RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT The City has received two grant awards for the operation of the Latimer County Drug Task Force. The first is from the Office of National Drug Control Policy in the amount of$45,150. The second is the Edward Byrne Memorial Justice Assistance Grant FY 2008 in the amount of$21,536. These grants will be used for Task Force operating expenses. In addition, $210,000 will be transferred from the Larimer County Drug Task Force forfeiture reserve account to the City of Fort Collins General fund to establish the 2009 annual operating budget for expenses that are not grant funded. There is no financial impact to the City of Fort Collins as there are no matching funds required. EXECUTIVE SUMMARY Fort Collins Police Services applied to the Office of National Drug Control Policy and the Department of Justice on behalf of the Latimer County Drug Task Force for federal grant monies to help fund the investigation of illegal narcotics activities in Larimer County. These grant awards will be used to offset operating expenses for each participating agency. In addition, because of the significant decrease in federal funds available for drug enforcement, the Drug Task Force is transferring $210,000 from its forfeiture reserve account to its 2009 operating budget to cover unfunded expenses. The majority of the forfeiture reserve account is made up of assets seized from people engaged in illegal drug activities. This appropriation is not a request to identify new dollars for the Police Services' 2009 budget. This action appropriates the$45,150 and$21,536 in new federal grant money and authorizes the transfer of$210,000 from the forfeiture reserve account for unfunded operating expenses for 2009. The Larimer County Drug Task Force currently includes Fort Collins Police Services, Loveland Police Department and the Colorado State University Police Department. ORDINANCE NO.020, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE AND TRANSFERRING PRIOR YEAR RESERVES IN THE LARIMER COUNTY DRUG TASK FORCE RESERVE TO THE GENERAL FUND FOR THE LARIMER COUNTY DRUG TASK FORCE WHEREAS, the Office of National Drug Control Policy has awarded Fort Collins Police Services ("FCPS") a grant of federal money in the amount of$45,150; and WHEREAS,the Office of Drug Control and System Improvement has awarded FCPS a grant in the amount of$21,536; and WHEREAS, there are $210,000 in prior year reserves in the Latimer County Drug Task Force Reserve in the General Fund; and WHEREAS,the two grants and prior reserve funds will be used by the Larimer County Drug Task Force (the "Task Force") to help fund the investigation of illegal narcotics activities and the 2009 annual operating budget of the Task Force; and WHEREAS, the Task Force consists of representatives from FCPS, Loveland Police Department, and the Colorado State University Police Department; and WHEREAS, the City and FCPS will administer the two grants for the Task Force; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 9, of the Charter permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated; and WHEREAS,City staff has determined that the appropriation of the grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year. WHEREAS, it is the desire of the City Council to appropriate unanticipated revenue and prior year reserves in the Latimer County Drug Task Force Reserve for transfer to the General Fund for appropriation therein for Police Services for the Multi jurisdictional Drug Task Force Grant Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows : Section 1 . That there is hereby appropriated from unanticipated grant revenue in the General Fund the sum of SIXTY SIX THOUSAND SIX HUNDRED EIGHTY SIX DOLLARS ($ 66,686) for expenditure, upon receipt, in the General Fund for Police Services for the Multi- jurisdictional Drug Task Force Grant Project. Section 2 . That there is hereby appropriated from prior year reserves in the Larimer County Drug Task Force Reserve the sum of TWO HUNDRED TEN THOUSAND DOLLARS ($210,000) for transfer to the General Fund, and appropriated therein, for Police Services for the Multi jurisdictional Drug Task Force Grant Project.
