Resolution 2005-139 Authorizing a Revocable Permit For Civil, Environmental, Cultural and
Geotechnical Surveys on Meadow Springs Ranch.
RECOMMENDATION
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT
Williams Pipeline will pay all costs associated with its activities.
EXECUTIVE SUMMARY
Williams Pipeline is considering the construction of a twenty inch (20') diameter Liquid Natural
Gas pipeline under a portion of Meadow Springs Ranch in northern Weld County along and near
a presently-existing pipeline. Survey crews for Williams are asking to enter Meadow Springs
Ranch in December or January to conduct an initial route (civil) survey. Then, in the spring after
local plants have bloomed, Williams is further asking to send an environmental survey team to
the Ranch to conduct an environmental impact assessment. Only after those two surveys have
been completed will Williams design the proposed route of the new pipeline and determine
whether said route will cross City-owned property at Meadow Springs Ranch or on other
property. At that time, should Williams decide to construct this new pipeline within City-owned
property, Williams will enter into negotiation with the City to purchase appropriate easement
rights and request that Council approve an appropriate written easement prior to initiation of
construction.
RESOLUTION 2005-139
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A REVOCABLE PERMIT FOR CIVIL, ENVIRONMENTAL,
CULTURAL AND GEOTECHNICAL SURVEYS ON MEADOW SPRINGS RANCH
WHEREAS, the City of Fort Collins is the owner of that certain real property located in
Weld County, Colorado, and known as Meadow Springs Ranch(the"Ranch'),which is located in
the northernmost part of the State of Colorado,a portion of which is shown in the legal description
attached hereto as Exhibit"A" and incorporated herein by this reference (the "Permit Area"); and
WHEREAS, Williams Pipeline("Williams"),is considering the possibility of constructing
a pipeline on or near the Ranch and has asked the City to authorize its survey crews to enter the
Permit Area in December,2005,or January,2006,in order to conduct the initial route(civil)survey
and again in the Spring of 2006, after local plants have bloomed, to conduct an environmental
survey,for a total permit period of two hundred forty(240)days from and after December 20,2005;
and
WHEREAS, City staff has reviewed the request to utilize the Permit Area for survey
purposes, and believes that said surveys or survey crews will not interfere with or adversely affect
the City owned property,based on current expectations; and
WHEREAS,as a condition of the issuance of a revocable permit,Williams will be required
to return the Ranch property to as near as possible its current condition; and
WHEREAS,Article XI, Section 10,of the Charter of the City of Fort Collins authorizes the
Council to permit the use of occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant
a revocable permit to Williams, d/b/a Overland Pass Pipeline, consistent with the terms of this
Resolution,including such additional terms and conditions as the City Manager,in consultation with
the City Attorney,deems necessary or appropriate to protect the interests of the City or to effectuate
the purposes of this Resolution.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins
commenced on this 20th day of December A.D. 2005.

Part of the South Half(S 1/2) of Section Twenty (20), in Township 12 North, of Range 67 West of
the 6'P.M., lying East of the C&S Railroad and lying West of Interestate-25, consisting of 135.4
acres, more or less, all in Weld County, Colorado.
