RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY Additional appropriations in the amount of$160,889 are needed for Airport improvements that are listed on Attachment 1 - Airport Capital Improvement Summary with Funding Sources for Years 2005 and 2006 (the "Summary"). In order for the Cities to expend this amount, each City must appropriate its half, $80,444. The projects included on the Summary have been identified as high-priority and are supported by the FAA and State Division of Aeronautics. The notable additional project on the Summary is the purchase of a high-speed snow plow truck with blade and power sweeper. The Colorado Aeronautical Board and the Division of Aeronautics awarded the Fort Collins-Loveland Municipal Airport a grant in the amount of$250,000 for aviation purposes. A portion of the aforementioned grant proceeds was previously appropriated for capital improvements in the 2005 Airport operating budget and the Airport Manager recommends that unappropriated grant proceeds,totaling$160,889, be appropriated and used with other, previously appropriated, Airport funds to purchase snow removal equipment. Ordinance No. 128, 2005, was unanimously adopted on First Reading on November 2, 2005. ORDINANCE NO. 128, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE APPROPRIATION OF FUNDS OF THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT FOR EXPENDITURE TO BE USED TO PURCHASE SNOW REMOVAL EQUIPMENT FOR USE AT THE AIRPORT WHEREAS, in 1963, the City of Fort Collins and the City of Loveland agreed to the establishment of a regional general aviation facility and became owners and operators of the Fort Collins-Loveland Municipal Airport(the"Airport'); and WHEREAS, the Airport is operated as a joint venture between the City of Fort Collins and the City of Loveland (the "Cities"), with each city retaining a 50% ownership interest, sharing equally in policy-making and management, and with each assuming responsibility for 50%of the capital and operating costs associated with the Airport; and WHEREAS, on September 30, 2005, the Colorado Aeronautical Board and the Division of Aeronautics awarded the Fort Collins-Loveland Municipal Airport an aviation system grant, in the amount of $250,000, to be used to for aviation purposes, in compliance with grant procedures and requirements as defined in the Division's Grant Program Project Management Manual; and WHEREAS, a portion of the aforementioned grant proceeds was appropriated for capital improvements in the 2005 Airport operating budget; and WHEREAS, the Airport Manager recommends that unappropriated grant proceeds, totaling$160,889,be appropriated and used with other,previously appropriated, Airport funds to purchase snow removal equipment; and WHEREAS, the aforementioned grant requires matching funds; and WHEREAS, said matching funds have already been appropriated and included in the 2005 budget of the Airport; and WHEREAS, under the Intergovernmental Agreement between the Cities, the City of Loveland is providing finance and accounting services for the Airport and the City of Fort Collins' share of existing and unanticipated Airport revenue will be held and disbursed by the City of Loveland, as an agent on behalf of the City of Fort Collins; and WHEREAS, in accordance with Article V, Section 8(b), of the Charter of the City of Fort Collins, any expense or liability entered into by an agent of the City, on behalf of the City, shall not be made unless an appropriation therefore shall have been made by the City Council. WHEREAS, it is the desire of the City Council to authorize the appropriation of$80,444 from the proceeds of the aviation system grant from the 2005 Colorado Aeronautical Board and the Division of Aeronautics, representing the City of Fort Collins' 50% share, to be used to purchase snow removal equipment at the Airport. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council hereby authorizes the appropriation of EIGHTY THOUSAND FOUR HUNDRED FORTY-FOUR DOLLARS ($80,444) to be used to purchase snow removal equipment at the Fort Collins-Loveland Municipal Airport. Introduced, considered favorably on first reading, and ordered published this 2nd day of November, A.D. 2005, and to be presented for final passage on the 15th day of November, A.D. 2005.
