Resolution 2009-040 Authorizing the City Manager to Investigate Options for a Cooperative
Arrangement That Would Provide Wastewater Treatment Services to Boxelder Sanitation District
and to Negotiate a Related Agreement for Future Council Consideration.
RECOMMENDATION
Staff recommends adoption of this Resolution.
At its March 31, 2009 meeting,the Water Board voted unanimously to recommend approval of the
Resolution.
FINANCIAL IMPACT
Some staff time will need to be allocated. Any agreement negotiated will use the cost of service
methodology.
EXECUTIVE SUMMARY
As an alternative to any modifications or new construction, Boxelder Sanitation District has asked
the City of Fort Collins about the possibility of the City providing wastewater treatment services for
the District in the future. The potential regional consolidation of wastewater services would
eliminate a wastewater treatment plant in the Fort Collins area and increase efficiencies that could
benefit the District, the City, and the region.
Due to drought and water conservation, currently the City facilities could accommodate part or all
of the District's flow. This request is timely as the City Wastewater Division is beginning the
updating process for the Wastewater Treatment Master Plan. The District request could be formally
reviewed as part of this process to predict any future impacts.
BACKGROUND
The Boxelder Sanitation District (the District) service area borders the City of Fort Collins
Wastewater Utility service area to the north and east. The District currently provides wastewater
services to customers within portions of the Fort Collins, Fort Collins Growth Management Area,

the town of Timnath, and Larimer County. The District anticipates future service being provided
to portions of Weld County.
Boxelder Sanitation District operates sewer lines, an industrial pretreatment program and a
wastewater treatment plant. The treatment plant is a lagoon system and is located at the confluence
of Boxelder Creek and the Cache la Poudre River,just downstream from the City's Drake Water
Reclamation facility and has a current capacity of approximately 2 million gallons per day(MGD).
The District will need to modify the existing treatment facility or construct a new facility at the
current location to meet future regulatory and capacity needs. Future capacity that the District will
need is currently predicted to be 8 to 10 MGD and would require a new much larger mechanical
facility, similar to those operated by the City of Fort Collins.

RE: Boxelder Sanitation District Request for Service
The Water Board heard a presentation from Steve Comstock, Water Reclamation and Biosolids
Division Manager, at the March 31 regular meeting on the possibility of the City providing
wastewater treatment services to the Boxelder Sanitation District (the "District"). The District
will soon need to update its current facility or construct a new facility to meet upcoming
regulations and to expand its capacity. At the same time,the City is beginning the update for its
Wastewater Treatment Master Plan.
Boxelder Sanitation District provides services to a portion of Fort Collins and its Growth
Management Area, the town of Timnath, and Larimer County. The Drake Water Reclamation
facility currently has excess capacity due to reduced water usage and could accommodate part or
all of the District's flow. The Utility staff is requesting authority to investigate options and to
negotiate an agreement with the District to provide wastewater treatment services to them.
The Board asked a variety of questions and made comments about the proposal. It was suggested
the service proposal may have implications for land use issues relating to the development and
annexation discussions between the City and Timnath, and that these issues should be considered
by the Planning and Zoning Board rather than the Water Board. Another question concerned
whether all the special districts could be consolidated into one regional wastewater treatment
plant. The history of the past proposed, but never built, regional plant by Windsor was given. A
question about the cost effectiveness of one large facility versus two separate facilities was also
discussed. The response was that one large plant treating wastewater from both districts would
be more cost effective and that they would have an option to discharge to either Boxelder Creek
or the Poudre River.
A motion was made by Board Member Johannes Gessler to recommend the City Manager be
authorized to investigate options for and to negotiate a cooperative agreement with Boxelder
Sanitation District(the District) to provide wastewater treatment services to the District. The
motion was seconded by Board Member Eileen Dornfest, and the vote was unanimous in favor
of the recommendation.
The Water Board would appreciate the opportunity to review any plan or negotiated agreement.

Recommendation
City of Fort Collins Water Board passed a motion
unanimously in support of this resolution and
recommends that the City Manager be authorized to
investigate options for and to negotiate a cooperative
agreement with Boxelder Sanitation District (the
District) to provided wastewater treatment services to
the District.
Staff recommends adoption of this resolution.

OF THE CITY COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO INVESTIGATE OPTIONS FOR A
COOPERATIVE ARRANGEMENT THAT WOULD PROVIDE WASTEWATER
TREATMENT SERVICES TO BOXELDER SANITATION DISTRICT AND
TO NEGOTIATE A RELATED AGREEMENT FOR FUTURE COUNCIL CONSIDERATION
WHEREAS,the Boxelder Sanitation District(the"District")service area borders the City's
Wastewater Utility service area and the District provides wastewater service to customers within
portions of Fort Collins, the Fort Collins growth management area, the Town of Timnath, and
Larimer County, and anticipates future service to properties within Weld County; and
WHEREAS,the District currently operates sewer lines,an industrial pretreatment program,
and a wastewater treatment plant; and
WHEREAS, the District will need to make modifications to its existing plant or construct
a new plant at its current site to continue to comply with applicable regulations and meet future
capacity needs; and
WHEREAS,as an alternative to modifying its existing plant or constructing a new plant,the
District,after becoming aware of other City contractual sewer agreements,desires to confer with the
City regarding possible arrangements under which the City would provide for the treatment of some
or all of the wastewater flows to meet the District's near term and future needs; and
WHEREAS,if such wastewater treatment arrangements are made,the District will maintain
its independence from the City and the City will assess charges related to the cost of providing
treatment for the District's wastewater flows; and
WHEREAS, consolidation of wastewater treatment services would eliminate a wastewater
treatment plant in the Fort Collins area, and increase efficiencies that could benefit the City, the
District and the region; and
WHEREAS,the City is authorized to enter into intergovernmental agreements to provide any
function, service or facility, as provided in Article II, Section 16 of the Charter of the City of Fort
Collins and Section 29-1-203, C.R.S.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager is hereby authorized and directed to investigate options for a
cooperative agreement to provide wastewater treatment services to Boxelder Sanitation District,and
to negotiate a related agreement for future presentation to and consideration by the City Council.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 21 st
day of April A.D. 2009.
