RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY This Ordinance, unanimously adopted on First Reading on April 21, 2009, authorizes staff to rent the City-owned house located at 149 Grandview for up to five years. ATTACHMENTS 1. RECOMMENDATION Staff recommends the adoption of the Ordinance on First Reading. FINANCIAL IMPACT Rent collected from this lease will resul��t leas$10 OOOj�in unanticipated revenue to the Cemetery Fund. Tenant will pay���Yellec�cit�xpense�household water expense. EXECUTIVE SUMMARY The City built this house for use by the Cemetery Superintendent. Since this position has been eliminated, the City does not need to use this house as a staff residence. This house has been a leased property for Grandview Cemetery since 1999. In the future, the area where the house is located will be needed for more cemetery space. Prior to that time, renting the house will generate income that the Cemetery staff can utilize. Staff also believes vandalism can be discouraged by keeping the house occupied. Location map. `�/ ORDINANCE NO. 039, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 149 GRANDVIEW AVENUE FOR UP TO FIVE YEARS WHEREAS, the City is the owner of a residential property located at 149 Grandview Avenue, Fort Collins, Larimer County, Colorado (the"Property"); and WHEREAS, the Property was formerly the residence of the Cemetery Superintendent; and WHEREAS, the Superintendent position has been eliminated and the City no longer needs to use this house as a staff residence; and WHEREAS, City staff desires to lease the Property for a period of up to five years at an annual rate of at least $10,000; and WHEREAS,pursuant to Section 23-111(a)of the City Code, the City Council is authorized to sell, convey or otherwise dispose of any and all interests in real property owned in the name of the City, provided that the City Council first finds,by ordinance, that such sale or other disposition is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That leasing the Property at 149 Grandview Avenue as provided herein is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement for the Property, consistent with the terms of this Ordinance, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary and appropriate to protect the interests of the City or to effectuate the purposes of this Ordinance, including, but not limited to,any necessary changes to the legal description of the Property,so long as such changes do not materially increase the size or change the character of the property to be leased.
