RECOMMENDATION Staff and the Art in Public Places Board recommend adoption of the Resolution. FINANCIAL IMPACT The Cit Park Sheldon Lake art budget is 67$ 006 to be used for design,fabrication, Y g gn, cation,installation,and contingency for this project. The funds for this project have been appropriated in the Art in Public Places Reserve Account in the Storm Drainage Utility Fund. The Art in Public Place r g ty s program has a maintenance fund for the long-term care of the APP art collection. EXECUTIVE SUMMARY This Resolution approves expenditures of $67,006 for design, fabrication, installation and contingency for a project to install a sculptural element by Brower Hatcher Studios on the shoreline of City Park's Sheldon Lake. BACKGROUND Section 23-303 of the City Code,which was added in 1995,established Art in Public Places Reserve Accounts within the Light and Power, Water, Wastewater and Storm Drainage Funds, and designated them for use in acquiring or leasing works of art,maintenance,repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by the Council in Ordinance No. 020, 1995. The Council permanently adopted the Art in Public Places Program, and reenacted City Code Chapter 23, Article IX, with certain modifications in 1998. The Art in Public Places(APP)Board moved to select an artist for this project using an RFP process through the City's Purchasing Department. The Selection Committee chose artist Brower Hatcher. May 16, 2006 -2- Item No. 22 Brower Hatcher worked with the proj ect team to create a design concept appropriate to the site. This design concept was reviewed and recommended by the Project Team and the APP Board. The APP Board reviewed the design for this project its regular meeting on October 19, 2005. The artist,along with the project team,proposes a geometric dome structure arching toward the path of the sun in Fort Collins. The dome consists of powder-coated stainless steel rods, and brass and stainless steel hardware. It sits atop four cultured-stone columns that reference the stone native to the site and early Fort Collins architecture. The artwork is also meant to reference a gazebo-like structure that was located at Sheldon Lake in the early 1900's. In addition, solar cells will be mounted within the geometry of the dome. The power generated by these cells will operate LED lights at the lower layers of the dome, which become illuminated at night.A manual switch will allow an override of the automatic illumination process.The artist will consult with the Fort Collins-based business Solar Bound on all solar-power components. Progressive layers of geometry were added to a basic dome shape, each layer being drawn toward the path of the sun. The resulting form is a record of the process. In addition, solar cells will be mounted within the geometry of the dome. The power generated by these cells will operate LED lights at the lower layers of the dome, which become illuminated at night. A manual switch will allow an override of the automatic illumination process. The artist will consult with the Fort Collins-based business Solar Bound on all solar-power logistics. Overall, the artwork is 13' h x 10' 6"w x 7' 9"d. The dome consists of powder coated stainless steel rods, and brass/stainless steel hardware. It sets atop four cultured- stone columns that reference the stone native to the site, and the neoclassical style of early Fort Collins architecture. Other Business: APP Staff has created anew sign for"Making Tracks," by David Griggs at the Civic Center Parking Structure. A Xeriscape Garden Party for"Watershed Stones"by Richard Hansen will be held on Friday Oct.28 at City Hall's Xeriscape Demonstration Garden. APP Staff continues regular maintenance on projects as needed. A City board &commission appreciation event will be held on Wednesday Nov.9,in the Canyon West Room at the Lincoln Center. Adjournment: 428 p.m R7pectf Sub it d, Corundlach Art 4A Public Places Program Assistant RESOLUTION 2006-056 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE STORM DRAINAGE UTILITY FUND TO COMMISSION AN ARTIST TO CREATE A SCULPTURAL ELEMENT FOR THE CITY PARK SHELDON LAKE SHORELINE WHEREAS, Section 23-303 of the City Code established the Art in Public Places Reserve Accounts in the Light and Power, Water, Wastewater and Storm Drainage Funds for use in the acquisition or leasing of works of art, maintenance, repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council in Ordinance No. 020, 1995 (the"Guidelines'); and WHEREAS,the City's stormwater utility recently completed a capital improvement project in and around Sheldon Lake in City Park(the"Project Site"),which included the installation of box culverts and storm sewers, the expansion of Sheldon Lake, and the creation of a stormwater detention facility on the City Park Nine Golf Course (the"Project"); and WHEREAS, pursuant to Section 23-304 of the City Code, one percent (1%) of the funds from the Project has been set aside in the Art in Public Places Reserve Account in the Storm Drainage Fund to be used for public art (the "Art Project") at the Project Site; and WHEREAS,the Art in Public Places Board(the`Board"),voted to select an artist for the Art Project through an RFP process with the City Purchasing Department; and WHEREAS,a Selection Committee selected Brower Hatcher Studios(the"Artist")to create a design concept appropriate to the Project Site; and WHEREAS,the Board evaluated the Artist's final design at its regular meeting on October 19, 2005, pursuant to the Guidelines; and WHEREAS, based on that evaluation, the Board voted to recommend the Artist's proposal for a geometric steel dome atop cultured-stone columns illuminated by solar powered lights; and WHEREAS,the estimated cost to create the Art Project,including commission of the Artist, fabrication, installation and contingency for the Art Project, is $67,006; and WHEREAS,those funds have been appropriated in the Art in Public Places reserve account in the Storm Drainage Utility Fund to provide for the artist design fees, fabrication,installation and contingency for the Art Project; and WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the recommended art be presented for Council review and approval,because the cost of the art exceeds $10,000; and WHEREAS,pursuant to Section 23-303 of the City Code,monies credited to Utility Art in Public Places reserve accounts shall be expended only for the acquisition of works of art that provide a betterment to such utility or that are otherwise determined by the City Council to be for a specific utility purpose that is beneficial to the rate payers of such utility. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that the Art Project proposed provides a betterment to the stormwater utility. Section 2. That the Council hereby authorizes the expenditure of up to SIXTY SEVEN THOUSAND SIX DOLLARS($67,006)from the Art in Public Places reserve account in the Storm Drainage Fund for the Art Project, located at Sheldon Lake in City Park, consisting of a geometric steel dome atop cultured-stone columns illuminated by solar powered lights, which project was proposed by Brower Hatcher Studios, and the conceptual design of which was reviewed and approved by the Art in Public Places Board on October 19, 2005.
