EXECUTIVE SUMMARY This Ordinance, which was unanimously adopted on First Reading on April 18, 2006, amends the City of Fort Collins District-Precinct Map, which was adopted by Council on November 16, 2004, by adjusting precinct boundaries to correspond with election precincts established by Larimer County. These changes do not affect Council District boundaries. EXECUTIVE SUMMARY This Ordinance amends the City of Fort Collins District-Precinct Map, which was adopted by Council on November 16, 2004, b adjustin precinct boundaries to correspond with election precincts established by Lari e c n not affect Council District boundaries. BACKGROUND Section 7-66 of the City Code provides that the Council shall,by ordinance, divide the City into as many election precincts as deemed necessary for the convenience of registered electors in the City. Insofar as practicable, boundaries must correspond with the election precincts established by the County. In February 2006, Latimer County amended its precinct boundaries pursuant to C.R.S. 1-5-101(3), which requires at least one precinct for every 2,000 active eligible electors. Due to growth,Latimer County found it necessary to split three Fort Collins precincts into seven precincts. One precinct, in District 4, was split into two precincts (Attachment 1). One precinct in District 3 was split into two precincts (Attachment 2C er ecinct in District 3 was split into three precincts (Attachment 3). In addition to the new precincts created by Larimer County's splitting of precincts, three new precincts have been added as a result ofthe Boma,Crawford,and Interchange Business Park 2nd and 3rd annexations. These annexations are located in County precincts that previously did not include any property within the Fort Collins city limits. To maintain corresponding boundaries with County April 18, 2006 -2- Item No. 12 precincts, three new City precincts must be created. These new precincts do not affect Council District boundaries. Although the District-Precinct map will likely be amended this fall to adjust District boundaries in order to balance the number of registered voters between Districts pursuant to the requirements of the City Code and Charter, staff believes it necessary to make precinct boundary adjustments now due to the possibility of a special election in September on the collective bargaining Charter amendment. Staff believes it is in the City's best interest to have precinct boundaries that match Larimer County's precincts, because it will allow the City to obtain accurate, relevant voter registration records from the County Elections Office. ORDINANCE NO. 065, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE CITY OF FORT COLLINS DISTRICT-PRECINCT MAP WHEREAS, by Ordinance No. 167, 2004, Council adopted the District-Precinct Map (the "Map") for the 2005 Regular Municipal Election; and WHEREAS, the Map includes election precinct boundaries established pursuant to Section 7-66 of the Code of the City of Fort Collins which provides that, insofar as practicable, boundaries must correspond with the election precincts established by Larimer County(the"County"); and WHEREAS, in February 2006 the Cou nty adjusted its preci nct boundaries thereby causing inconsistencies between County precinct boundaries and City precinct boundaries; and WHEREAS,in addition to precinct boundary changes made by Larimer County,the City has annexed land in certain County precincts that previously did not contain any property included in the Fort Collins city limits, thereby creating the need for additional City precincts; and WHEREAS, the Council has determined that it is in the best interest of the citizens of Fort Collins to amend the previously adopted Map to correspond City precinct boundaries with the County precinct boundaries, as shown on the Amended District-Precinct Map, dated May 12, 2006 the "Amended( Map"), which is on file in the office of the City Clerk and which is incorporated herein by this reference. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section1. That the Cityof FortCollins District-Precinct Map,adopted by Ordinance No. 167, 2004 on November 16, 2004, is hereby amended by adjusting election precinct boundaries to correspond with County precinct boundaries, and by renumbering precincts as necessary, pursuant to the Amended Map heretofore referenced. Section 2. That the Amended Map shall be used for determining residency for voter registration purposes for any special municipal election held following the effective date of this Ordinance and prior to the adoption of a District-Precinct Map for the next ensuing regular municipal election,except for any special municipal election held in conjunction with a consolidated or general election conducted by Larimer County.
