EXECUTIVE SUMMARY
This Ordinance, which was unanimously adopted on First Reading on February 21, 2006, amends
Section 2-203 of the Code to clearly authorize the Cultural Resources Board to disburse both
Cultural Development and Programming Account and Tourism Programming Account funds.

EXECUTIVE SUMMARY
The purpose of the Ordinance is to correct an error in the City Code. The Cultural Resources
Board, as one of its functions funCi e, m dations to the City Council

Fund Program only allocated e Cu r evelop ent and Programming Account.
In 1997, the Council passed 7, am g Section 2-203 of the Code
regarding the functions of the Cultural Resources Board, and Resolution 1997-060, amending the
Fort Fund Guidelines, to allow the Fort Fund Program to also allocate funds from the Tourism
Programming Account. hi 1999, Ordinance No. 023, 1999 was passed by the Council to add a
new function of the Cultural Resources Board to Section 2-203 of the Code. Unfortunately,
when the 1999 Ordinance was drafted, it did not include the changes made to Section 2-203 in
1997, and by approval of the 1999 Ordinance, the words "Tourism Programming Account' were
unintentionally deleted from Section 2-203. This error was just recently discovered. Approval
of this Ordinance would amend Section 2-203 of the Code to clearly authorize the Cultural
Resources Board to disburse both Cultural Development and Programming Account and
Tourism Programming Account funds.
ORDINANCE NO. 032, 2006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 2-203 OF THE CODE OF THE CITY OF FORT COLLINS
REGARDING THE FUNCTIONS OF THE CULTURAL RESOURCES BOARD
WHEREAS,one of the functions of the City's Cultural Resources Board(the"Board")is to
review proposals for funding from the City's "Fort Fund" program and make recommendations to
the City Council regarding such proposals; and
WHEREAS, up until 1997, the Board's functions under Section 2-203 of the City Code
authorized the Board to make funding recommendations to the Council only for funds in the Cultural
Development and Programming Account; and
WHEREAS,in 1997 the City Council determined that funds from the Tourism Programming
Account should also be allocated through the Fort Fund program, and by Ordinance No. 074, 1997
the Council amended Section 2-203(3) of the City Code to state that the Board could review
proposals for funding from both the Cultural Development and Programming and Tourism
Programming Accounts; and
WHEREAS, in 1999 the Council adopted Ordinance No. 023, 1999 which added a new
Board function to Section 2-203(5) of the City Code; and
WHEREAS,Ordinance No.023, 1999 mistakenly omitted from Section 2-203(3)the words
"and the Tourism Programming Account"that had been added in 1997; and
WHEREAS, the Council wishes to correct the error made in 1999.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 2-203(3)of the Code of the City of Fort Collins is hereby amended to read
as follows:
Sec. 2-203. Functions.
(3) To review proposals for funding from the Cultural Development and
Programming Account and the Tourism Programming Account, following
established and published guidelines, and to submit recommendations
regarding such proposals to the City Council to be approved by the Council
by resolution.
