ITEM NUMBER: 21 AGENDA ITEM SUMMARY DATE: January 3, 2006 FORT COLLINS CITY COUNCIL STAFF: Darin Atteberry SUBJECT Emergency Ordinance No. 006, 2006, Temporarily Suspending the Operation and Enforcement of the Land Use Code and Zoning Map Regarding the Usage of the"Ricker Building"as an Emergency Daytime Severe Winter Weather Shelter for the Homeless. RECOMMENDATION Staff recommends adoption of the Ordinance. EXECUTIVE SUMMARY The City was recently approached by several agencies with a request to provide a City facility for use as a severe winter weather daytime shelter for the homeless. The"Ricker Building"located at 220 North Howes Street will be made available for this purpose through April,2006. United Way of Latimer County will operate as the fiscal agent, and Catholic Charities Northern will run the program. A minimum of three paid individuals,including a program director,will be on site,as will volunteers. Individuals entering the facility will be screened by the staff, and individuals smelling of alcohol, visibly impaired, or disruptive will be denied entry. A separate, supervised space will be provided for women and children. The facility will only be open between the hours of 8:00 am and 4:00 pm on weekdays when the temperature is forecast to reach a high temperature/wind chill temperature/wet bulb temperature of no more than 30 degrees Fahrenheit. The decision to open will be made by 3:00 pm the day prior to opening, based on forecast information. The City Charter requires the affirmative vote of at least five Councilmembers for the passage of an emergency ordinance. EMERGENCY ORDINANCE NO. 006, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS TEMPORARILY SUSPENDING THE OPERATION AND ENFORCEMENT OF THE LAND USE CODE AND ZONING MAP REGARDING THE USAGE OF THE"RICKER BUILDING"AS AN EMERGENCY DAYTIME SEVERE WINTER WEATHER SHELTER FOR THE HOMELESS WHEREAS,it has come to the attention of the City Manager and City Council that there is presently no location within the City for an emergency daytime shelter for the homeless in the event of severe winter weather; and WHEREAS,severe winter weather could strike at any moment,necessitating the utilization of an emergency ordinance to adequately address this need; and WHEREAS, the City is the owner of the "Ricker Building" located at 220 North Howes Street and more particularly described as Lots 29,30,31,32 and 33,Block 32,Fort Collins,County of Larimer, State of Colorado; and WHEREAS, the Council has determined that the Ricker Building should be used as an emergency daytime severe winter weather shelter for the homeless in the interest of protecting the health, safety and welfare of the homeless; and WHEREAS, Article 11, Section 6 of the Charter of the City of Fort Collins authorizes the Council to adopt emergency ordinances, which shall be finally passed on first reading by the affirmative vote of at least five members of the Council and which shall contain the specific statement of the nature of the emergency. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the threat of severe winter weather has presented an emergency to the homeless of the City such that it is fitting and appropriate for the Council to suspend the application and enforcement of the Land Use Code and the related Zoning Map to that certain property known as the"Ricker Building"more particularly described as Lots 29, 30, 31, 32 and 33, Block 32, Fort Collins, County of Larimer, State of Colorado,to allow for the usage of the Ricker Building as an emergency daytime severe winter weather shelter for the homeless,provided that:(a) the suspension of the application and enforcement of the Land Use Code pursuant to this Ordinance shall apply only from and after the date hereof and shall continue only through April 30, 2006; and(b) during said period of time, the City Manager is authorized to utilize the "Ricker Building" as an emergency daytime severe winter weather shelter for the homeless only when the high daily temperature is forecast to reach a temperature/wind chill temperature/wet bulb temperature of no more than 30 degrees Fahrenheit. Section 2. That the City Clerk is hereby directed to cause the publication of this Ordinance in the Fort Collins Coloradoan no later than January 10, 2006. Introduced, considered favorably by five (5) members of the Council of the City of Fort Collins and finally passed as an emergency ordinance and ordered published this 3rd day of January, A.D. 2006.
