SUBJECT
Resolution 2009-027 Authorizing the Lease of City-Owned Property at 212 West Mountain Avenue
for Up to One Year.
RECOMMENDATION
Staff recommends the adoption of the Resolution.
FINANCIAL IMPACT
Rent collected from this lease will result in $5,187 per month in unanticipated revenue to
Miscellaneous Revenue - General Fund. Tenant will be responsible for all expenses for utilities,
janitorial, and taxes (if applicable).
EXECUTIVE SUMMARY
The City and the County purchased the property at 212 West Mountain Avenue in 1985 as part of
the Block 31 purchases. The current tenant's lease will expire March 31, 2009 and the tenant is in
the process of relocating. Staff recommends leasing this property until this area of Block 31 is
needed for future improvements.
BACKGROUND
In the Intergovernmental Agreement dividing Block 31,this property was quit claimed to the City.
The County occupied this building until the new County Courthouse was completed in the summer
of 2003. This building has a total of 7,704 square feet, of which 6,225 is currently usable. In 1998,
this property was identified for the future Performing Arts Center. In addition, this particular site
has been slated as a potential site for the Downtown Development Authority amphitheater.
Larimer Center for Mental.Health (formerly Island Grove Regional Treatment Center) has been
leasing this building since 2004. The lease expires March 31, 2009. They are currently in the
process of acquiring a new facility and have tentatively scheduled to vacate 212 West Mountain in
June or July 2009.

The monthly lease payment for this property,will be $5,187. In addition, the tenant will be
responsible for the following expenses: taxes (if applicable), all utilities, and janitorial.

RESOLUTION 2009-027
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY
AT 212 WEST MOUNTAIN AVENUE FOR UP TO ONE YEAR
WHEREAS, the City is the owner of real property located at 212 West Mountain
Avenue, Fort Collins, Larimer County, Colorado (the "Property"); and
WHEREAS, the Property was purchased as part of the Block 31 purchases and has been
identified as the location of the future Performing Arts Center; and
WHEREAS, the City does not have a present use for the Property; and
WHEREAS, the City currently leases the Property to the Larimer Center for Mental
Health (LCMH), whose lease will expire March 31, 2009; and
WHEREAS, LCMH is in the process of acquiring a new facility, but may not be ready to
move until June or July 2009; and
WHEREAS, the City desires to continue to lease the Property to LCMH for a period of
up to one year at a monthly rate of$5,187.50; and
WHEREAS, when LCMH moves out, the City may seek a new tenant for the Property;
and
WHEREAS, the lease of the Property is beneficial in that it will generate revenue, reduce
the City's costs for utilities for the Property, and also discourage vandalism of the Property; and
WHEREAS, under Section 23-114 of the City Code, the City Council is authorized to
lease, for a definite term of two years or less, any and all interests in real property owned in the
name of the City, provided that the City Council first finds, by resolution, that the lease is in the
best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the City Council hereby finds that leasing the Property at 212 West
Mountain Avenue for up to one year as provided herein is in the best interests of the City.
Section 2. That the City Manager is hereby authorized to execute a lease agreement
for the Property, consistent with the terms of this Resolution, together with such additional terms
and conditions as the City Manager, in consultation with the City Attorney, deems necessary or
appropriate to protect the interests of the City or to effectuate the purposes of this Resolution.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this
24th day of March, A.D. 2009.
