Ordinance Nos. 100, 101, 102, and 103, 2005, were unanimously adopted on First Reading on September 20, 2005. ORDINANCE NO. 100, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR THE CLIMATE WISE PROGRAM WHEREAS,the Air Quality Plan,an element of City Plan most recently updated by the City Council in Resolution 2004-072 in May 2004, identifies an overarching air quality goal of continually improving air quality as the city grows; and WHEREAS, the Air Quality Plan contains an air quality policy to reduce Fort Collins greenhouse gas emissions 30% below worst-case 2010 levels; and WHEREAS, the City of Fort Collins' Climate Wise Program is a successful voluntary business outreach program that assists local organizations in reducing greenhouse gas emissions, air and water pollution,and solid waste generation,while increasing energy efficiency and reducing utility costs; and WHEREAS,the Climate Wise Program supports local economic development by supporting local businesses in increasing their environmental stewardship while improving their bottom line; and WHEREAS,the City of Fort Collins has been awarded a grant from the Colorado Pollution Prevention Advisory Board ("CPPAB") in the amount of$20,000; and WHEREAS, the CPPAB grant funds will be used to provide on-site pollution prevention assessments and other technical assistance to Climate Wise Program partners; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for the fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the grant funds from the CPPAB as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year. Mayor ATTEST: City Clerk ORDINANCE NO. 101, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR THE NATURAL RESOURCES RADON PROGRAM AND AUTHORIZING THE TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE NATURAL RESOURCES OPERATING BUDGET TO THE GRANT PROJECT WHEREAS, since 1995, the City has placed special emphasis on reducing radon in Fort Collins, where levels average about 4 picocuries per liter of air, which is the level at which the Environmental Protection Agency and the U.S. Surgeon General recommend action; and WHEREAS, the Fort Collins Natural Resources Radon Program (the "Program") is part of the City's indoor air quality program,which is guided by the Air Quality Plan with a policy goal to educate and encourage residents to reduce their exposure to indoor air pollution; and WHEREAS, the current radon program includes aggressive education, a voluntary radon testing program, mandatory radon mitigation in new construction, and an ordinance requiring the distribution of radon information to all residential home-buyers at point-of-sale; and WHEREAS, the City of Fort Collins has been awarded a grant from the Colorado Department of Public Health and Environment ("CDPHE") in the amount of$16,000; and WHEREAS, the CDPHE grant funds are to be used to continue radon education,encourage testing of homes, provide low cost test kits,and conduct a study to evaluate the effectiveness of the City's radon mitigation ordinance; and WHEREAS, the grant requires$16,000 of matching funds,which have been included in the 2005 Natural Resources budget and are available for transfer to the CDPHE project for the Program; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter") enables the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided the total amount of such supplemental appropriations, in combination with all previous appropriations for the fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of the CDPHE grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpected and unencumbered amount or portion thereof from one project to another project, provided that the purpose for which the transferred funds are to be expended remains unchanged. Mayor ATTEST: City Clerk ORDINANCE NO. 102, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR THE NATURAL RESOURCES CMAQ PROJECT AND AUTHORIZING THE TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE NATURAL RESOURCES OPERATING BUDGET TO THE GRANT PROJECT WHEREAS, motor vehicles remain the number one source of air pollution in Fort Collins; and WHEREAS,the Air Quality Plan has as a goal the reduction of total motor vehicle emissions of high priority pollutants by focusing on both technology and behavioral change; and WHEREAS, the Colorado Air Quality Control Commission has decided to terminate the motor vehicle emissions testing program in the North Front Range, including Fort Collins, in December 2006; and WHEREAS, the emissions testing program has helped to reduce tailpipe emissions and ozone-forming pollutants; and WHEREAS, the City of Fort Collins has been awarded Congestion Mitigation and Air Quality("CMAQ") grant funds from the Colorado Department of Transportation in the amount of $39,645; and WHEREAS, the CMAQ funds will be used to conduct a pilot project to identify and repair high-polluting vehicles and to test a voluntary "Change-of-Ownership" emission testing program; and WHEREAS, the grant requires $9,910 of matching funds which have been included in the 2005 Natural Resources budget and are available for transfer to the pilot project; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter") enables the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided the total amount of such supplemental appropriations, in combination with all previous appropriations for the fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the CMAQ grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpected and unencumbered amount or portion thereof from one project to another project, provided that the purpose for which the transferred funds are to be expended remains unchanged. Mayor ATTEST: City Clerk ORDINANCE NO. 103, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR THE NATURAL RESOURCES EMISSIONS TESTING TRANSITION PROJECT AND AUTHORIZING THE TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE NATURAL RESOURCES OPERATING BUDGET TO THE GRANT PROJECT WHEREAS, the City of Fort Collins has actively participated in a Multi-Jurisdictional Inspection and Maintenance Transition Committee(the"Committee") to evaluate ways to mitigate the increase in hydrocarbon emissions that will occur when the state mandated emissions testing program is terminated in December 2006; and WHEREAS the Committee has identified a number of regional approaches to lower volatile organic compounds that contribute to ground-level ozone formation; and WHEREAS, the City of Fort Collins has been awarded grant funding from the Colorado Department of Public Health and Environment ("CDPHE") in the amount of$5,200; and WHEREAS, the CDPHE grant funds will be used to conduct activities to reduce ozone- forming pollutants including conducting outreach to insure compliance with Stage I vapor recovery fueling protocols, seeking permission and placing "Stop at the Click" stickers on fuel pumps, and c) obtaining information from current emissions inspectors about strategies to maintain or increase public participation in vehicle maintenance and implementing an outreach effort; and WHEREAS, the grant requires $3,190 of matching funds which have been included in the 2005 Natural Resources budget and are available for transfer to the CDPHE Emissions Testing Transition Project; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter") enables the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided the total amount of such supplemental appropriations, in combination with all previous appropriations for the fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the CDPHE grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpected and unencumbered amount or portion thereof from one project to another project, provided that the purpose for which the transferred funds are to be expended remains unchanged. RECOMMENDATION Staff recommends adoption of the Ordinances on First Reading. FINANCIAL IMPACT The City has received the following grants to support air quality programs consistent with objectives identified in the City's Air Quality Plan: F 1. A$20,000 grant from tho Colorado Pollution Pnkenti` dvisory Board for support of the Climate Wise Program&t will advance the C ity's greephouse gas reduction goal identified in the City's Air Quality`Plan. No local mafoh is required. 2. A $16,000 grant from the Colorado Department of Public Health and Environment to continue radon outreach and conduct a study to determine the effectiveness of passive radon- reduction systems installed under Fort Collins'radon-resistant new construction ordinance. This grant requires a local match of$16,000; matching funds will be provided from the existing 2005 Air Quality Program budget. 3. A $39,645 Congestion Mitigation and Air Quality grant from the Colorado Department of Transportation to conduct a pilot project to identify and repair high-emitting vehicles. This grant requires a local match of$9,910; matching funds will be provided from the existing 2005 Air Quality Program budget. 4. BACKGROUND A. Colorado Pollution Prevention Advisory Board funding for Climate Wise This Ordinance appropriates$ ,000 f anti a r 'en i into the General Fund.The funding is provided by the Colorado P ution P venti of ory rd to help provide direct technical assistance to business partner tlye a W e Progra (the "Program"). The technical assistance consists of on-site pollution prevention assessments to new partner businesses,monitoring partner business progress, and providing follow-up implementation support and quantification of reductions to existing partner businesses in the program. The City of Fort Collins began the Program in 2000 as a local adaptation of the federal Climate Wise program (run by the Environmental Protection Agency). The Program works directly with businesses in the city to reduce greenhouse gas emissions and achieve a number of important environmental goals: air and water pollution prevention, solid waste reduction, water and energy conservation, renewable energy, travel demand reduction and more. The Program has been very successful, surpassing goals both in terms of number of businesses participating and in pollution prevention and greenhouse gas reduction. Grant funds: $20,000 Matching funds: $0 Funding period: June 1, 24 5 Junk 1 2006 at B. Colorado Department'of Puublic HealWaAA Environment funding for Radon Outreach and Survey This Ordinance appropriates $16,000 of unanticipated revenue into the General Fund. The funding is provided by the Colorado Department of Public Health and Environment. Funding will be used to conduct a study to determine the effectiveness of passive radon-reduction systems installed under Fort Collins' new radon-resistant new construction ordinance and to continue encouraging radon testing and mitigation through media advertising and low-cost radon test kit sales. September 20, 2005 -3- Item No. 10 A-D The grant requires matching funding of$16,000 which will be provided from the air quality program budget contained in the 2005 General Fund. Grant funds: $16,000 Matching funds: $16,000 Funding period: October'1, 2005 =Septembet 30, 2006 C. Congestion Mitigation and Air Ouality funding for "High-Emitter Pilot" This Ordinance appropriates $39,645 of unanticipated revenue into the General Fund. The funding is from the federal Congestion Mitigation and Air Quality Program, provided by the Federal Highway Administration and administered by the Colorado Department of Transportation. These funds will be used to conduct a pilot program to identify high-emitting vehicles in Fort Collins using roadside remote sensing of tailpipe emissions. Vehicle owners will be invited to receive an emissions test to confirm high emissions, then receive subsidized repairs of their vehicle. The project also will test a voluntary"Change of Ownership"emissions testing program by offering half- price emissions tests to potential vehicle buyers. The goal is to gain experience with alternative ways to cost-effectively identify and repair high-polluting vehicles. The grant requires matching funding of $9,910 which will be provided from the Air Quality Program budget contained in the 2005 G eraLfund , Federal funds: $39,645iV � Matching fund: $9,910 ,w - Funding period: October 1, 2005 — September 30, 2006 D. Colorado Department of Public Health and Environment funding for "Emissions Testing Transition" This Ordinance appropriates $5,200 of unanticipated revenue into the General Fund. The funding is provided by the Colorado Department of Public Health and Environment under the Community- Based Air Grants program. Funding will be used to implement some of the actions identified by a Front Range-wide intergovernmental committee that investigated ways to mitigate the increase in hydrocarbon emissions that will occur when the state-run emissions testing program is terminated. Grant-funded activities include (a) conducting outreach to insure compliance with Stage I vapor recovery fueling protocols, (b) seeking permission and placing "Stop at the Click" stickers on fuel pumps in the North Front Range, and (c) obtaining information from current emissions inspectors about strategies to maintain o rease pub li ;; p = icipatioin vehicle maintenance and implementing an outreach effort: The rosal c s hydrocarbon emission in order to reduce ozone precursors given the elevated ozone leveg i ort Collins and the region.
