RECOMMENDATION Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY This Resolution authorizes the City Manager to defer annexation of parcels eligible for annexation if specific criteria are met. BACKGROUND The Intergovernmental Agreement between Latimer County and the City of Fort Collins requires that all parcels within the Growth Management Area eligible for voluntary annexation be annexed into the City as soon as possible. In most cases, annexation requirements found in the present IGA have brought eligible County properties into the City with a relatively seamless transition in service. However, there are circumstances where the City and the property owner would be better served by postponing annexation until such time that a full range of City services can be efficiently provided. A good example would be the situation where an individual lot located at the perimeter of a large subdivision becomes eligible for voluntary annexation. Providing city services, such as utilities to this individual lot, would be highly inefficient, and also potentially confusing for police and emergency responders. The proposed resolution gives the City Manager the authority to postpone Council consideration of an annexation if the subject property meets one or more of the following conditions: 1. The property is too difficult or costly to serve with a full range of City services; or 2. The property is a single lot within an existing subdivision; or 3. The property is part of an enclave which is eligible in its entirety for involuntary annexation, or a part of a parcel that the City anticipates will soon become such an enclave. RESOLUTION 2006-036 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO CONSIDER ANNEXATIONS UNDER THE CITY'S INTERGOVERNMENTAL AGREEMENT WITH LARIMER COUNTY REGARDING COOPERATION ON MANAGING URBAN DEVELOPMENT WHEREAS, on November 21, 2000, the City entered into an intergovernmental agreement with Larimer County regarding cooperation on managing urban development; and WHEREAS, paragraph 8(A) of the intergovernmental agreement states that the City will consider the annexation of any parcel of land located within the growth management area which is eligible for voluntary annexation; and WHEREAS, the City Council has determined that with regard to certain types of annexations, the City Manager should be authorized to decide whether or not the annexation should be presented to the City Council for additional consideration; and WHEREAS, the Council has determined that the City Manager may, under the criteria established pursuant to this Resolution, consider certain annexations and respond to the County on behalf of the City that the City does not desire to annex those parcels proposed for annexation; and WHEREAS, the Council has further determined that the City Manager must be given criteria to guide his decision making with regard to such annexation proposals. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that, pursuant to paragraph 8(A) of the intergovernmental agreement between the City and Larimer County regarding cooperation on managing urban development, the City Manager is hereby authorized to consider the annexation of parcels of land located within the growth management area which are eligible for voluntary annexation, and to take either of the following actions: (1) The City Manager may communicate to Larimer County that the City does not desire to annex the area if the annexation would: a. be difficult or costly to serve with a full range of urban services; or b. consist of a single lot in an existing subdivision; or C. consist of a part of an enclave which is eligible for involuntary annexation, or a part of a parcel of land anticipated by the City to soon become such an enclave. (2) If a proposed annexation does not come within any of the above criteria, the City Manager shall refer the same to the City Council for additional consideration and recommendation to Larimer County.
