EXECUTIVE SUMMARY: Ordinance No. 213, 2001, which was unanimously adopted on First Reading on December 18, 2001 , authorizes the acquisition of Parcel 99701312005 by eminent domain proceedings to complete the construction of Redwood Street between Conifer and Vine Drive. EXECUTIVE SUMMARY: The developer, Palladian Construction Compan e O own North affordable housing project is required to complete the construction o Street between Conifer and Vine Drive. There is one small, irregu y-shaped parcel o on the ent of Redwood Street for which the developer has en unable to obtain cessary t-of-way. This small parcel appears to have been ab ed by its owner. The Town North developer purchased the tax certificates for 1he prope hen it was auctioned the Larimer County Treasurer for non- payment of tax epeate pts to locate the pr rty owner have been unsuccessful. In ord o take advantage d state cing for affordable housing projects, the deve r has asked the City to i eminent domain to acquire the property. The effoi of the developer meet the criteria of the resolution that Council adopted regarding City part ation in eminent domain roceedings for development projects. The developer will pay all C- osts associated with thi action, including, but not limited to, appraisals, litigation cost and ount necessary for a purchase of the property or any amount ordered as just comp for the property. That porti struction of Redwood Street and related improvements will be held by the City. The rider portion is encumbered by an existing irrigation ditch easement held by Lake Canal. That remainder will be conveyed to the developer for inclusion in the development project.
