RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: The grant of $115,000 is unanticipated revenue in the Water Fund. The total cost of the vulnerability assessment project is estimated to be $190,000. 7- EXECUTIVE SUMMARY: A $115,000 Environmental Protection Agency ("EPA") Grant has been awarded to the City to be used for a vulnerability assessment of the water system. Adoption of this Ordinance would appropriate the EPA grant proceeds to the Water Fund Vulnerability Assessment Grant Project and transfer $75,000 of existing appropriations from the Water Fund into the Grant Project. BACKGROUND: House of Representatives Bill H.R. 3448, Public Health Security and Bioterrorism Response Act of 2001 (the"Act"),requires community water systems to conduct vulnerability assessments under the authority of the EPA.Under the Act, community water systems serving a population of greater than 3,300 persons are required to conduct an assessment of the vulnerability of its system to a terrorist act or other intentional acts intended to substantially disrupt the ability of the system to provide a safe and reliable source of drinking water.The vulnerability assessment must include, but need not be limited to, a review of pipes and constructed conveyances, physical barriers, water collection,pretreatment, treatment, storage and distribution facilities,electronic,computer or other automated systems which are utilized by the public water system, the use, storage, or handling of various chemicals, and the operation and maintenance of such system. DATE: August 20, 2002 2 J ffEM NUMBER: 23 The EPA announced March 19,2002,that Requests for Application for the security planning grants of $115,000 for drinking water systems serving more than 100,000 people were due April 29,2002. Grants were awarded in July 2002,for use for vulnerability assessments that must be completed by March 31, 2003,or six months from the award date, whichever is later. The funds awarded can be applied toward three basic security elements:(1)vulnerability assessments;(2)emergency operating plans (EOPs); or (3) security system improvement designs. The EPA recognizes that these funds will not be sufficient to complete each of the security elements,but the funds will provide the means for utilities to begin to protect their systems. ORDINANCE NO. 115, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE WATER FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS WITHIN THE WATER FUND FOR THE VULNERABILITY ASSESSMENT GRANT PROJECT WHEREAS, House of Representatives Bill H.R. 3448, Public Health Security and Bioterrorism Response Act of 2001, requires community water systems to conduct vulnerability assessments under the authority of the Environmental Protection Agency ("EPA"); and WHEREAS, under that law,community water systems serving a population of greater than 3,300 persons are required to conduct an assessment of the vulnerability of their systems to a terrorist act or other intentional acts intended to substantially disrupt the ability of such systems to provide a safe and reliable drinking water; and WHEREAS, EPA grants were awarded in July 2002, for cities with more than 100,000 people, for vulnerability assessments to be completed by March 31, 2003, or six months from the award date, whichever is later; and WHEREAS, one of these EPA grants in the amount of$115,000, was awarded to the City to be used for a vulnerability assessment of the City's water system; and WHEREAS, the total cost of the vulnerability assessment project is estimated to be $190,000; and WHEREAS,the remaining$75,000 needed to complete the project will be transferred from existing appropriations in Water Fund Operations into the grant project in the Water Fund; and WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10, of the Charter authorizes the Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff has determined that the appropriation of the EPA grant funds, as described herein, will not cause the total amount appropriated in the relevant funds to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the City Council to appropriate the sum of$115,000 in the Water Fund-Vulnerability Assessment Grant Project from unanticipated revenue in the form of EPA grant proceeds and authorize the transfer of $75,000 from unspent and unencumbered existing appropriations in the Water Fund-Operations to the Water Fund-Vulnerability Assessment Grant Project to be used for a vulnerability assessment of the City's water system. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL,OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Water Fund-Vulnerability Assessment Grant Project the sum of ONE HUNDRED FIFTEEN THOUSAND DOLLARS($115,000)from EPA grant funds to be used for a vulnerability assessment of the City's water system. Section 2.That the unexpended and unencumbered appropriated amount of SEVENTY-FIVE THOUSAND DOLLARS ($75,000) is hereby authorized for transfer from the Water Fund- Operations to the Water Fund-Vulnerability Assessment Grant Project and appropriated therein to be used for a vulnerability assessment of the City's water system.
