EXECUTIVE SUMMARY:
With the expansion of City Park and Recreation lands into the Poudre Canyon, the Parks and
Recreation Department wishes to be able to apply the provisions of the City Traffic Code on
lands owned by the City but located outside of the City limits. In particular, the Parks and
Recreation Department wants to be able to ticket vehicles that do not display a day use parking
permit in parks such as Gateway where such permits will be required.
The current Code provisions pertaining to recreation areas are specifically applicable to City
parks and recreation areas located inside the City limits. Incorporating the Traffic Code by
reference into the recreation areas provisions of the Code will make the Traffic Code applicable
to parks and recreation areas outside of the City limits in the same way that other provisions of
the Code, including those dealing with animal control, fire prevention and miscellaneous
offenses, are already incorporated in the recreation area provisions. As a result, special officers,
commissioned by the City of Fort Collins Police Department, will be able to ticket individual
vehicles whose drivers fail to purchase day use parking passes as required, using the existing
parking provisions of the Traffic Code. Currently the City Traffic Code is not specifically
enforceable outside of the City limits. Chapter 23 of the Code also contains a typographical
error that will be corrected by this ordinance.
• ORDINANCE NO. 062, 2002
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 23, ARTICLE X OF THE CODE OF THE CITY
OF FORT COLLINS REGARDING PARKS, TRAILS AND RECREATION AREAS.
WHEREAS, the Model Traffic Code, as originally adopted by the City, and its subsequent
amendments as contained in Chapter 28 of the Code of the City of Fort Collins(the"Traffic Code"),
are not specifically applicable outside the city limits; and
WHEREAS,the Parks and Recreation Department wishes to be able to apply the provisions
of the Traffic Code, especially those concerning parking violations, to parks and recreation areas
owned or managed by the City outside city limits; and
WHEREAS,incorporating the Traffic Code by reference into the recreation areas provisions
in Chapter 23, Article X of the City Code would make the Traffic Code applicable to parks and
recreation areas outside city limits; and
WHEREAS, Section 23-203(a)(14)d. of the City Code contains a typographical error that
should be corrected; and
WHEREAS, the Council has reviewed the proposed amendments and the reasons therefor,
and believes the amendments are in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 23-203(a)(14) of the Code of the City of Fort Collins is hereby amended to
react as follows:
See. 23-203. Prohibited acts; permits.
(a) It shall be unlawful to:
(14) Violate the following in any recreation area:
a. Division 5 of Chapter 4, regarding control of animals;
b. Chapter 9, regarding fire prevention and protection;
C. Chapter 11, regarding hazardous materials transportation;
d. Section i2 3:712-19, prohibiting tampering with refuse or
rubbish containers;
e. Chapter 17, regarding miscellaneous offenses, including
without limitation the discharge of weapons, trespass,
loitering and disturbing the peace; artd
f. Chapter 23.5 regarding special events-; and
g: Chapter 28 regarding vehicles and traffic.
Introduced and considered favorably on first reading and ordered published this 16th day of
April, A.D. 2002, and to be presented for final passage on the 7th day of May, A.D. 2002.
