RECOMMENDATION: Staff recommends adoption of the Resolution and of the Ordinance on First Reading. FINANCIAL IMPACT: Federal "ISTEA" funds will pay for 100% of the cost for the new crossing warning devices. $134,258 in Federal Funds has been budgeted towards this project and is being appropriated into the City's Minor Streets Capital Fund. The City is required to pay for the Colorado Department of Transportation's costs for administering the project. These costs, estimated at$2,242,will be paid with existing Minor Streets Capital Funds. EXECUTIVE SUMMARY: A. Resolution 99-96 Authorizing the City Manager to Enter into an Agreement with the Colorado Department of Transportation, and the Union Pacific Railroad Company for Installing New Crossing Warning Devices at the Larimer County Road 32 and Union Pacific Railroad Crossing. B. First Reading of Ordinance No. 132, 1999, Appropriating Unanticipated Revenue in the Capital Projects Fund Minor Streets Capital Project to Be Used to Install New Crossing Warning Devices at the Larimer County Road 32 And Union Pacific Railroad Crossing. The agreement with the Colorado Department of Transportation (CDOT), and the Union Pacific Railroad Company (UPRR), is for installation of crossing warning devices at the Larimer County Road 32 and UPRR crossing as shown on the attached map. The project consists of replacing the existing stop sign controlled crossing with a signal system and gates to improve safety at the crossing. In addition,the signal system will improve the function of the street by requiring vehicles to stop only for trains. This installation will work well with the traffic signal planned for installation at Latimer County Road 32 at Timberline Road (700 feet to the east of the crossing). DATE: August 3, 1999 2 ITEM NUMBER: 20 A-B The City applied for and received Federal ISTEA Funds to pay for 100%of the cost to upgrade the crossing warning devices. Ordinance No. 132, 1999, appropriates the $134,258 in Federal Funds budgeted towards the project in to the City's Minor Streets Capital Project in the Capital Projects Fund. The UPRR's estimated cost for the upgrade is $126,758. The City is required to pay for CDOT's costs for administering the project, because the federal funds may not be used for this purpose. These costs, estimated at $2,242, will be paid for with existing Minor Streets Capital Funds. This project is planned to be done in coordination with another project under separate agreement between the City and the UPRR to replace and widen the crossing material to provide width for the two travel lanes and two bicycle lanes/shoulders. Construction of the improvements is scheduled to be done in the fall of this year. RESOLUTION 99-96 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION AND THE UNION PACIFIC RAILROAD COMPANY FOR INSTALLING NEW CROSSING WARNING DEVICES AT THE LARIMER COUNTY ROAD 32 AND UNION PACIFIC RAILROAD CROSSING WHEREAS, the City and the Union Pacific Railroad Company ("Union Pacific") desire to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing; and WHEREAS, Federal Intermodel Surface Transportation Efficiency Act ("ISTEA") funds have been made available to pay for one hundred(100)percent of the cost of installing new crossing warning devices; and WHEREAS,the Ciry has sufficient Minor Streets Capital Funds to reimburse the Colorado Department of Transportation for its costs in administering the project, which costs are estimated to be in the sum of Two Thousand Two Hundred and Forty Two Dollars ($2,242); and WHEREAS,the costs of the project are estimated by Union Pacific to be in the sum of One Hundred Twenty Six Thousand Seven Hundred and Fifty Eight Dollars ($126,758); and WHEREAS, ISTEA funds are available in the maximum amount of One Hundred Thirty Four Thousand Two Hundred and Fifty Eight Dollars ($134,258)to fund the project; and WHEREAS, the City, the State of Colorado and Union Pacific now desire to enter into a contract for the purpose of accomplishing the installation of new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing; and WHEREAS, Section 16 of Article II of the City Charter provides that the Council may, by resolution,enter into contracts with other governmental bodies to furnish governmental services or to enter into cooperative or joint activities with other governmental bodies; and WHEREAS, the Council had determined that the aforesaid contract for the installation of new crossing warning devices is in the best interest of the City. NOW,THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLIN''S that the City Council hereby approves the Contract between and among the City,the State of Colorado and the Union Pacific Railroad Company,and authorizes the City Manager to enter into the Contract on behalf ofthe City,which contract provides that one hundred(100)percent of the cost to install the aforesaid new crossing warning devices shall be funded by Intermodel Surface Transportation Efficiency Act funds and the cost incurred by the State of Colorado in administering the project shall be reimbursed by the City to the State in the estimated sum of Two Thousand Two Hundred and Forty Two Dollars($2,242), from City Minor Streets Capital Funds. Passed and adopted at a regular meeting of the City Council held this 3rd day of August, A. D. 1999. Mayor ATTEST: City Clerk ORDINANCE NO. 132, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND MINOR STREETS CAPITAL PROJECT TO BE USED TO INSTALL NEW CROSSING WARNING DEVICES AT THE LARIMER COUNTY ROAD 32 AND UNION PACIFIC RAILROAD CROSSING WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,the City Council adopted Resolution 99-96,on August 3, 1999,authorizing the City to enter into a contract with the Colorado Department of Transportation(CDOT)and the Union Pacific Railroad Company for the receipt of Intermodal Surface Transportation Efficiency Act funds (ISTEA) to be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing (the"Project'); and WHEREAS, the estimated cost of the Project is One Twenty-Nine Thousand Dollars ($129,000);and WHEREAS, CDOT has made available to the City, Intermodal Surface Transportation Efficiency Act funds to pay for one hundred (100)percent of the cost ($126,758) of installing new crossing warning devices at the Project; and WHEREAS,local funds,totaling Two Thousand Two Hundred Forty-Two Dollars($2,242) have been identified and are appropriated in the 1999 Capital Projects Fund Minor Streets Capital project to be used to reimburse the Colorado Department of Transportation for its costs in administering the Project; and WHEREAS, it is the desire of the Council to appropriate the sum of$126,758 in federal Intermodal Surface Transportation Efficiency Act funds to be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund Minor Streets Capital project,the sum of ONE HUNDRED TWENTY-SIX THOUSAND SEVEN HUNDRED FIFTY-EIGHT DOLLARS ($126.758), upon receipt from Colorado Department of Transportation Intermodal Surface Transportation Efficiency Act funds,to. be used to install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad crossing. i Introduced and considered favorably on first reading and ordered published this 3rd day of August, A.D. 1999, and to be presented for final passage on the 17th day of August,A.D. 1999.
