SUBJECT:
Resolution 2000-149 Approving the Purchase of Convention and Visitor Services from the Fort
Collins Convention and Visitors Bureau, Inc., as an Exception to the Competitive Procurement
Process.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT:
Funds for this Contract are in the 2001 budget.
EXECUTIVE SUMMARY:
The Fort Collins Convention and Visitors Bureau, Inc. (the "CVB") has been performing services
related to tourism,convention and visitor activities for over ten Years. The current agreement was
negotiated in 1996 with four one year renewal options through 12/31/00. The City and the CVB are:
jointly having an economic impact study performed with a completion date expected in the next
month. After that study is finished a request for proposal will be issued and a new five-year
agreement negotiated with the successful proposer. Staff is requesting a three month extension of
the current contract in order to have adequate time to select and negotiate the new contract. A
competitive process for these services will be completed and a new contract in place by March 3 L
2001. The City is currently paying $71,090 per quarter and the renewal amount recommended is
$73,223. This represents a 3% increase which is consistent with prior year renewals.
Among the services provides are:
• 800 inquiry numbers and web site
• Responding to visitor inquiries
• Marketing Fort Collins as a visitor and convention location
• Providing a visitors guide and other brochures

APPROVING THE PURCHASE OF CONVENTION AND VISITOR SERVICES FROM THE
FORT COLLINS CONVENTION AND VISITORS BUREAU, INC., AS AN EXCEPTION
TO THE COMPETITIVE PROCUREMENT PROCESS
WHEREAS,pursuant to Ordinance No. 20, 1984,the City of Fort Collins established a 3%n
Lodging Tax on hotel/motel rooms with City limits for the purpose of promoting tourism,
conventions and other activities which utilize public accommodations within the city; and
WHEREAS, the City of Fort Collins,pursuant to Resolution 86-181,contracted with the Fort
Collins Convention & Visitors Bureau (the "CVB") to coordinate tourism and visitor promotion
activities pursuant to Section 25-244 of the Code of the City of Fort Collins; and
WHEREAS, a staff team reviewed the CVB's performance in 1995, and evaluated various
options for continued tourism and visitor promotion services that maximize community benefits;and
WHEREAS, in 1995, the City, pursuant to Resolution 95-177, entered into a contract with
CVB as an exception to the competitive purchasing requirements as described in Section 8-
160(d)(1)c of the City Code (which has since been renumbered as Section 8-161(d)(1)c); and
. WHEREAS, in 1999, the City, pursuant to Resolution 99-108, amended its contract with the
CVB to reallocate CVB budget resources under the contract so as to provide for proactive conference
and convention sales; and
WHEREAS,pursuant to more recent amendments to that contract for services,the CVB is also
operating the new Fort Collins Visitor's Center and Welcome Center on Prospect Road; and
WHEREAS,the City desires to extend its contract for services with the CVB beyond its current
expiration date of December 31,2000,in order to purchase tourism,convention and visitor services
for the first quarter of 2001, pending the completion of an economic impact study that is currently
in progress and will assist in determining the nature of the services to be acquired by the City for the
next contract term; and
WHEREAS, Section 8-161(d)(1)b of the Code of the City of Fort Collins authorizes the
Purchasing Agent to contract for services without competition if,although there exists more than one
(1)responsible source, a competitive process cannot be used or,if used, will result in a substantially
higher cost to the city,will otherwise injure the city's financial interests,or will substantially impede
the city's administrative functions or the delivery of services to the public; and
WHEREAS,the Purchasing Agent has determined that the purchase of tourism,convention
and visitor services from CVB, falls within the scope of this exception, because the use of a
competitive process to contract for the services for one calendar quarter pending the completion of
a review of the services to be acquired for the next contract term would result in increased costs,
interfere with the City's administrative functions and impede delivery of tourism, convention and
visitor services to the public; and
WHEREAS, the Purchasing Agent has submitted the requisite justification for said
determination to the City Manager for approval; and
WHEREAS, the City Manager has reviewed and approved the justification for this
acquisition; and
WHEREAS, Section 8-161(d)(3) requires approval of this purchasing method by City
Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition;
and
WHEREAS,the total original cost of the contract with CVB was more than said amount and
was approved by the Council,and staff has therefore deemed it appropriate that Council review and
authorize the proposed extension of that contract.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT COLLINS that the Purchasing Agent is hereby authorized to purchase tourism, convention
and visitor services for the first quarter of 2001 from the Fort Collins Convention and Visitors
Bureau, Inc., in the amount of$73,223.
