RECOMMENDATION Staff recommends adoption of the Ordinance. FINANCIAL IMPACT The extension of the term will allow the negotiation of fees, undetermined at this time, for engineering fees associated with FAA funded projects. EXECUTIVE SUMMARY There is an urgent need to conduct design work for airport improvements which will be completed during next summer's construction season. In order to obtain the most favorable construction costs it is necessary to solicit bids over the winter months. Due to the complexity of the project the design work needs to commence as soon as possible and will take approximately 6 months to complete. The current Agreement with CH2M Hill expires this October 31, 2005. In order to start this work now and continue work beyond the Agreement expiration term it is necessary to extend the term of the Agreement for one year to October 31, 2006. The funds necessary to complete the design fees have already been adopted in the 2005 Airport budget; 95% of the costs are recovered from an existing FAA Grant and 2.5% of the Airport's match will come from a Grant from the State of Colorado. The FAA process for selecting an airport engineer and the process for determining engineering fees are different than is normally followed. The FAA requires airports to select an engineering firm based on qualifications and experience and not with any consideration for price. Once a qualified engineering firm is selected then fees are negotiated on a project-by-project basis once a scope of work is established. Once an FAA eligible project is identified and the scope of work agreed upon then fees are negotiated with the engineering firm. The fee negotiations also incorporate the use of an Independent Fee Estimate from a separate engineering firm; this information helps with determining reasonable fees. September 6, 2005 -2- Item No. 13 The FAA also requires Airports to go through an engineer selection process every five years, however, the FAA has consented to an extension of our contract with CH2M Hill, Inc. for an additional year. The Airport will be starting this process in the very near future to selection an Airport engineer for the next five-year term. ORDINANCE NO. 097, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO EXTEND THE TERM OF THE AGREEMENT BETWEEN THE CITY AND CH2M HILL, INC. FOR ENGINEERING SERVICES AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT WHEREAS, the Cities of Fort Collins and Loveland, Colorado entered into an Agreement dated October 31, 2000 ("Agreement'), with CH2M Hill, Inc. for the provision of engineering services at the Fort Collins-Loveland Municipal Airport ("Airport"); and WHEREAS, said Agreement will expire on October 31, 2005, unless the term is extended; and WHEREAS, the selection of another engineering services provider at this time would unnecessarily disrupt the continuity of the 2005-2006 Airport projects; and WHEREAS, the City and CH2M Hill, Inc. desire to extend the term of the Agreement for a period of one (1) year; and WHEREAS, Section 8-186(a) of the City Code provides that no contract for professional services,including renewals,shall be made by the City for a period longer than five(5)years,unless authorized by ordinance; and WHEREAS,the Federal Aviation Administration,as the principal source of funding for the Airport projects, has consented to a one (1) year extension to the Agreement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, COLORADO, that the City Manager is hereby authorized to execute on behalf of the City a one (1) year term extension to the Agreement for engineering services at the Fort Collins- Loveland Municipal Airport with CH2M Hill, Inc. Introduced, considered favorably on first reading, and ordered published this 6th day of September, 2005, and to be presented for final passage on the 20th day of September, A.D. 2005.
