HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 02/07/2006 - FIRST READING OF ORDINANCE NO. 015, 2006, APPROPR ITEM NUMBER: 13 AGENDA ITEM SUMMARY DATE: February 7, 2006 FORT COLLINS CITY COUNCIL STAFF: John Lang SUBJECT First Reading of Ordinance No. 015, 2006, Appropriating Unanticipated Revenue in the Capital Projects Fund - South Taft Hill Road, Horsetooth Road to Harmony Road Project, to Be Used for the Construction of Improvements to a Section of South Taft Hill Road from Horsetooth Road South to Harmony Road and Authorizing an Intergovernmental Agreement for the Project RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading FINANCIAL IMPACT The construction of South Taft Hill Road from Horsetooth Road to Harmony Road is being funded through a transfer of$1,736,400 in Regional Road Capital Expansion Fees from Larimer County to the City of Fort Collins. No local matching funds are required by the City. EXECUTIVE SUMMARY The City of Fort Collins Engineering Department has received $1,736,400 from Larimer County's Regional Road Capital Expansion Fee Program (the "Program"). Under this Program, the County collects a fee from building permits issued within unincorporated Larimer County and the City of Fort Collins. This Program was initiated by Larimer County in 1999 and adopted by the City of Fort Collins in February of 2000. South Taft Hill Road (County Road 19) between Fort Collins and Loveland is identified as one of five regional roads in the Larimer County Transportation Plan dated 1998. Larimer County has selected South Taft Hill Road from Horsetooth Road to Harmony Road for funding of interim improvements. The Ordinance also authorizes an intergovernmental agreement documenting the City's and County's respective rights and responsibilities in connection with the construction project. BACKGROUND South Taft Hill Road between Horsetooth Road and Harmony Road has not yet been annexed by the City of Fort Collins, but is located within the City's Growth Management Area. It is currently a two-lane county road with no left turn lanes, no bike lanes, a partial sidewalk and February 7, 2006 -2- Item No. 13 minimal shoulders. The City's Master Street Plan identifies this section of road as a four-lane arterial street. Larimer County's Transportation Plan, adopted in 1998, has identified five roads within the County that are considered "Regional Roads" and are eligible for funding from the Program for road improvements. South Taft Hill Road (County Road 19) is one of the regional roads that can be improved using these impact fees. The interim improvements will include two travel lanes, widened shoulders, a center turn-lane, completion of the sidewalk on the west side of the roadway, and minor improvements to the Taft Hill/Harmony intersection. City and County staffs have negotiated an intergovernmental agreement to outline the City's and the County's respective rights and responsibilities in connection with the South Taft Hill Road construction project. CO c a> i C O m Drake Road Q' o m m o � U ca H vi Horsetooth Road CR 38E Project Location I Harmony Road a� a� U) t Vicinity Map South Taft Hill Road Improvements Project ORDINANCE NO. 015, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND - SOUTH TAFT HILL ROAD, HORSETOOTH ROAD TO HARMONY ROAD PROJECT, TO BE USED FOR THE CONSTRUCTION OF IMPROVEMENTS TO A SECTION OF SOUTH TAFT HILL ROAD FROM HORSETOOTH ROAD SOUTH TO HARMONY ROAD AND AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT REGARDING THE PROJECT WHEREAS, the section of South Taft Hill Road from Horsetooth Road south to Harmony Road, located within the City's Growth Management Area, is currently a two-lane County road with no left turn lanes, no bike lanes, a partial sidewalk, and minimal roadway shoulders; and WHEREAS, this roadway is identified in the City's Master Street Plan as one that should become a four-lane arterial street; and WHEREAS, South Taft Hill Road (County Road 19) is identified in Larimer County's Transportation Plan as one of five roads within the County that are considered "Regional Roads" and, as such, Taft Hill Road is eligible for funding from the County's Regional Road Capital Expansion Fee Program (the "Program"); and WHEREAS, under the Program, initiated by Larimer County in 1999 and adopted by the City in 2000, the County collects fees from building permits issued within unincorporated Larimer County and the City of Fort Collins, and these fees are then available for funding improvements to "Regional Roads" as identified by the County; and WHEREAS, on February 3, 2004, City Council adopted Ordinance No. 008, 2004, appropriating $300,000, upon receipt, from the Program, that was used to cover the cost of designing a four-lane arterial street for the section of South Taft Hill Road from Horsetooth Road south to Harmony Road; and WHEREAS, Larimer County has agreed to contribute an additional $1,736,400, to the City, from its Program to be used to construct interim improvements to South Taft Hill Road from Horestooth south to Harmony Road; and WHEREAS, the aforementioned interim improvements will include two travel lanes, widened shoulders, a center turn-lane, completion of the sidewalk on the west side of the roadway, and minor improvements to the Taft Hill Road/Harmony Road (County Road 38E) intersection; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of$1,736,400 upon receipt from Larimer County as described herein will not cause the total amount appropriated in the Capital Projects Fund - South Taft Hill Road, Horsetooth Road to Harmony Road Capital Project budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of $1,736,400, representing Regional Road Capital Expansion fees collected by Larimer County, in the Capital Projects Fund - South Taft Hill Road, Horsetooth Road to Harmony Capital Project to be used to construct interim roadway improvements to the section of South Taft Hill Road from Horsetooth Road south to Harmony Road; and WHEREAS, in order to document the respective rights and responsibilities of the City and the County in connection with the construction of the South Taft Hill Road improvements, City and County staffs have negotiated an intergovernmental agreement dated February 3, 2006, a copy of which is on file in the Office of the City Clerk for public inspection, consistent with the terms of this Ordinance, which agreement is incorporated herein by this reference (the "Project IGA"); and WHEREAS, the City is authorized to enter into intergovernmental agreements to provide any function, service or facility, such as a grant agreement, as provided in Article II, Section 16 of the Charter of the City of Fort Collins and Section 29-1-203, C.R.S.. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund - South Taft Hill Road, Horsetooth Road to Harmony Road Capital Project, the sum of ONE MILLION SEVEN HUNDRED THIRTY-SIX THOUSAND FOUR HUNDRED DOLLARS ($1,736,400), upon receipt from Larimer County, to be used to construct interim roadway improvements to the section of South Taft Hill Road from Horsetooth Road to Harmony Road. Section 2. That the Mayor is hereby authorized to execute the Project IGA, in substantially the form on file in the Office of the City Clerk, subject to modifications, amendments or additions thereto as may be determined by the City Manager, in consultation with the City Attorney, to be necessary or appropriate to protect the interests of the City, with the understanding that future amendments to the Project IGA not otherwise provided for herein may be approved by the Council by resolution.
