RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. FINANCIAL IMPACT The City has received the following grant and donations for Police Services: (1) A grant in the amount of$20,000 from the Bohemian Foundation for the continuation of the Restorative Justice Program. No cash match is required. (2) Donations totaling$1,575 from various local service clubs and private donators for continuation of The Restorative Justice Program. EXECUTIVE SUMMARY This Ordinance,which was unanimously adopted on First Reading on January 17,2006, authorizes appropriation of unanticipated revenue in the General Fund to continue the Restorative Justice Program. A grant in the amount of$20,000 has been received from the Bohemian Foundation to continue this program. Donations totaling$1,575 benefitting the Restorative Justice Program have also been received from the Seratoma Club, EyeOpeners Kiwanis, the InterFaith Council and an anonymous individual contributor. ORDINANCE NO. 007, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND FOR CONTINUATION OF THE RESTORATIVE JUSTICE PROGRAM WHEREAS, the City of Fort Collins Police Services has been awarded a grant from the Bohemian Foundation in the amount of$20,000 for salaries associated with the continued operation of the Restorative Justice Program, which includes Restorative Justice Youth Conferencing and RESTORE; and WHEREAS,various civic groups(Sertoma Club, EyeOpeners Kiwanis, InterFaith Council) and an anonymous individual have donated a total of$1,575 to the Restorative Justice Program;and WHEREAS, the Restorative Justice Program is an alternative method of holding a youth offender accountable for his or her actions by conferencing with the young person, the victim and community members to identify the harm caused by the incident, and to find meaningful ways for the young person to repair that harm; and WHEREAS, the grant period for the Bohemian Foundation grant is from December 1, 2005 to November 30, 2006 and no matching funds are required by the grant; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the Bohemian Foundation funds and additional donations as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated revenue in the General Fund the sum ofTWENTY THOUSAND DOLLARS($20,000) for expenditure in the General Fund for continuation of the Restorative Justice Program. Section 2. That there is hereby appropriated from unanticipated donations in the General Fund the sum of ONE THOUSAND FIVE HUNDRED SEVENTY FIVE DOLLARS ($1,575) for expenditure in the General Fund for continuation of the Restorative Justice Program.
