RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: Funds are budgeted for 2000. EXECUTIVE SUMMARY: The Streets Department has been using Wirtgen profilers(rotomills)since 1992. The machines have proven to be reliable and effective for removing roadway asphalt in maintenance operations. Streets considers this machine to be superior to competitive units because it has a four-track drive system, is heavier, more powerful, uses a strike-off plate, and has a well designed milling drum. Maintenance costs are not insignificant with a machine such as this. The Streets Department has found that the cost of annual maintenance of the City's current,older Wirtgen is approximately 25% less than that of similar,competing machines in a municipal environment. In fact maintenance costs of the Wirtgen WI 90ODC, when new,were 60% less than another municipality's new unit from a major competitor. Much of that lower cost can be attributed to superior milling drum design which requires less maintenance to begin with and is easier and less expensive to work on when necessary. Due to the design advantages of the Wirtgen W2000 and the lack of suitable substitutes, the Purchasing Agent has determined that a competitive process cannot reasonably be used and,if used . would result in a substantially higher cost to the City and may result in the impairment of the City's delivery of services to the public. DATE: February 15, 2000 2 ITEM NUMBER: 20 Wirtgen America sells and supports its products through Faris Machinery. Wirtgen has provided excellent warranty and parts support for the W190ODC Wirtgen mill owned by the City. Faris Machinery has offered the Wirtgen W2000 to the City for$410,000. Section 8-161 of the Code states that any exemption to the use of competitive bidding in excess of $100,000 must be approved by the City Council. The Resolution will authorize the purchase of a Wirtgen W2000 as an exemption to the use of competitive bid or proposal as provided in Section 8-161(d)(4). RESOLUTION 2000-30 • OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE PURCHASE OF A WIRTGEN W2000 ROTOMILL FROM FARIS MACHINERY AS AN EXCEPTION TO THE CITY'S COMPETITIVE PURCHASING REQUIREMENTS WHEREAS, Wirtgen rotomills have been reliable and effective for asphalt removal since Streets began using them in 1992; and WHEREAS, the Wirtgen W2000 rotomill is heavier and more powerful than competitive units and uses a four-track drive system to enhance stability and safety, and the operating components of the W2000 are well-designed and efficient in operation; and WHEREAS, Streets has documented lower operating costs for Wirtgen rotomills, as compared to competitive units,and the City has enjoyed excellent service and support from Wirtgen America; and WHEREAS,the Wirtgen rotomill is the only machine in its size class that has a four-track drive system which provides greater stability needed for use on city streets due to their surface curvature; and • WHEREAS,Faris machinery is the exclusive local supplier of Wirtgen America,the maker of the Wirtgen W2000; and WHEREAS,the Purchasing Agent has determined that the purchase of the Wirtgen W2000 as an exception to competitive process is in the best interests of the City,due to the superior design, efficiency, and proven reliability of the unit; and WHEREAS, funds have been budgeted and approved in the Streets Department budget for 2000; and WHEREAS, Section 8-161(d)(1)(a) of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and services without utilizing a competitive bidding process where the Purchasing Agent determines that only one responsible source exists;and WHEREAS, the Purchasing Agent has determined that only one reasonable source of the Wirtgen W2000 exists and has submitted the requisite justification for his determination to the City Manager for approval; and WHEREAS, the City Manager has reviewed and concurred in that determination for this acquisition; and . WHEREAS, Section 8-161(d)(3)required approval of this purchasing method by the City Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the purchase of a Wirtgen W2000 from Faris Machinery,in the amount of$410,000, is hereby approved as an exception to the City's competitive purchasing requirements.
