ESPLIN ITEM NUMBER: 28 AGENDA ITEM SUMMARY DATE: June 7, 2005 FORT COLLINS CITY COUNCIL STAFF: Kathleen M. Lane SUBJECT Resolution 2005-066 Reappointing Gordon F. Esplin as Temporary Judge and Authorizing the Execution of an Employment Agreement. RECOMMENDATION Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY Council originally appointed Gordon F. Esplin as Temporary Judge (Assistant Municipal Judge) in 1989, and has reappointed him every two years thereafter. His current appointment terminates on June 30, 2005. Municipal Judge Kathleen M. Lane recommends that Mr. Esplin be reappointed for another two-year term. Mr. Esplin is currently paid $85 per hour for his services. That rate is well below the going rate for legal fees in Fort Collins and is at or below the amount paid to other Assistant Municipal Judges in Colorado who serve only occasionally. However, due to budgetary constraints, staff is not recommending an increase in the compensation paid to Mr. Esplin at this time. Mr. Esplin has agreed to continue in this position at the current pay rate. RESOLUTION 2005-066 OF THE COUNCIL OF THE CITY OF FORT COLLINS REAPPOINTING GORDON F. ESPLIN AS TEMPORARY JUDGE AND AUTHORIZING THE EXECUTION OF AN EMPLOYMENT AGREEMENT WHEREAS, Article VII of the Charter of the City of Fort Collins allows the Council to designate a temporary judge to serve in the absence of the Municipal Judge; and WHEREAS, the Council wishes to reappoint Gordon F. Esplin to serve in such capacity at the discretion of Municipal Judge Kathleen Lane. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That Gordon F. Esplin is hereby appointed temporary judge to serve as a temporary judge for the City as deemed necessary by Municipal Judge Kathleen Lane for a term beginning July 1, 2005 and ending June 30, 2007. Section 2. That the compensation to be paid by the City to Mr.Esplin for serving in this capacity shall be at the rate of Eighty-Five Dollars ($85) per hour. Section 3. That the Mayor is hereby authorized to enter into an employment agreement between the City and Gordon F. Esplin, to effectuate the purposes of this Resolution.
