SUBJECT
Items Relating to an Intergovernmental Agreement with the Colorado Department of
Transportation to Accept and Appropriate Funds Offered for the Design and Construction of the
Lemay Avenue Southbound Right Turn Lane at Mulberry Street.
RECOMMENDATION
Staff recommends adoption of the Resolution and Ordinance on First Reading.
FINANCIAL IMPACT
The total budget for this project is $200,000. The City will contribute matching funds in the
amount of $43,383 in order to receive a grant of $156,617 for the design, right of way
acquisition and construction of a right turn lane on Lemay Avenue at Mulberry Street. The City
funds are available and appropriated in the Minor Streets Capital account. The federal funds
administered by the Colorado Department of Transportation are funds available to Local
Agencies under the Surface Transportation Improvement Program for fiscal year 2004-2005.
EXECUTIVE SUMMARY
A. Resolution 2005-006 Authorizing the Mayor to Enter Into an Intergovernmental
Agreement with the Colorado Department of Transportation in Order for the City to
Receive Grant Funding for the Design, Right-of-Way Acquisition and Construction of a
Right Turn Lane in Lemay Avenue at Mulberry Street.
B. First Reading of Ordinance No. 013, 2005, Appropriating Unanticipated Revenue in the
Capital Projects Fund - Minor Streets Project to be used with Existing Appropriations for
the Design and Construction of the Lemay Avenue Southbound Right Turn Lane at
Mulberry Street.
The City applied for and received the offer of Congestion Mitigation and Air Quality ("CMAQ")
funds for FY 2004-2005 to install a right turn lane for southbound Lemay Avenue at Mulberry
Street.

BACKGROUND
This project will add a right turn lane to southbound Lemay Avenue at Mulberry Street. This
proposed right turn lane will serve a high volume of turning traffic that currently uses the outside
lane on Lemay Avenue and, in some cases, the bicycle lane to turn onto westbound Mulberry
Street.
The intersection of Lemay and Mulberry was reconstructed as part of the required improvements
for the development of the Wal-Mart Shopping Center (Mulberry-Lemay Crossings). Right-turn
lanes were constructed for all directional movements except for southbound Lemay Avenue. At
the time this movement was not warranted, and Wal-Mart could not be required to construct this
turn lane. However, the City recognizes that the addition of this turn lane now will reduce
congestion and improve safety at this busy intersection. Others from CDOT and the Federal
Highway Administration ("FHWA") agreed. This project competed with several other projects
for the CMAQ funds, and a panel of City, CDOT and FHWA staff recommended it for funding.
Improvements will consist of grading, asphalt and concrete pavement, concrete curb and gutter,
concrete walkway relocation, enhanced crosswalk, median (constructed to avoid having to move
the traffic signal pole and controller and other utilities), related drainage improvements, utility
access adjustments and related signing and striping. Some right-of-way acquisition is required
from the adjoining property.

RESOLUTION 2005-006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION
IN ORDER FOR THE CITY TO RECEIVE GRANT FUNDING FOR THE
DESIGN, RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION OF A
RIGHT TURN LANE IN LEMAY AVENUE AT MULBERRY STREET
WHEREAS,the Colorado Department of Transportation("CDOT")has awarded a$156,617
Surface Transportation-Urban grant to the City to assist in funding the design, right-of-way
acquisition and construction of a right turn lane in Lemay Avenue at Mulberry Street, on the
condition that the City supply matching funds in the amount of$43,383; and
WHEREAS, the City Council has determined that it is in the best interest of the City that the
Mayor enter into an agreement with CDOT in order for the City to receive the $156,617 in grant
funding for the above-described right turn lane project.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that, contingent upon Council appropriation of the necessary funds therefor, the Mayor
is hereby authorized to enter into an agreement with the Colorado Department of Transportation in
order for the City to receive a grant in the sum of$156,617 to assist in the funding of the design,
right-of-way acquisition and construction of a right turn lane in Lemay Avenue at Mulberry Street.
Passed and adopted at a regular meeting of the City Council held this 1st day of February,
A.D. 2005.

ORDINANCE NO. 013, 2005
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND -
MINOR STREETS PROJECT TO BE USED WITH EXISTING APPROPRIATIONS
FOR THE DESIGN AND CONSTRUCTION OF THE
LEMAY AVENUE SOUTHBOUND RIGHT TURN LANE AT MULBERRY STREET
WHEREAS, the intersection at Lemay Avenue and Mulberry Street is a full movement,
signalized intersection, which experiences a high volume of turning traffic for all directional
movements; and
WHEREAS,right turn lanes exist at all legs of this intersection except for southbound Lemay
Avenue; and
WHEREAS, the Colorado Department of Transportation ("CDOT") has made available to
the City of Fort Collins,under the Surface Transportation Improvement Program for FY 2004-2005,
federal funds in the amount of$156,617 to be used for the design and construction of a right turn
lane on southbound Lemay Avenue at Mulberry Street (the "Project"); and
WHEREAS, the scope of the Project improvements will include grading, asphalt and
concrete pavement, concrete curb and gutter, concrete walkway relocation, enhanced crosswalk,
median, related drainage improvements,utility access adjustments and related signing and striping;
and
WHEREAS,local matching funds needed to cover the cost of the Project improvements and
administrative costs associated with the Project, totaling $43,383, have been identified and are
available in the form of existing appropriations in the Capital Projects Fund-Minor Streets capital
project; and
WHEREAS, the City Council adopted Resolution 2005-006, on February 1, 2005,
authorizing the Mayor to enter into an intergovernmental agreement with CDOT for the receipt of
Federal Surface Transportation Improvement Program Funds to be used for the design and
construction of a right turn lane on southbound Lemay Avenue at Mulberry Street ; and
WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the Federal Surface
Transportation Improvement Program Funds from CDOT as described herein will not cause the total
amount appropriated in the Capital Projects Fund - Minor Streets capital project budget to exceed
the current estimate of actual and anticipated revenues to be received during any fiscal year; and
WHEREAS, it is the desire of the Council to appropriate the sum of$156,617 in Federal
Surface Transportation Improvement Program Funds from CDOT, to be used with existing
appropriations totaling$43,383, in the Capital Projects Fund-Minor Streets capital project for the
purpose of designing and constructing a right turn lane on southbound Lemay Avenue at Mulberry
Street.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund - Minor Streets capital project, the sum of ONE HUNDRED FIFTY-SIX
THOUSAND SIX HUNDRED SEVENTEEN DOLLARS ($156,617) from Colorado Department
of Transportation Federal Surface Transportation Improvement Program Funds, for the purpose of
designing and constructing a right turn lane on southbound Lemay Avenue at Mulberry Street.
Introduced and considered favorably on first reading and ordered published this 1st day of
February, A.D. 2005, and to be presented for final passage on the 15th day of February, A.D. 2005.
