First Reading of Ordinance No. 8, 1999, Amending Section 2-93 of the City Code to Add a New
Function of the Air Quality Advisory Board.
RECOMMENDATION:
Staff and the Air Quality Advisory Board recommend adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
Members ofthe Air Quality Advisory Board discussed the addition of a new provision to the existing
list of functions of the Board,as set forth in the City Code,at the Board's October 28, 1998 retreat.
The proposed revision is set forth below(new language is shaded):
Sec. 2-93. Functions.
The duties and functions of the board shall be to advise the City Council regarding
policies, plans, and programs to improve and maintain the city's air quality. The
` board may, without limitation, biennially review air quality indicators and
recommend adjustments to the Air Quality Action Plan,; review and recommend
revisions,as needed, to the Air Quality Policy Plan and to anydother Cityplans that
may;have significant impacts on air quality; as needed: and advise the Governor-
designated lead agency for air quality planning on matters pertaining to the Fort
Collins element of the State Implementation Plan. The board may also convene ad
1 hoc citizen task groups to provide additional technical expertise to the board for the
planning of specific action strategies.
This amendment arises because of a recent change in the Air Quality Action Plan update process,
i.e.,Objective 1:Reduce the Growth Rate of Daily Vehicle Miles Traveled(VMT),is now considered
separately in conjunction with updates to City Plan,Master Transportation Plan, and their various,
implementation programs.
Because of this change, City actions that reduce the VMT growth rate will no longer be considered
part of the Air Quality Action Plan update process. This change recognizes the fact that the City's
efforts to reduce VMT growth are contained within implementation of City Plan and the Master
Transportation Plan, which have their own processes and timelines for monitoring progress and
making implementation changes. Natural Resources staff is working with other City departments

and the Air Quality Advisory Board to track implementation of the VMT-related programs in order
that recommendations may be made in a timely manner.
Board members agreed that this change makes sense. They were anxious,however,that the change
should not be misconstrued. Specifically,Board members wanted to clarify that they may continue
to advise City Council on the land use and transportation plans and programs that reduce the VMT
growth rate. For this reason, the Board has proposed that the functions of the Board be revised as
set forth above.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
. AMENDING SECTION 2-93 OF THE CODE OF THE CITY
TO ADD A NEW FUNCTION OF THE AIR QUALITY ADVISORY BOARD
WHEREAS,the functions of the Air Quality Advisory Board of the City (the 'Board") are
set forth in Section 2-93 of the Code of the City; and
WHEREAS, because of changes to the Air Quality Action Plan update process, certain air
quality-related matters are now considered in conjunction with updates to certain planning
documents other than the City's air quality plans,such as City Plan and the Master Transportation
Plan; and
WHEREAS,the Board's role in review of these air quality-related matters is important,and
the functions of the Board as currently listed in the Code do not include the review of the air quality
aspects of these other City planning tools; and
WHEREAS, at its retreat on October 28, 1998, the Board discussed the addition of this
specific function to its already listed functions, as they appear in Section 2-93 of the City Code.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 2-93 of the Code of the City of Fort Collins is hereby amended to read as
follows:
