ITEM NUMBER: 21 AGENDA ITEM SUMMARY DATE: December2, 2008 FORT COLLINS CITY COUNCIL STAFF: Helen Matson SUBJECT Resolution 2008-115 Authorizing the Lease of a Portion of City-owned Property at 300 North Howes Street to Friends of the Fort Collins Bike Program, Inc., for up to Two Years as Part of the Recycled Bike Project. RECOMMENDATION Staff recommends adoption of the Resolution. FINANCIAL IMPACT Fort Collins Bike Program, Inc. pays $5/year for its current lease at 222 LaPorte Avenue. Exchanging these two areas will not increase the lease cost for the Bike Program. As in the current lease, the Bike Program will pay the yearly lease payment, its pro-rata share of utilities and will provide the necessary materials/equipment and volunteers to staff this project. EXECUTIVE SUMMARY On December 18, 2007, City Council approved leasing 222 LaPorte Avenue to the Friends of the Fort Collins Bike Program, Inc. ("FFCBP"). This site is the former home of the Poudre Valley Creamery("PVC"). The leased premises for the FFCBP include a garage at the west end of the site, the stand-alone building at the south of the parking lot and an area at the northeastern comer of the facility. The area at the northeastern corner of the building has been used by FFCBP for bike storage only. They have been utilizing the garage and the stand-alone building for the bike repair work. Due to structural deterioration in the northeast portion of the building,the City has been advised not to allow use in this area. As a result, staff has worked with the City's Bicycle Coordinator and the FFCBP to identify another area that could be used as bicycle storage. One block to the north is a City building, located at 300 North Howes, that is currently being used as storage but has room available for bikes. Since the building is only one block from the current site,this building became the optimum choice. The property at 300 North Howes is part of the Option Agreement with Penny Flats for its residential/commercial plans for this block. Staff has talked with Penny Flats about the possibility of leasing a portion of this site until it is ready to move forward with the option that contains the property at 300 North Howes Street. Penny Flats has agreed to allow the City to lease the property. December 2, 2008 -2- Item No. 21 Staff requests that Council approve a lease for the eastern bay,containing 1,306 square feet, of the building at 300 North Howes Street for the FFCBP. Howes Location Ma ° r _ ---- ------ -__ CHERRY ST I i 7-1 III F _ o © Q j I a o kv x ) - ---1 — -- -i--MAPLE ST i o C3 1 �i NI N z i c Z Z uJ 7771 CITY z � iz � o + LU ❑ y Hill IAPORiEAVE N Portion of Building to be Leased q RESOLUTION 2008-115 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF A PORTION OF CITY-OWNED PROPERTY AT 300 NORTH HOWES STREET TO FRIENDS OF THE FORT COLLINS BIKE PROGRAM, INC., FOR UP TO TWO YEARS AS PART OF THE RECYCLED BIKE PROJECT WHEREAS, the City is the owner of the property located at 300 North Howes Street, Fort Collins, Larimer County, Colorado, more particularly described as a portion of Lot 3, Penny Flats Subdivision, City of Fort Collins, Colorado (the "Howes Property"); and WHEREAS, the City has been cooperating with the Friends of the Fort Collins Bicycle Program,Inc.,a Colorado non-profit corporation(the"Friends"),on various programs including the Recycled Bike Project,which refurbishes lost,abandoned and donated bicycles and places them back in the community through the `Bike Library' operated by the Friends for the benefit of the community; and WHEREAS, the Friends' programs benefit the community by promoting bike riding, a desirable transportation alternative that will reduce traffic and improve air quality; and WHEREAS, in exchange for the various community benefits, and specifically for the operation ofthe Bike Library,the City Council,on December 18,2007,passed Resolution 2007-109, authorizing the lease of City property at 222 LaPorte Avenue(the"LaPorte Property")to the Friends to be used as space for storage and repair of bicycles and for operation of the Bike Library; and WHEREAS, part of the building on the LaPorte property that the Friends have been using for bicycle storage is no longer structurally sound; and WHEREAS, as a substitute storage space, City staff is proposing that the City lease to the Friends a storage bay located in the building on the Howes Property as shown on Exhibit "A", attached hereto and incorporated herein by reference (the "Premises"); and WHEREAS, the lease term will be for a period of up to two years, concurrent with the Friends lease of the LaPorte Property; and WHEREAS,the Friends would be responsible for the cost of utilities for the Premises, but would not be charged additional rent for the Premises beyond their current lease rate for the LaPorte Property of$5 per year; and WHEREAS,under Section 23-114 of the City Code,the City Council is authorized to lease, for a definite term of two (2)years or less, any and all interests in real property owned in the name of the City, provided that the City Council first finds, by resolution, that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that leasing the Premises located at 300 Howes Street under the terms listed above is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement for the Premises on terms and conditions consistent with this Resolution,together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, determines to be necessary and appropriate to protect the interests of the City,including any necessary changes to the legal description of the Premises, as long as such changes do not materially increase the size or change the character of the leased premises.
