RECOMMENDATION Staff recommends adoption of the Resolution. FINANCIAL IMPACT Coburn will pay all costs associated with its activities. EXECUTIVE SUMMARY The City of Fort Collins conducted a Request for Proposal ("RFP") process that requested proposals for the development of a portion of Block 33 in accordance with adopted City plans. The property included in this RFP was 75% of the block, excluding the Car Barn and associated parking. Through this process, the City selected Coburn's firm to complete the requested work in the RFP. At that time, the City and Coburn entered into an Exclusive Negotiating Agreement. The goal for this project is for Coburn to eventually acquire the property from the City and develop it in accordance with the approved plans. Coburn has done a preliminary design for the property and is proceeding into conceptual review. In order for Coburn to continue its work, the firm needs to have permission from the City to access the property and to perform due diligence work on the property including surveying and geotechnical drilling. They will also need on-going access to the site as the project develops. Issuing this Permit allows Coburn to continue the work as required by the Exclusive Negotiating Agreement for the property on Block 33. This Permit is not intended to include construction activities. Location Map ATTACHMENT REVOCABLE PERMIT FOR BLOCK 33 LOCATION MAP 0 Z CHERRY ST Cq Z Z MAPL ST ® Revocable Permit Area N RESOLUTION 2005-050 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A REVOCABLE PERMIT TO COBURN DEVELOPMENT, INC., FOR A PERIOD OF UP TO TWO YEARS ON PROPERTY OWNED BY THE CITY FOR THE PURPOSE OF ACCESS AND PERFORMING DUE DILIGENCE ACTIVITIES WHEREAS, the City of Fort Collins ("City") is the owner of that certain real property described as Lots 1 — 8 and 13 — 16, Block 33, Fort Collins, Colorado ('Property"); and WHEREAS, the City issued a Request for Proposal ("RFP") on September 14, 2004, for the development of the Property; and WHEREAS, as a result of the RFP, the City selected Coburn Development, Inc. ("Coburn") to plan a development for the Property and the City entered into an Exclusive Negotiating Agreement with Coburn, dated January 26, 2005; and WHEREAS, Coburn has asked the City to authorize its access onto the Property to perform preconstruction due diligence work including, but not limited to, surveying and geotechnical drilling; and WHEREAS, it is anticipated that such activities will be completed within a two-year period; and WHEREAS, Article XI, Section 10, of the Charter of the City of Fort Collins authorizes the Council to permit the use or occupation of any street, alley, or public place, provided that such permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is expressly reserved in such permit. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager is hereby authorized to execute such documents as are necessary to authorize Coburn to have access to the Property, consistent with the terms of this Resolution, which authorization may include such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or effectuate the purposes of this Resolution.
