SUBJECT
First Reading of Ordinance No. 061, 2005, Appropriating Unanticipated Revenue in the Street
Oversizing Fund and Authorizing the Transfer of Appropriations from the Street Oversizing
Fund to the Capital Project Fund - Trilby and Ziegler Road Improvements Project,
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
This Ordinance appropriates $629,342 in unanticipated revenue from "contributions in aid of
construction" in the Street Oversizing Fund (received from the Poudre R-1 School District), and
$598,113 in existing budgeted money from the Street Oversizing Fund into the Capital Projects
Fund to construct minor arterial roadway improvements for the Ziegler Road Project, Trilby
Road to Kechter Road and the Trilby Road connection. Included in this total appropriation is
$100,000 for the design for the intersection improvements at the Kechter Road and Ziegler Road
intersection.
Funds will be appropriated as follows:
Poudre R-1 School District $629,342 Contribution In Aid of Construction
Street Oversizing Fund $598,113 Street Oversizing Fund
EXECUTIVE SUMMARY
The construction of Kinard Junior High School requires minor arterial street improvements for
Ziegler Road adjacent to the school property. Staff worked with the Poudre R-1 School District
in an effort to coordinate the completion of Ziegler between Trilby Road and Kechter Road as
well as the connection of Trilby between Timberline Road and Kechter. The improvements will
be to an important segment of roadway which will provide primary access to the new Kinard
Junior High School projected to open in the fall of 2006. This project is funded entirely through
developer contributions and the construction will be managed by the City Street Oversizing
Program staff.

BACKGROUND
Over the past year, the Poudre R-1 School District and the Street Oversizing staff have worked
to complete the design of Ziegler adjacent to the new Kinard Junior High School (currently
under construction). This project will finish the construction of the east half of Ziegler with bike
lanes, curb, gutter and sidewalk from Kechter on the north to Trilby on the south. Fossil Lake
Estates participated in the project by dedicating the necessary right-of-way along the frontage of
their developed site.
The Project is planned to begin construction in the fall of 2005. The Project will be constructed
without closing traffic flow other than a 2 week closure to install a 24 inch diameter water line
for Fort-Collins Loveland Water District. Project construction is planned to be completed within
2 months of the start date.
On May 3, 2005, City Council adopted Resolution 2005-043 calling for a roundabout design at
this intersection. The design will take place this summer and include citizen input. The roadway
improvements to Ziegler will be completed this year; however, the intersection improvements
will be completed the summer of 2006 prior to the opening of the Kinard Junior High School.
Both the roadway construction project and the roundabout engineering design will begin as soon
as funds are available. The intersection construction funding will be appropriated next year from
2006 Street Oversizing Fund revenues.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE STREET
OVERSIZING FUND TO THE CAPITAL PROJECT FUND - TRILBY AND ZIEGLER ROAD
IMPROVEMENTS PROJECT
WHEREAS, with the construction of Kinard Core Knowledge Junior High School (the
"School") scheduled to be completed in time for the Fall 2006 school year, arterial street
improvements are planned for Ziegler Road, adjacent to the School, from Kechter Road south to
Trilby Road; and
WHEREAS, during the past two years, staff from the City and Poudre R-1 School District
have been working on design plans for Ziegler Road adjacent to the School; and
WHEREAS, the planned improvements include the installation of curb-and-gutter,
sidewalks, and bike lanes from Kechter Road on the north to Trilby Road on the south (the
"Project"); and
WHEREAS, the estimated cost to construct improvements associated with the Project is
$1,127,455, with available funds identified as follows:
Contributions - Poudre R-1 School District $ 629,342
Street Oversizing Fund - Existing Appropriations 498,113
Total $ 1,127,455
WHEREAS,upon completion of the bid process,the Project is scheduled to begin in the Fall
of 2005, with final completion within two months of the Project's start date; and
WHEREAS, on May 3, 2005, City Council adopted Resolution 2005-043, authorizing the
construction of a modem roundabout at the crossing of Ziegler and Kechter Roads; and
WHEREAS, City staff recommends that $100,000 be appropriated in the Project and used
for the design of the roundabout improvements; and
WHEREAS, staff further recommends using available appropriations in the City's Street
Oversizing Fund 2005 budget; and
WHEREAS, the design of the modern roundabout intersection improvements will be bid at
the same time as the aforementioned arterial improvements for Ziegler Road, with said design
scheduled for completion during the summer of 2005 and construction of the improvements
scheduled for the Summer 2006; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits City Council to make supplemental appropriations by ordinance at any time during the fiscal
year, provided that the total amount of such supplemental appropriations, in combination with all
previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, Article V, Section 10, of the Charter authorizes City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital
account to another fund or capital project,provided that the purpose for which the transferred funds
are to be expended remains unchanged; and
WHEREAS, the appropriation of the contribution from Poudre R-1 School District as
described herein will not cause the total amount appropriated in the Street Oversizing Fund budget
to exceed the current estimate of actual and anticipated revenues to be received during any fiscal
year; and
WHEREAS, it is the desire of City Council to appropriate the sum of $629,342 from
contributions within the Street Oversizing Fund, for transfer to the Capital Projects Fund - Trilby
and Ziegler Road Improvements Project, and to authorize the transfer of existing appropriations,
totaling $598,113, in the Street Oversizing Fund to the Capital Projects Fund - Trilby and Ziegler
Road Improvements Project to be used to construct arterial street improvements for Ziegler Road,
adjacent to the new School, from Kechter Road, south to Trilby Road ($1,127,455) and to begin
design of modern roundabout improvements at the intersection of Kechter and Ziegler Roads
($100,000).
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated revenue in the Street
Oversizing Fund,the sum of SIX HUNDRED TWENTY-NINE THOUSAND THREE HUNDRED
FORTY-TWO DOLLARS($629,342) for transfer to the Capital Projects Fund-Trilby and Ziegler
Road Improvements Project, and appropriated therein, to be used to construct arterial street
improvements for Ziegler Road, adjacent to the new School, from Kechter Road, south to Trilby
Road.
Section 2. That the unexpended appropriated amount ofFIVE HUNDRED NINETY-EIGHT
THOUSAND ONE HUNDRED THIRTEEN DOLLARS ($598,113) is hereby authorized for
transfer from the Street Oversizing Fund to the Capital Projects Fund - Trilby and Ziegler Road
Improvements Project,and appropriated therein,to be used to construct arterial street improvements
for Ziegler Road, adjacent to the new School,from Kechter Road, south to Trilby Road($498,113)
and to begin design of modern roundabout improvements at the intersection of Kechter and Ziegler
Roads ($100,000).
Introduced, considered favorably on first reading, and ordered published this 7th day of
June, A.D. 2005, and to be presented for final passage on the 5th day of July, A.D. 2005.
