SUBJECT
Second Reading of Ordinance No. 184, 2004, Authorizing Addendum #1 to the Long-Term Lease
of Property at the Fort Collins-Loveland Airport with Bill Sheel.
RECOMMENDATION
Staff recommends adoption of this Ordinance on Second Reading.
EXECUTIVE SUMMARY
Bill Sheel has constructed a private hangar on the airport under a long-term lease agreement. Mr.
Sheel wishes to construct an automobile access to his hangar off of Lear Drive. The land needed
for this access will be added to his lease and lease payments will be increased by an additional
$115.80 per year.
The cities have the option of canceling the amendment if the land is needed for any purpose in the
future. The cities are not obligated for any costs if the amendment is cancelled prior to the expiration
of the term of the base lease.
Ordinance No. 184, 2004, was unanimously adopted on First Reading on November 16, 2004.
ORDINANCE NO. 184, 2004
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING ADDENDUM#1 TO THE LONG-TERM LEASE OF
PROPERTY AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
WITH BILL SHEEL
WHEREAS, the City Council adopted Ordinance No. 058, 2002,authorizing the long-term
lease of property at the Fort Collins-Loveland Municipal Airport to Bill Sheel,for the construction
of an aircraft hangar; and
WHEREAS, on April 17, 2002, the Cities of Fort Collins and Loveland entered into the
Lease Agreement with Bill Sheel as authorized by said Ordinance; and
WHEREAS, Bill Sheel desires to increase the area he will lease from the Cities so that he
can construct and maintain an automobile access road from Lear Drive to the hangar constructed on
the leased premises; and
WHEREAS, the lease of the additional area to Bill Sheel for the construction and
maintenance of an access road will not adversely affect the Cities' use of their Airport property.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to enter into Addendum#1 to the above described
Lease Agreement between the Cities of Fort Collins and Loveland, Colorado and Bill Sheel dated
April 17,2002,which Addendum is on file with the City Clerk of the City of Fort Collins,Colorado,
subject to such modifications in form or substance as the Mayor, in consultation with the City
Attorney,may deem necessary to effectuate the purposes of this Ordinance or to protect the interests
of the City.
Introduced and considered favorably on first reading and ordered published this 16th day of
November,A.D.2004,and to be presented for final passage on the 7th day of December,A.D.2004.
