RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT This Ordinance appropriates $471,063 in unanticipated revenue from Contributions-in-Aid-of- Construction in the Street Oversizing Fund (received from the developers of the Sidehill Development), and transfers an additional $900,000 from existing appropriations in the Street Oversizing Fund into the Capital Projects Fund in order to construct arterial roadway improvements for the Drake and Zeigler Road Improvements Project, Phase I. This project will go to bid as soon as funds are available. Funds will be appropriated as follows: Sidehill Development $443,751.96 Contributions-In-Aid-of-Construction Street Oversizing Fund $900,000.00 Street Oversizing Fund EXECUTIVE SUMMARY The Drake and Zeigler Road Improvements Project, Phase I includes arterial street improvements for Drake Road, from Timberline east to Environmental Drive (approximately 4,500 linear feet). These street improvements will include the widening of Drake Road to a minor arterial street standard from its existing two-lane configuration, and the construction of the Environmental Drive connection(an additional 1,000 linear feet). The improvements include the installation of curb-and- gutter, sidewalks, asphalt paving, bike lanes, and storm sewers. Staff has coordinated this project with the planned construction of a new trunk sewer line to be constructed by the City's water and wastewater utility. These projects both require a full street closure in order to construct them safely and efficiently. By coordinating schedules and completing the work simultaneously, only one street closure will be necessary. The construction is planned to begin in March of 2005. The full closure of the roadway will last approximately 3 months. December 7, 2004 -2- Item No. 21 BACKGROUND Staff has designed the Drake and Ziegler Road Improvements Project in conjunction with the Rigden Park development. The designed improvements include approximately 4500 linear feet of Drake Road east of Timberline and a realignment of Ziegler Road from Drake to Horsetooth. The first phase is the construction of the designed improvements for Drake Road from Timberline to Environmental Drive, and will be completed in 2005. With the Sidehill Development and the future Lifestyle Center on Harmony and Ziegler, the widening of this roadway to accommodate the increasing traffic volume is a priority. The second phase of construction is planned for 2006,and will realign Ziegler Road to the west side of the Fossil Creek Reservoir Inlet Ditch,to replace the existing substandard County Road#13,now named Ziegler Road. This new alignment will meet minor arterial standards and will eliminate the current substandard roadway with its narrow one lane bridges. Staff has worked with the owners of the Cargill property and has successfully negotiated the purchase of a slope and construction easement required for this construction. A map is attached which indicates the approximate limits of the two phases of the Drake and Ziegler Road Improvements Project. ORDINANCE NO. 192, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE STREET OVERSIZING FUND TO THE CAPITAL PROJECT FUND -DRAKE AND ZIEGLER ROAD IMPROVEMENTS PROJECT, PHASE I WHEREAS, City staff has designed the Drake and Ziegler Road Improvements Project, Phase I (the "Project"), in conjunction with the Rigden Farm development; and WHEREAS, increased traffic volumes anticipated as a result of the Sidehill Development and the future Lifestyle Center at Harmony Road and Ziegler Road have created the need to begin construction of the Project improvements on Drake Road from Timberline Road east to Environmental Drive; and WHEREAS, Project improvements include the installation of curb-and-gutter, sidewalks, asphalt paving, bike lanes, and storm sewers in conjunction with the widening of Drake Road to a minor arterial street standard and the construction of the Environmental Drive connection; and WHEREAS, the Project improvements will be constructed in conjunction with the construction of a new trunk sewer line by the City's Wastewater Utility, thereby, minimizing the impact of road closures to motorists; and WHEREAS, the estimated cost to construct improvements associated with the Project is $1,343,752, with available funds identified as follows: Street Oversizing Fund -Developer Contributions $ 443,752 Street Oversizing Fund- Existing Appropriations 900,000 Total $ 1,343,752 WHEREAS,upon completion of the bid process,the Project is scheduled to begin in March 2005, with final completion scheduled for June 2005; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital account to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff has determined that the appropriation of the developer contributions from Sidehill Development as described herein will not cause the total amount appropriated in the Street Oversizing Fund budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the City Council to appropriate the sum of$443,752 from developer contributions within the Street Oversizing Fund,fortransfer to the Capital Projects Fund- Drake and Ziegler Road Improvements Project, and to authorize the transfer of existing appropriations,totaling$900,000,in the Street Oversizing Fund to the Capital Projects Fund Drake and Ziegler Road Improvements Project to be used to construct improvements on Drake Road from Timberline Road, east to Environmental Drive. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated revenue in the Street Oversizing Fund, the sum of FOUR HUNDRED FORTY-THREE THOUSAND SEVEN HUNDRED FIFTY-TWO DOLLARS ($443,752)for transfer to the Capital Projects Fund-Drake and Ziegler Road Improvements Project, and appropriated therein, to be used to construct improvements on Drake Road from Timberline Road, east to Environmental Drive. Section 2. That the unexpended appropriated amount of NINE HUNDRED THOUSAND DOLLARS ($900,000) is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund-Drake and Ziegler Road Improvements Project,and appropriated therein,to be used to construct improvements on Drake Road from Timberline Road, east to Environmental Drive. Introduced, considered favorably on first reading, and ordered published this 7th day of December,A.D.2004,and to be presented for final passage on the 21 st day of December,A.D.2004.
