SUBJECT
First Reading of Ordinance No. 078, 2005, Appropriating Unanticipated Revenue in the General
Fund and Authorizing the Transfer of Appropriated Amounts Between Accounts and Projects for
the Multi-Jurisdictional Drug Task Force.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The City received a $250,000 grant from the Office of Drug Control and System Improvement
("Byrne Grant") for the Latimer County Multi-Jurisdictional Drug Task Force. This funding
which was appropriated by Ordinance No. 103, 2004, was for the federal 2005 fiscal year
funding cycle (July 1, 2004 through June 30, 2005). The Federal Government has since changed
its fiscal year from July 1st through June 30th to October 1st through September 30th. The fiscal
year change created a funding gap of three months (July 1, 2005 through September 30, 2005)
requiring a request for bridge funding to cover the three month funding gap.
The Office of Drug Control and System Improvement awarded a new grant ("Byrne Bridge
Grant") in the amount of $51,250. The Byme Bridge Grant is a three month extension of the
existing Byrne Grant.
In addition to the Byrne Bridge Grant, a new local match of$108,125 is required. The $108,125
is apportioned as follows: $32,168 is to be appropriated from Fort Collins Police Services; the
Larimer County Sheriff's Office is contributing $49,090 via personnel; Colorado State
University Police Department has increased its obligation by $26,867 consisting of $25,617 in
personnel and a cash payment to the City of Fort Collins for $1,250 (which is included in this
appropriation Ordinance).
EXECUTIVE SUMMARY
The Larimer County Drug Task Force ("Task Force") includes Fort Collins Police Services,
Loveland Police Department, Larimer County Sheriff's Department, Drug Enforcement
Administration, and the Colorado State University Police Department.

Fort Collins Police Services applied to the Office of Drug Control and System Improvement on
behalf of the Task Force for federal grant monies to help fund the investigation of illegal
narcotics activities in Larimer County. The application was due to the recent change by the
Federal Government in their fiscal year which created a three month funding gap. The City
recently received notification of the grant award in the amount of $51,250, plus an additional
$1,250 in revenue from Colorado State University Police Department. The participating
agencies must provide matching funds in the amount of $108,125. Fort Collins' portion of the
match is $32,168. These funds will be used for rental and operational costs at the Task Force
off-site location, overtime funding to help offset the overtime costs of each participating agency,
and confidential funds to be used for the purchase of narcotics from drug dealers by undercover
police officers.
As the administrator of this grant, Police Services will assure funding to other participating
agencies for their share or the federal funds.
ORDINANCE NO. 078, 2005
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
BETWEEN ACCOUNTS AND PROJECTS FOR THE
MULTI-JURISDICTIONAL DRUG TASK FORCE
WHEREAS, Fort Collins Police Services was awarded a grant of federal money in the
amount of$250,000 through the Office of Drug Control and System Improvement("Byrne Grant")
for the federal fiscal year of July 1, 2004 through June 30, 2005 and these funds were appropriated
on Ordinance No. 103, 2004 ; and
WHEREAS,the federal government changed its fiscal year from July 1st through June 30th
to October 1st through September 30th, which creates a three month funding gap from July 1,2005
through September 30, 2005; and
WHEREAS,Fort Collins Police Services has been awarded a grant of federal money in the
amount of$51,250 through the Office of Drug Control and System Improvement ("Byrne Bridge
Grant") to bridge the funding gap from July 1, 2005 through September 30, 2005; and
WHEREAS,this grant is to be used by the Larimer County Drug Task Force("Task Force")
to help fund the investigation of illegal narcotics activities in Larimer County; and
WHEREAS, the City of Fort Collins will administer the grant for the Task Force which
includes Fort Collins Police Services, Loveland Police Department, Larimer County Sheriff's
Department, Drug Enforcement Administration, and the Colorado State University Police
Department; and
WHEREAS, the members of the Task Force will provide matching funds in the amount of
$108,125; and
WHEREAS,Fort Collins' portion of the matching funds is$32,168 which is included in the
2005 Police Services budget and is available for transfer to the Multi jurisdictional Drug Task Force
Grant Project; and
WHEREAS,the City of Fort Collins will receive$1,250 from the Colorado State University
Police Department to fund its portion of training costs; and
WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS,Article V,Section 10, of the Charter authorizes the City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or project
to another fund or project, provided that the purpose for which the transferred funds are to be
expended remains unchanged.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated grant revenue in the General
Fund the sum of FIFTY ONE THOUSAND TWO HUNDRED FIFTY DOLLARS ($51,250) for
expenditure upon receipt from the Office of Drug Control and System Improvement in the General
Fund for Police Services for the Multi-jurisdictional Drug Task Force Grant Project.
Section 2. That the unexpended appropriated amount of THIRTY-TWO THOUSAND ONE
HUNDRED SIXTY-EIGHT DOLLARS($32,168)is hereby authorized for transfer from the Police
Services operating budget in the General Fund to the Multi-jurisdictional Drug Task Force Grant
Project.
Section 3. That there is hereby appropriated from unanticipated revenue in the General Fund
the sum of ONE THOUSAND TWO HUNDRED FIFTY DOLLARS($1,250)for expenditure upon
receipt from Colorado State University Police Department in the General Fund for Police Services
for the Multi-jurisdictional Drug Task Force Grant Project.
