RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY The City purchased this parcel of land, including house and out buildings, as part of the Operations Services Master Plan. Staff recommends leasing this site until the improvements included in the Master Plan are constructed to discourage vandalism and to lower City costs to maintain the site. The site is currently leased. Ordinance No. 072, 2005, was unanimously adopted on First Reading on July 5, 2005. ORDINANCE NO. 072, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 812 NORTH SHIELDS STREET, FORT COLLINS, COLORADO FOR UP TO FIVE YEARS WHEREAS,the City of Fort Collins is the owner of the property at 812 North Shields Street, Fort Collins, Larimer County, Colorado; and WHEREAS, the City purchased this property for facilities provided in the Operations Services Master Plan to be constructed at a later date; and WHEREAS, the City desires to lease this Property for a period of up to five years at an annual rate of at least $10,200; and WHEREAS, the lease of the Property is beneficial in that it will discourage vandalism and reduce the City's costs to maintain the Property; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that leasing the property at 812 North Shields Street as provided herein is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a negotiated Lease Agreement consistent with the terms of this Ordinance, together with such additional terms and conditions as the City Manager,in consultation with the City Attorney,determines to be appropriate to protect the interests of the City.
