SUBJECT:
First Reading of Ordinance No. 56, 1998. Authorizing the Transfer of Appropriations Between the
Timberline Extension Capital Project and the Art in Public Places Program in the Cultural Services
and Facilities Fund.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The funds will be transferred from the Timberline Project Capital Project Fund to the Art in Public
Places Reserve Account in the Cultural Services and Facilities Fund.
Council approved an additional $890,000 to the Timberline Road project on January 6, 1998. One
percent(1%) of that amount, or $8,900 was required to be used for public art, but has not yet been
transferred to the appropriate Art in Public Places reserve account. The funds will be added to the
Art in Public Places Timberline Road project and be used for administration, commission of the
artist, Robert Tully, and contingency. and maintenance of the landscape art project that was
previously approved by the Council.
EXECUTIVE SUMMARY:
Council approved an additional $890,000 to the Timberline Road project on January 6, 1998. The
(1%) $8,900 will be transferred to the Art in Public Places Reserve Account in the Cultural Services
and Facilities Fund. The additional money will enable the artist, Robert Tully, to expand his art
project at Timberline Road.
ORDINANCE NO. 56, 1998
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATIONS
BETWEEN THE TIMBERLINE EXTENSION CAPITAL PROJECT
AND THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE
CULTURAL SERVICES AND FACILITIES FUND
WHEREAS, the City Council adopted Ordinance No. 197, 1997, on January 6, 1998,
appropriating prior year reserves in the Capital Projects Fund and authorizing the transfer of
appropriations between capital projects for the purpose of providing an additional $890,000 for the
construction of an extension of Timberline Road from Prospect to SummitView capital project (the
"Timberline Extension Project'); and
WHEREAS, pursuant to Section 23-304 of the City Code, one percent (1%) of the funds
appropriated for the Timberline Extension Project was required to be set aside in the Art in Public
Places reserve account in the Cultural Services and Facilities Fund, for use in the acquisition or
leasing of works of art,maintenance, repair or display of works of art, and administrative expenses
related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines
adopted by Council in Ordinance No, 20, 1995 (the "Guidelines"); and
WHEREAS, one percent of the funds appropriated for the Timberline Extension Project in
Ordinance No. 197, 1997, or $8,900, was not previously transferred to the Art in Public Places
reserve account in the Cultural Services and Facilities Fund; and
WHEREAS, Article V, Section 10, of the Charter of the City of Fort Collins authorizes the
City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof
from one fund or capital project to another fund or capital project, provided that the purpose for
which the transferred funds are to be expended remains unchanged; and
WHEREAS, on October 21, 1997, the Council approved the commission of artist Robert
Tully for the creation of a landscape sculpture art project in connection with the Timberline
Extension Project in Resolution 97-142; and
WHEREAS, the additional $8,900 will be used along with previously earmarked funds,
totaling $78.670, to allow the artist, Robert Tully, to expand the landscape sculpture art project
planned and approved for the Timberline Extension Project; and
WHEREAS, it is the desire of the Council to authorize the transfer of $8,900 from the
Choices 95 Timberline Extension capital project to the Art in Public Places program in the Cultural
Services and Facilities Fund, to be used with existing appropriations for the landscape sculpture
proposed by artist Robert Tully for the Timberline Extension Project.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
. COLLINS that the unexpended appropriated amount of EIGHT THOUSAND NINE HUNDRED
DOLLARS ($8,900) is hereby authorized for transfer from the Choices 95 Timberline Extension
capital project to the Art in Public Places reserve account in the Cultural Services and Facilities
Fund, and appropriated therein,to be used for the landscape sculpture project by artist Robert Tully,
in connection with the Timberline Extension Project.
Introduced and considered favorably on first reading and ordered published this 7th day of
April, A.D. 1998, and to be presented for final passage on the 21 st day of April, A.D. 1998.
