RECOMMENDATION: Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY: On March 18, 1997, the City Council passed Ordinance No. 51, 1997, adopting a new Land Use Code, and Ordinance No. 52, 1997, adopting a new Zoning Map, which were designed to help implement the land use policies of City Plan,the update to the City's Comprehensive Plan. At the time of the adoption of the ordinances, approximately 27 rezoning issue areas had been identified where either the property-owner and/or the adjacent property-owners and residents did not agree with staffs recommendation for the zoning of an area or piece of property. Rather than delay the adoption of the new Land Use Code, it was agreed that the rezoning of the issue areas would be further reviewed after adoption of the ordinances.The process would look again at the City Structure Plan and potential zoning designation. This property is one such issue area. Ordinance No. 46, 1998,which was unanimously adopted on First Reading on March 17, 1998,authorizes the rezoning of approximately 1.671 acres of a 4.880 site located east of Snead Drive and north of Fossil Creek Parkway. The rezoning request involves changing approximately 1.048 acres from the R-L, Low Density Residential,Zone to the C,Commercial,Zone,and changing approximately.623 acres from C to R-L. The current zoning consists of approximately 3380 acres of R-L Zoning and 1.494 acres of C Zoning. APPLICANT: Fort Collins/Loveland Water District c/o Dino DiTullio The Everitt Companies 3900 South College Avenue Fort Collins, CO 80525 OWNER: Fraternal Order of Police Lodge#3 Michael Thornton, President DATE: March 17, 1998 2 ITEM NUMBER: 19 BACKGROUND: On February 18, 1997,the City Council began the final steps to complete a two-year long process to update the City s Comprehensive Plan with the passage of Resolution 97-25, adopting the Community Vision and Goals 2015 document, the City Structure Plan map, and the City Plan Principles and Policies document as the three major elements of the new City Plan. On March 18, 1997,the process continued as the Council adopted Resolution 97-44, amending the City Structure Plan map,and the passage of Ordinance No. 51, 1997, and Ordinance No. 52, 1997, codifying anew Land Use Code and anew Zoning Map,,respectively. The City Structure Plan map was initially adopted in November 1996.In the period between November 1996, and March 1997, the new Zoning Map was developed. The development of the Zoning Map caused a reevaluation of the Structure Plan map and resulted in over 40 changes,which, as indicated,were approved by the Council in March. In addition, at the time of the adoption of Ordinance Nos. 51 and 52, 1997, approximately 27 rezoning issue areas had been identified where either the property-owner and/or the adjacent property-owners and residents did not agree with staffs recommendation for the zoning of an area or a piece of property. Rather than delay the adoption of the new Land Use Code until all issues could be resolved, it was agreed that the rezoning of the issue areas would be further reviewed after adoption of the ordinances.The process would look again at the City Structure Plan map and potential zoning designation. This property is one such issue area In March 1997, the owner was offered pwo choices for the`zoning of the property: accept staff s recommendation for the existing 3.386 acres of R-L, Low Density Residential, Zone and approximately 1.494 acres of C .Comme.rcial,Zoning,or place the property into the T,Transition, Zone. The owner selected the first option knowing the zonings would be reevaluated within one year. The surrounding zoning and land uses are as follows: N: E-1, Estate (County), Fairway Estates Subdivision, large-lot single-family residential S: R,Residential(County),Fossil Creek Meadows, single-family residential urban density C, Commercial,undeveloped E: R, Residential (County);-Fossil Creek°Meadows, single-family residential urban density W: C, Commercial, Fossil Creek Desipn Center)PUD;�commercial development (Carpet Exchange, etc.) This property was annexed into the City as part ofthe Fossil Creek First and the Fossil Creek Second Annexations in 1984. The existing C,Commercial,zoned portion(approximately 1.494 acres) of the property was initially zoned B-L, Limited Business, with a PUD condition. The existing R-L zoned portion(approximately 3.386 acres)has been zoned R-L since the time of annexation. The former B-L Zone was for properties which were to develop as neighborhood convenience centers. The PUD condition required all development proposals on the B-L zoned part of the property to be submitted and reviewed according to the criteria in the Land Development Guidance System (LDGS). The R-L Zone is for low density residential areas developed predominately with single family homes. DATE: March 17, 1998 3 ITEM NUMBER: 19 Rezonine: The applicant,the Fort Collins\Loveland Water District,with concurrence from the property-owner, the Fraternal Order of Police Lodge 41,requests that the City rezone approximately 1.671 acres of a 4.880 site located east of Snead Drive and north of Fossil Creek Parkway. The rezoning request involves changing approximately 1.048 acres from the R-L, Low Density Residential, Zone to the C. Commercial, Zone, and changing approximately .623 acres from C to R-L. The current zoning consists of approximately 3.380 acres of R-L Zoning and 1.494 acres of C Zoning. If approved,the site would have 2.961 acres of R-L Zoning and 1.919 acres of C Zoning. The zoning change is being requested by the Fort Collins/Loveland Water District in order to allow the construction of a new office building on the C zoned portion of the site. The rezoning is, perhaps, more of a request to make an adjustment to the existing zoning district boundaries than a rezoning to allow a completely different set of uses on the subject property. The site is shown of the City Structure Plan to be included in a commercial district and a low-density mixed-use neighborhood but the boundaries of the plan, as they should be, are not precise. When a draft of the zoning map was prepared for public review during the development of the Land Use Code, the entire property was initially depicted to be totally included in a commercial district. Several adjacent property-owners questioned the proposed zoning thus putting the property on the rezoning issues list. The existing C and R-L zones were placed on the property using the former B-L and R-L zoning boundaries. Since March 1997,the Water District has formulated sufficient plans to make the rezoning request fit its future desires for theruse of the property. An office building on the site would be a logical land use transition buffer between the commercial development to the west and the single-family residential development to the east.. NEIGHBORHOOD MEETINGS: Representatives from the Fort Collins/Loveland Water District and from the Everitt Companies met with the Fossil Creek Homeowner's Association on November 6, 1997,to discuss the potential for the construction of a new Water District office on the subj ect property. An open house showing the office development plans to surrounding residents was held on November 20, 1997. A letter of support for the rezoning from the Homeowners Association's President is attached. Because of the Water District's outreach efforts,staff saw no need to duplicate efforts and conduct a neighborhood meeting on the rezoning. FINDINGS OF FACT/CONCLUSION:. 1. The subject property was temporarily placed into the C,Commercial,and R-L,Low Density Residential,Zones in March 1997,in order to help facilitate the adoption of the City's new Land Use Code. 2. The requested rezoning (boundary adjustments) are consistent with the City's Comprehensive Plan. DATE: March 17, 1998 4 ITEM NUMBER: 19 PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board, at its meeting of February 19, 1998, voted 4-0 to recommend approval of the requested rezoning as part of the Board's Consent Agenda. STAFF RECOMMENDATION: Staff recommends approval of the requested C and R-L Zoning Districts.
