Items Relating to the RDC Annexation.
RECOMMENDATION:
Staff recommends adoption of the Ordinances on Second Reading.
EXECUTIVE SUMMARY:
A. Second Reading of Ordinance No. 42, 1998, Annexing Property Known as the RDC
Annexation to the City of Fort Collins, Colorado.
B. Second First Reading of Ordinance No.43, 1998,Amending the Zoning Map of the City of
Fort Collins and Classifying for Zoning Purposes the Property Included in the RDC
Annexation to the City of Fort Collins, Colorado.
On March 17, 1998, Council unanimously adopted Resolution 98-42 Setting Forth Findings of Fact
and Determinations Regarding the RDC Annexation.
On March 17, 1998, Council also unanimously adopted Ordinance No. 42 and 43, 1998,annexing
and zoning approximately 39.15 acres in size. The site is generally located in an area bounded by
the Burlington Northern Railroad and Vine Drive on the north,Collins Aire Mobile Home Park and
Summitview Drive on the east, Industrial Business Park International P.U.D. and International
Boulevard on the south, and the Dry Creek Annexation on the west. The property is vacant.
The proposed zoning is L-M-N, Low Density Mixed-Use Neighborhood. This will match the
existing zoning on the Dry Creek parcel located immediately to the west. Contiguity with the
existing municipal boundary is gained along the north and west property lines.

This is a 100% voluntary annexation and zoning of a property approximately 39.15 acres in size.
The site is generally located in an area bounded by the Burlington Northern Railroad and Vine Drive
on the north,Collins Aire Mobile Home Park and Summitview Drive on the east,Industrial Business

existing zoning on the Dry Creek parcel located immediately to the west. Contiguity with the
existing municipal boundary is gained along the north and west property lines.
BACKGROUND:
The property is located within the Urban Growth Area. According to policies and agreements
between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation according
to State law. The property gains contiguity by the following parcels:

The surrounding zoning and land uses are as follows:

The parcel gains the necessary one-sixth (16.6%)contiguity along the north and west boundaries.
With the these property lines being contiguous,the parcel has 39%contiguity. The parcel,therefore,
complies with the requirements of the INTERGOVERNMENTAL AGREEMENT FOR THE
URBAN GROWTH AREA andOglftib
Zoning:
The proposed zoning is L-M-N,Low Density Mixed-Use Neighborhood. This zone is intended to
be a setting for a predominance of low density housing combined with complementary and
supporting land uses that serve a neighborhood and are developed and operated in harmony with the
residential characteristics of a neighborhood. Placing the subject parcel into the L-M-N zone
complies with City Plan and Structure Plan. The L-M-N zone matches the zoning on the adjacent
parcel to the west, Dry Creek Annexation.
Findings:
1. The annexation of thisLcelc iste a polic s and agreements between Larimer

2. The parcel meets all criteria included in State law to qualify for annexation by the City of
Fort Collins.
3. The requested zone district, L-M-N, Low Density Mixed-Use Neighborhood, is in
conformance with the City's Comprehensive Plan (City Plan) and the City Structure Plan.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board voted 6-0 to recommend to City Council approval of the RDC
Annexation and Zoning at its regular meeting of March 5, 1998.
