RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY The City of Greeley, the North Weld County Water District and East Latimer County Water Districts,(the"Districts")are in the process of acquiring the necessary easements for their waterline transmission projects("GWET"and"NEWT")which are scheduled to begin construction in January 2009. The City of Fort Collins Engineering Department owns a parcel of land at 1000 North College Avenue on which the City of Greeley and the Districts have requested easements for their projects. The City property was purchased for the future intersection of the realigned East Vine Drive and North College Avenue as shown on the Master Street Plan. In addition to the$2000 compensation, the City of Greeley has also agreed to demolish the existing building,as requested by City staff,and reseed the ground after construction is complete. This Ordinance, unanimously adopted on First Reading on August 19, 2008, authorizes the conveyances of the easements. City staff will continue to assist Latimer County to uphold the conditions set forth in the approval of the project by the Latimer County Planning Commission on October 17, 2007 for the areas impacted by the project lying in Latimer County's jurisdiction. In addition to the $2000 compensation, the City of Greeley has also agreed to demolish the existing building, as requested by City Staff, and reseed the grower c truc ' is c pl BACKGROUND The Greeley Waterline Enhancement Transmission Project (GWET) involves the installation of a 60-inch diameter pipeline and is designed to transport water from its Bellvue water treatment plant located northwest of Fort Collins to the City of Greeley and surrounding towns. The North Weld County Water District and East Larimer County Water District Waterline Transmission Project (NEWT) is designed to meet the water needs of the growing population in Northern Colorado, including the City of Fort Collins. It involves the installation of a large diameter pipeline(between I August 19, 2008 -2- Item No. 22 42 and 60 inches) from the Soldier Canyon Filter Plant near Horsetooth Reservoir to the two Districts. The City of Greeley has requested a .066 a em i ill north nineteen feet of the parcel for its waterline. The Districts have requested a.086 acre parcel that will encumber the south 25 feet of the parcel for their waterline. The location of these waterlines was shown on the final route design for the GWET project, which was approved by the City of Fort Collins Planning and Zoning Board on June 16, 2005. The City of Greeley and the Districts have agreed to pay the City a fee of$1000 for each of the easements. The City of Greeley has also agreed to demolish the existing building, as requested by City staff, and will reseed the ground after construction is complete. City staff has requested the demolition of the building since it will save the City this cost when the future intersection is constructed. Planning and Zoning BU ng M p eY 005. i ORDINANCE NO. 102, 2008 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CONVEYANCE OF TWO WATERLINE EASEMENTS ON CITY PROPERTY TO THE CITY OF GREELEY AND THE EAST LARIMER COUNTY AND NORTH WELD COUNTY WATER DISTRICTS WHEREAS, the City is the owner of a parcel of real property located at 1000 North College Avenue (the "City Property"); and WHEREAS, the North Weld County Water District (NWCWD) and East Latimer County Water District (ELCO) (together, the "Districts"), along with the City of Greeley, are in the process of acquiring the necessary easements for their waterline transmission projects, which are scheduled to begin construction in January 2009 (the "Projects"); and WHEREAS, the City of Greeley has asked the City to convey to it a waterline easement on the City Property as described on Exhibit "A", attached and incorporated herein (the "GWET Easement"), and the Districts have asked the City to convey to them a waterline easement on the City Property as described on Exhibit "B", attached and incorporated herein (the "NEWT Easement'); and WHEREAS, the GWET Easement is .066 acres in size and the NEWT Easement is .086 acres; and WHEREAS, as consideration for the easements, the City of Greeley and the Districts have agreed to pay the City $1,000 for each of the easements and to demolish the existing building on the Property; and WHEREAS, upon completion of the Projects, the City of Greeley and the Districts will restore the easement areas to a condition comparable to their condition prior to construction, including the reseeding of the ground areas and the restoration of any City improvements affected by the construction of the Project improvements or the use of the easement areas; and WHEREAS, City staff has identified no negative impacts to the City resulting from the grant of the requested easements or installation of the waterlines; and WHEREAS, Section 23-11l(a) of the City Code provides that the City Council is authorized to sell, convey, or otherwise dispose of any and all interests in real property owned in the name of the City, provided that the Council first finds, by ordinance, that such sale or other disposition is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: i Section 1. That the conveyance of the GWET and NEWT Easements on the City Property to the City of Greeley, NWCWD and ELCO as provided herein is in the best interests of the City. Section 2. That the Mayor is hereby authorized to execute such documents as are necessary to convey the GWET Easement to the City of Greeley and the NEWT Easement to NWCWD and ELCO on terms and conditions consistent with this Ordinance, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, determines are necessary or appropriate to protect the interests of the City, including, but not limited to, any necessary changes to the legal descriptions of the easements, as long as such changes do not materially increase the size or change the character of the easements.
