RECOMMENDATION Staff recommends the adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY The City built this house for use by the Cemetery Superintendent. Since this position has been eliminated, the City does not need to use this house as a staff residence. CLRS staff considered moving the building to Roselawn Cemetery to be used as a maintenance facility. Researching this option, staff concluded that it would not be cost effective to move and remodel the house into a maintenance shop. This Ordinance,which was unanimously adopted on First Reading on September 21, 2004, allows staff to keep the house rented for up to five years. ORDINANCE NO. 150, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 149 GRANDVIEW ROAD, FORT COLLINS, COLORADO, FOR UP TO FIVE YEARS WHEREAS, the City of Fort Collins is the owner of the property at 149 Grandview Road, Fort Collins, Larimer County, Colorado (the "Property"); and WHEREAS, the Property was formerly used as the residence of the Cemetery Superintendent; and WHEREAS,this Superintendent position has been eliminated and the City does not need to utilize the Property as a staff residence; and WHEREAS, City staff desires to lease the Property for a period of up to five years at an annual rate at least$10,000; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that leasing the residence at 149 Grandview Road as provided herein is in the best interests of the City of Fort Collins. Section 2. That the City Manager is hereby authorized to execute a negotiated Lease Agreement consistent with the terms of this Ordinance, together with such additional terms and conditions as the City Manager,in consultation with the City Attorney,determines to be appropriate to protect the interests of the City.
