RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY The Airport has not previously adopted minimum standards for commercial aeronautical operations occurring at or around the Airport. However,the FAA recommends that all federally funded airports adopt minimum standards. This Ordinance, unanimously adopted on First Reading on August 19, 2008, authorizes the adoption of those minimum standards. Public comments received during First Reading at the August 19th City Council meeting concerned changing language in Article Three, which deals with "Retail Self Service Fueling Operator" standards. The Airport Steering Committee met on August 21 st and conducted detailed discussions with representatives from the FNL Pilots Organization concerning their comments about Article Three. At this meeting it was agreed by all parties present, that the importance of approving Minimum Standards for the Airport takes precedence over proposing changes that would further delay adoption of the Standards. At this meeting, the Steering Committee and staff committed to meeting with all interested parties to discuss their concerns. On September 2,2008, such a meeting was held with a good exchange of information and all parties agreed to continue follow-up meetings as more information is gathered. ATTACHMENTS I. BACKGROUND The purpose of minimum standards is to provide a minimum level of safety and service to the general public and to provide a"level playing field"for the aeronautical businesses that operate and compete at the Airport. The FAA recommends through its Grant Assurances, that airports adopt minimum standards as a way to ensure fair competition and non-discriminatory practices. The Cities have not previously adopted minimum standards for Airport businesses. The minimum standards only serve to regulate commercial aeronautical businesses wishing to operate at the Airport. S O businesses include, but are not limited to, aircraft repair shops, flight training, aircraft sales, aircraft charter, flying clubs, aircraft rental,aircraft radio repair/sales,aircraft painting,to name a few. The standards regulate such things as: hours of operation, minimum amounts of insurance, leased areas, hangar space, auto parking, restrooms, trained staff, FAA certifications and regulatory requirements such as TSA security standards. August 19, 2008 -2- Item No. 23 The minimum standards will require that a license be granted annually to each aeronautical business operating at the Airport. The annual license fee is set at $300. The license fee will be in place of the 1% of gross sales, which will be discontinued upon approval of the minimum standards. The minimum standards will be updated on a regular basis to provide for current or future changes necessary to accommodate operational or regulatory changes; such processes will require public comments and hearings before adoption. In addition, these standards do not impact or in any way superseded any requirements in the City of Loveland development and building standards required for development and construction of the Airport grounds. ORDINANCE NO. 103, 2008 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING MINIMUM STANDARDS FOR COMMERCIAL AERONAUTICAL ACTIVITIES AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT WHEREAS, the cities of Fort Collins and Loveland (jointly "the Cities") have previously entered into that certain "Intergovernmental Agreement for the Joint Operation of the Fort Collins-Loveland Municipal Airport" ("the IGA")dated May 16, 2000; and WHEREAS, in the IGA, the Cities set forth the terms and conditions pursuant to which the Fort Collins-Loveland Municipal Airport ("the Airport") will be owned, operated and maintained by the Cities as a joint venture; and WHEREAS, the Federal Aviation Administration ("the FAA") recommends in Advisory Circular No. 150/5190-7, dated August 28, 2006, that in order to stay in compliance with its federal grant assurance requirements, the Cities should adopt reasonable and non-discriminatory minimum standards to regulate commercial aeronautical activity at the Airport; and WHEREAS, the Cities have not yet adopted such minimum standards; and WHEREAS, the Airport Steering Committee has worked with the Cities' staffs to develop the "Fort Collins-Loveland Municipal Airport Minimum Standards" ("the Minimum Standards"), a complete copy of which is on file with the City Clerk and available for public inspection; and WHEREAS, the adoption of the Minimum Standards will encourage the provision of high quality products, services, and facilities to Airport users, encourage the development of quality improvements at the Airport, promote the public's health, safety and welfare, promote the economic health of the Airport and the businesses located at the Airport, promote the orderly development of Airport property, and promote the economic self-sufficiency of the Airport. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That adoption of the Minimum Standards is necessary for the public's health, safety and welfare. Section 2. That the Minimum Standards are hereby approved and adopted to be enforced by the Cities at the Airport in accordance with the terms and conditions of the Minimum Standards.
