RECOMMENDATION Staff recommends adoption of the Resolution and adoption of the Ordinance on First Reading. FINANCIAL IMPACT The Ordinance appropriates$73,000 into the Equipment Fund Alternative Fuel Station representing the 2005 fiscal year budget for the City of Fort Collins. The following funding sources have been identified: 2005-2006 Federal Fiscal Year Funds administered by CDOT $58,400 Local Match from City of Fort Collins (Operations Services—Fleet Fund) $14,600 Total $73,000 EXECUTIVE SUMMARY A. Resolution 2005-021 Authorizing the Execution of an Intergovernmental Agreement with the Colorado Department of Transportation for the Construction and Installation of a Compressed Natural Gas Backup Compressor at the Transfort Alternative Fueling Station. B. First Reading of Ordinance No. 038, 2005, Appropriating Unanticipated Revenue in the Equipment Fund and Authorizing the Transfer of Existing Appropriations in the Equipment Fund for Construction and Installation of a Compressed Natural Gas Backup Compressor at the Transfort Alternative Fueling Station. These actions are necessary to move forward with the installation of a backup Compressed Natural Gas facility which will provide additional fast fueling capability and a redundancy system in the event of a main compressor malfunction. This system will be critical in Transfort's fueling capability, as Transfort continues to acquire additional Natural Gas buses. March 15, 2005 -2- Item No. 18 A-B BACKGROUND The City of Fort Collins has completed the natural gas phase of the alternative fuels facility located at Transfort, 6570 Portner Road. Currently the City operates three minibuses, two minivans, and one pickup. In addition,a 30' full-size bus is on order and expected to be delivered this year. Staff anticipates that at least the next five buses will operate on natural gas. The Colorado Department of Transportation (CDOT) has drafted a grant contract for this project (05-HA4-00049), which allows these funds to be appropriated for the State of Colorado and provided to the City for use for the project. The Resolution authorizes the Mayor to enter into the grant contract for the funding. The Ordinance appropriates the Congestion Mitigation and Air Quality Funds and the local match expenditures to be spent for the City of Fort Collins 2005 budget year for the project. RESOLUTION 2005-021 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION AND INSTALLATION OF A COMPRESSED NATURAL GAS BACKUP COMPRESSOR AT THE TRANSFORT ALTERNATIVE FUELING STATION WHEREAS, on October 21, 2003, the City Council adopted Ordinance No. 135, 2003, appropriating $262,400 in federal Congestion Mitigation & Air Quality ("CMAQ") funds and authorizing the use of City matching funds,totaling $55,076,to be used to construct an alternative fueling facility at the City's Transfort site on Trilby Road, a natural gas appliance, and provide funding for an emissions repair project; and WHEREAS,on September 7,2004,Council adopted Ordinance No. 128,2004,appropriating $210,000 donated by the Governor's Office of Energy Management and Conservation and authorizing the use of City funds,totaling$242,000,to add a Hythane®/Hydrogen fueling appliance and related infrastructure at the Transfort Alternative Fueling Station; and WHEREAS, the Colorado Department of Transportation ("CDOT") has agreed to make available to the City a total of$58,400 in federal CMAQ funds to be used to construct and install a Compressed Natural Gas("CNG")backup compressor at the Transfort Alternative Fueling Station; and WHEREAS, the City's required local match is $14,600, and is available in the form of existing appropriations in the City's Equipment Fund; and WHEREAS, construction and installation of the aforementioned backup compressor at the Transfort fueling facility will provide additional fast fueling capability and a redundancy system in the event of a compressor malfunction; and WHEREAS, in order to receive the above-described CMAQ funds, it is necessary for the Mayor to enter into an intergovernmental agreement with CDOT for the receipt of those funds to be used to construct and install a CNG backup compressor at the Transfort Alternative Fueling Station; and WHEREAS, it is the desire of the Council to authorize the execution of said intergovernmental agreement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute an intergovernmental agreement with CDOT providing for the receipt of$58,400 in CMAQ funds to be used to construct and install a CNG backup compressor at the Transfort Alternative Fueling Station,together with such additional terms and conditions as the City Manager, in consultation with the City Attorney,determines to be appropriate to protect the interests of the City and consistent with the purposes set forth herein. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 15th day of March, A.D. 2005. Mayor ATTEST: City Clerk ORDINANCE NO. 038, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE EQUIPMENT FUND AND AUTHORIZING THE TRANSFER OF EXISTING APPROPRIATIONS IN THE EQUIPMENT FUND FOR CONSTRUCTION AND INSTALLATION OF A COMPRESSED NATURAL GAS BACKUP COMPRESSOR AT THE TRANSFORT ALTERNATIVE FUELING STATION WHEREAS, on October 21, 2003, the City Council adopted Ordinance No. 135, 2003, appropriating $262,400 in federal Congestion Mitigation & Air Quality ("CMAQ") funds and authorizing the use of City matching funds,totaling $55,076,to be used to construct an alternative fueling facility at the City's Transfort site on Trilby Road, a natural gas appliance, and provide funding for an emissions repair project; and WHEREAS,on September 7,2004,Council adopted Ordinance No. 128,2004,appropriating $210,000 donated by the Governor's Office of Energy Management and Conservation and authorizing the use of City funds,totaling$242,000,to add a Hythane®/Hydrogen fueling appliance and related infrastructure at the Transfort Alternative Fueling Station; and WHEREAS, the City has entered into a contract with the Colorado Department of Transportation ("CDOT") and will receive a total of$58,400 in federal CMAQ funds to be used to construct and install a Compressed Natural Gas ("CNG") backup compressor at the Transfort Alternative Fueling Station; and WHEREAS, the City's required local match is $14,600, and is available in the form of existing appropriations in the City's Equipment Fund; and WHEREAS, construction and installation of the aforementioned backup compressor at the Transfort fueling facility will provide additional fast fueling capability and a redundancy system in the event of a compressor malfunction; and WHEREAS,the City Council adopted Resolution 2005-021,on March 15,2005,authorizing the Mayor to enter into an intergovernmental agreement with CDOT for the receipt of CMAQ funds to be used to construct and install a CNG backup compressor at the Transfort Alternative Fueling Station; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff has determined that the appropriation of CMAQ funds ($58,400) from CDOT to exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,it is the desire of the Council to appropriate the sum of$58,400 in CMAQ funds from CDOT, and authorize the transfer of appropriations, totaling $14,600, from the Equipment Fund 2005 operating budget to the Equipment Fund - Transfort Alternative Fuel Station Backup Compressor project, to be used to construct and install a CNG backup compressor at the Transfort Alternative Fueling Station. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenues in the Equipment Fund-Transfort Alternative Fueling Station Backup Compressor project the sum of FIFTY-EIGHT THOUSAND FOUR HUNDRED DOLLARS ($58,400) to be used to construct and install a Compressed Natural Gas backup compressor at the Transfort Alternative Fueling Station. Section 2. That the unexpended appropriated amount of FOURTEEN THOUSAND SIX HUNDRED DOLLARS ($14,600) is hereby authorized for transfer from the Equipment Fund operations budget to the Equipment Fund - Transfort Alternative Fueling Station Backup Compressor project to be used to construct and install a Compressed Natural Gas backup compressor at the Transfort Alternative Fueling Station. Introduced, considered favorably on first reading, and ordered published this 15th day of March, A.D. 2005, and to be presented for final passage on the 19th day of April, A.D. 2005.
