Resolution 2005-037 Authorizing the Lease of City-Owned Agricultural Property at 1425 Overland
Trail for Up to Two Years.
RECOMMENDATION
Staffrecommends adoption of the Resolution. The Natural Resources Advisory Board reviewed and
approved the original land acquisition in 2003,which was at that time subject to a farm lease to the
proposed lessee. A one-year extension of the lease for 2005, with option to extend through 2006,
was approved by the Board at its regularly scheduled meeting on April 6, 2005.
EXECUTIVE SUMMARY
Pursuant to the City of Fort Collins Land Conservation and Stewardship Master Plan,the Andrijeski
Farm was purchased on September 1,2004. The 153-acre farm is located within the City's Growth
Management Area at 1425 North Overland Trail. A portion of the property was leased by the
previous owner to Roger and Keith Amey for several years for crop and grazing purposes, and it is
the intent of City Natural Area staff to extend the lease for a one or two year period, at the option
of both parties, subject to management direction from the staff.
BACKGROUND
The one-year lease, with option to extend an additional year, to the current lessee is on and over a
75-acre portion of the Andrijeski Farm which has traditionally been cultivated and grazed. The
remainder of the farm, not subject to the lease, is wetland area and a natural pond system which
provide a natural habitat for riparian flora and fauna, including a population of the rare Spiranthes
diluvialis(Ute ladies'-tresses orchid). These sensitive areas will be monitored and nurtured by the
Natural Areas staff in cooperation with the agricultural tenant as delineated in the lease. The lease
rate is $3,000 for each one-year period.
RESOLUTION 2005-037
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF CITY-OWNED AGRICULTURAL PROPERTY
AT 1425 OVERLAND TRAIL FOR UP TO TWO YEARS
WHEREAS, the City of Fort Collins is the owner of the property legally described as the
South 1/2 of the North 1/2 of Section 5,Township 7 North,Range 69 West of the 6th P.M., County
of Larimer, Colorado and also known as 1425 Overland Trail (the "Property"); and
WHEREAS,the City purchased this property for Natural Areas purposes and is promulgating
a Management Plan for the Property; and
WHEREAS, the City desires to lease portion of the Property containing approximately 75
acres, more specifically described on Exhibit"A", attached hereto and incorporated herein by this
reference (the"Leased Premises") for agricultural purposes for a term of one year, with an option
to renew for one additional year, for the annual lease rate of$3,000; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to approve the lease any and all interests in real property owned in the name of the City
for a period of two years of less by Resolution, provided that Council first finds that the lease is in
the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that leasing the Leased Premises pursuant to
the terms set forth herein is in the best interests for the City of Fort Collins.
Section 2. That the City Manager is hereby authorized to execute a lease agreement for
the Leased Premises, consistent with the terms of this Resolution, together with such additional
terms and conditions or modifications as the City Manager, in consultation with the City attorney,
determines to be necessary and appropriate to protect the interests of the City.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this
19th day of April, A.D. 2005.
