SUBJECT
First Reading of Ordinance No. 039, 2005, Appropriating Unanticipated Grant Revenue in the
Capital Projects Fund - Nix Barn Restoration Capital Project and Authorizing the Transfer of
Appropriations Between Funds for the Purpose of Restoring the Exterior of the Nix Barn at the
Nix Farm Natural Area, 1745 Hoffman Mill Road.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The City has been awarded a grant from the Colorado Historical Society's State Historical Fund
in the amount of$97,500 for the exterior restoration of the Nix Barn at the Nix Farm. A local
match of$52,500 is required and will be provided using existing appropriations in the Natural
Areas Fund. In addition, the Natural Areas Fund will contribute $1,500 to incorporate art into
the project. This Ordinance appropriates the grant proceeds in the Capital Projects Fund - Nix
Barn Restoration Capital Project and authorizes the transfer of existing appropriations, totaling
$54,000, from the Natural Areas Fund to the Capital Project Fund - Nix Barn Restoration Capital
Project.
EXECUTIVE SUMMARY
This item requests the appropriation of unanticipated grant revenue in the amount of $97,500,
and authorizes the transfer of$54,000 from the Natural Areas Fund to be used for stabilization
and restoration of the Nix Barn at the Nix Farm, 1745 Hoffman Mill Road.
The Colorado Historical Society awarded the City of Fort Collins a State Historical Fund grant
to cover structural analysis and building stabilization, window inventory and restoration,
chimney, doors, and siding restoration, replace the rusted leaking roof, and paint the historic
barn at the Nix Farm. State Historical Fund grants are available to public entities as applicants
for the purpose of historic preservation of their public buildings. The grant is designed to help
applicants use historic-type materials and craftsmanship that may cost more than modern ones.
This grant requires a cash match of $52,500. The City Code requires public projects to
incorporate art and $1,500 is being allocated for that purpose. The grant cash match and funding
to be used to incorporate art into the project will come from the Natural Areas Fund. The grant

also requires that the City allow State Historical Fund staff to record a 20-year covenant on the
property assuring its preservation.
The City's role is: (1) apply for the grant; (2) contract with the state to receive and administer the
grant funds; (3) provide the cash match; (4) contract for the restoration; (5) distribute the grant
and cash match funds. The Advance Planning Department will manage the grant.
ORDINANCE NO. 039, 2005
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE
CAPITAL PROJECTS FUND - NIX BARN RESTORATION CAPITAL PROJECT
AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS
FOR THE PURPOSE OF RESTORING THE EXTERIOR OF THE NIX BARN AT THE NIX
FARM NATURAL AREA, 1745 HOFFMAN MILL ROAD
WHEREAS,in 1996,the City of Fort Collins purchased a 27.5 acre parcel of land containing
two residences,a ramp barn,and an equipment/animal shed from Tom and Patsy Nix(the"Nix Farm
Natural Area"),using proceeds from the City's dedicated 0.25 cent sales and use tax to finance the
acquisition and development of open space, trails and natural areas, as approved by the voters at a
municipal election on November 3, 1992; and
WHEREAS,the Nix farm with its buildings,structures and sites have historical significance
to the City of Fort Collins, for their association with and representation of the agricultural
development of Fort Collins; and
WHEREAS,on June 5,2001,City Council adopted Ordinance No.94,2001,designating the
buildings, structures, and farm site know as the Nix Farm Natural Area, located at 1745 Hoffman
Mill Road in Fort Collins, as an historic landmark pursuant to Chapter 14 of the Code of the City
of Fort Collins; and
WHEREAS, the City of Fort Collins has been awarded a grant in the amount of$97,500
from the Colorado State Historical Society's State Historical Fund for the purpose of restoring the
exterior of the Nix barn on the site of the Nix Farm Natural Area (the"Project"), which grant will
require the City of Fort Collins to allow the State Historical Fund staff to record a 20-year covenant
on the property for its preservation; and
WHEREAS, local matching funds needed to cover the cost of the project improvements,
totaling$52,500,have been identified and are available in the form of existing appropriations in the
Natural Areas Fund 2005 Budget; and
WHEREAS, in addition, the Natural Areas Fund will contribute $1,500 to be used to
incorporate art into the Project, in conjunction with the City's Art in Public Places Program,
bringing the total Project cost to $151,500; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V, Section 10, of the Charter authorizes the City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital
project to another fund or capital project,provided that the purpose for which the transferred funds
are to be expended remains unchanged; and
WHEREAS, pursuant to Section 23-305 of the City Code, a City-selected artist shall
participate in the design of projects for the purpose of incorporating works of art into all aspects of
the project,both functional and aesthetic,to the fullest extent possible within the project budget,and
be paid from the project budget; and
WHEREAS, City staff has determined that the appropriation of funds from the Colorado
State Historical Society's State Historical Fund as described herein will not cause the total amount
appropriated in the Capital Projects Fund-Nix Barn Restoration capital project to exceed the current
estimate of actual and anticipated revenues to be received during any fiscal year; and
WHEREAS, it is the desire of the Council to appropriate the sum of$97,500,in the form of
grant proceeds from the Colorado Historical Society's State Historical Fund,in the Capital Projects
Fund-Nix Barn Restoration Capital Project,and authorize the transfer of$54,000 from the Natural
Areas Fund to the Capital Projects Fund - Nix Barn Restoration Capital Project to restore the
exterior of the Nix Barn at the Nix Farm Natural Area, and to incorporate art, totaling $1,500, into
said project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Capital Projects Fund - Nix Barn Restoration Capital Project the sum of NINETY SEVEN
THOUSAND FIVE HUNDRED DOLLARS ($97,500)to be used to restore the exterior of the Nix
Barn at the Nix Farm Natural Area.
Section 2. That the unexpended appropriated amount of FIFTY-FOUR THOUSAND
DOLLARS ($54,000) is hereby authorized for transfer from the Natural Areas Fund to the Capital
Projects Fund - Nix Barn Restoration Project, and appropriated therein, to be used to restore the
exterior of the Nix Barn at the Nix Farm Natural Area, and for incorporating art, totaling $1,500,
into said project.
Section 3. That the Mayor is hereby authorized to execute such documents of
conveyance of the covenant as the City Manager,in consultation with the City Attorney,determines
to be necessary or appropriate and not inconsistent with this Ordinance.
Introduced and considered favorably on first reading and ordered published this 19th day of
