RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY The Spring Creek Stormwater Basin Master Plan identified several capital projects to reduce the risk of flooding in the Spring Creek Basin. A $2,697,188 State of Colorado Division of Emergency Management ("CDEM") Grant has been awarded to the City for the construction of some of the stormwater projects in the Spring Creek Basin. The projects to be constructed with the grant include expansion of the Taft Hill, Rolland Moore and Southern Railroad Detention Ponds and the stabilization of the Burlington Northern Railroad embankment. The performance period for the grant is December 16, 2004 through December 31, 2006. This new grant was made available from the CDEM through an agreement with the Federal Emergency Management Agency for Pre-Disaster Mitigation ("PDM") projects. The Fort Collins projects were selected through a nationwide competitive process and may be the first in the nation to be awarded the PDM grant for a capital project. The Ordinance, which was unanimously adopted on First Reading on March 1, 2005, appropriates the grant proceeds to the Spring Creek PDM Capital Project. ORDINANCE NO. 028, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STORM DRAINAGE FUND FOR PROJECTS TO REDUCE PEAK FLOWS IN THE SPRING CREEK BASIN WHEREAS, the City of Fort Collins has been awarded a grant by the State of Colorado Division of Emergency Management ("CDEM") in the amount of$2,697,188; and WHEREAS, the grant is made available from the CDEM through an agreement with the Federal Emergency Management Agency for pre-disaster mitigation; and WHEREAS, the Grant was awarded to the City for the construction of several stormwater projects to reduce peak flows in the Spring Creek Basin; and WHEREAS, the grant proceeds will be used to expand the Taft Hill, Rolland Moore, and Southern Railroad Detention Ponds,and to stabilize the Burlington Northern Railroad embankment; and WHEREAS,the local matching funds needed,totaling$899,063, have been identified, and are appropriated and available in the Spring Creek Basin capital project budget in the Storm Drainage Fund; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of the grant funds from CDEM for projects to reduce peak flows in the Spring Creek Basin will not cause the total amount appropriated in the relevant funds to exceed the current estimate of actual and anticipated revenues to be received in that fund during any fiscal year WHEREAS, it is the desire of the Council to appropriate$2,697,188 in CDEM grant funds in the Storm Drainage Fund. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Storm Drainage Fund the sum of TWO MILLION SIX HUNDRED NINETY-SEVEN THOUSAND ONE HUNDRED EIGHTY-EIGHT DOLLARS for projects to reduce peak flows in the Spring Creek Basin. Introduced, considered favorably on first reading and ordered published this 1st day of March, A.D. 2005 and to be presented for final passage on the 15th day of March, A.D. 2005.
