SUBJECT :
First Reading of Ordinance No. 40, 1999, Amending Various Sections of the Transitional Land Use
Regulations Relating to the Consolidation of the Office of Electric Utility Services and the Office of
Water, Wastewater and Stormwater Utility Services.
RECOMMENDATION:
I Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
Ordinance No. 198, 1998,which was adopted on Second Reading on November 17, 1998,consolidated
the Office of Electric Utility Services and the Office of Water, Wastewater and Stormwater Utility
Services into one service area, the Office of Utility Services.
In view of this reorganization it is necessary to also make amendments to the Transitional Land Use
Regulations to change references to the "General Manager of the Water, Wastewater and Stormwater
Utility" to the "General Manager of Utility Services." Also, references to the "Office of the Electric
Utility"and"Office of the Water,Wastewater and Stormwater Utility"should be changed to the"Office
of Utility Services." The necessary changes are detailed in this Ordinance.
ORDINANCE NO. 40, 1999
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING VARIOUS SECTIONS OF THE TRANSITIONAL LAND USE
REGULATIONS OF THE CITY OF FORT COLLINS RELATING TO THE
CONSOLIDATION OF THE OFFICE OF ELECTRIC UTILITY SERVICES AND
THE OFFICE OF WATER, WASTEWATER AND STORMWATER UTILITY SERVICES
WHEREAS, on November 17, 1998, City Council approved Ordinance No. 198, 1998, on
second reading, consolidating the Office of Electric Utility Services and the Office of Water,
Wastewater and Stormwater Utility Services; and
WHEREAS, as a consequence, the City's General Manager of the Electric Utility and the
General Manager of the Office of Water, Wastewater and Stormwater Utility Services have now
been consolidated into one office,known as the General Manager of Utility Services; and
WHEREAS, the Office of the Electric Utility and the Office of Water, Wastewater and
Stormwater Utility are now consolidated into one office,known as the Office ofUtility Services;and
WHEREAS, as a result of this reorganization, it is necessary to make the changes in the
Transitional Land Use Regulations that are set forth in this Ordinance.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 29-524(a) of the Transitional Land Use Regulations of Fort
Collins is hereby amended to read as follows:
Sec. 29-524. Irrigation requirements.
(a) If the planting areas in the landscaping required by these Regulations are
extensive,the installation of an underground irrigation system shall be required,and
a final irrigation plan shall be submitted to and approved by the General Manager of
the ff' `■'-'-- 1'1111.-- tuid Starmwater Utility Services prior to the
issuance of the first building permit,or if no building permit is required,prior to the
commencement of construction. The final irrigation plan shall be submitted in
accordance with §29-526(G)(4)(d). If the water requirements of the plant material
are low enough to be met with natural precipitation, and if a means of temporary
irrigation is available to establish the plant material,the General Manager may waive
the requirement for an underground irrigation system.
Section 2. That Section 29-642(b)of the Transitional Land Use Regulations of the City
of Fort Collins is hereby amended to read as follows:
Sec. 29-642. Preliminary plat review.
(b) Such preliminary plat shall be processed in the following manner:
(1) The subdivider shall provide the Director of Planning with twenty
(20) copies of the preliminary plat. The Director shall, when
appropriate,furnish the following agencies and offices with a copy of
such plat for review and comments:
a. Fire Services;
b. E-leetrie Utility Sek des;
C. Parks and Recreation;
d. Engineering;
e. Public Service Company;
f. Telephone company;
g. Ditch and irrigation companies;
h. Public school district;
i. State Highway Department;
kj. Police Services;
1k. Zoning Inspector;
ni. Comprehensive planning;
elm. Transportation services;
pn. City's right-of-way agent;
qa. Railroad companies;
rp. Cable television companies;
sq Western Slope Gas Company;
tr. U.S. Department of Energy;
Section 3. That Section 29-679(b)of the Transitional Land Use Regulations of the City
of Fort Collins is hereby amended to read as follows:
Sec. 29-679. Required improvements prior to issuance of certificate of
occupancy.
(b) Where applicable, the person requesting a certificate of occupancy shall be
required to conform to the provisions of§§ 10-36 and 10-37 of the City Code by
submitting a post construction floodproofing elevation certificate to the General
Manager of t4te Offiee afWater,Wastewater and Stc..__ ate Utility Services for the
City's permanent records.
