SUBJECT
First Reading of Ordinance No. 101, 2004, Amending Section 2-596 of the City Code and
Setting the Compensation of the Interim City Manager.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
This ordinance establishes the salary and compensation provided the Interim City Manager while
he serves in this capacity.
EXECUTIVE SUMMARY
City Council appointed Darin Atteberry as Interim City Manager, effective June 16, 2004, via
Resolution 2004-065 on May 25, 2004. City Council appointed Mr. Atteberry to this position
with the understanding that his compensation would be adjusted and that the compensation
increase would be made effective with the date of his appointment as Interim City Manager. The
Ordinance also makes a City vehicle available to Mr. Atteberry during the period of his service
as Interim City Manager.

ORDINANCE NO. 101, 2004
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 2-596 OF THE CODE OF THE CITY OF FORT COLL NS
AND SETTING THE COMPENSATION OF THE INTERIM CITY MANAGER
WHEREAS, pursuant to Article III, Section 1 of the City Charter, the City Council
(the "Council") is responsible for fixing the compensation of the City Manager; and
WHEREAS, the City of Fort Collins is committed to compensating its employees in
a manner which is fair, competitive and understandable; and
WHEREAS, the City's pay philosophy is based on total compensation, which
includes not only base salary but also deferred compensation payments, vacation and
holiday leave, and amounts paid by the City for medical, dental, life and long-term disability
insurance; and
WHEREAS, City Manager John Fischbach has resigned his position as City
Manager effective June 16, 2004; and
WHEREAS, the Council, through adoption of Resolution 2004-065, has appointed
Assistant City Manager Dann Atteberry as the Interim City Manager; and
WHEREAS, this interim appointment will continue in effect until such time as the
Council officially appoints the new City Manager or such earlier time as the Council may
subsequently determine to be in the best interest of the City; and
WHEREAS, the Council agrees that at such time as the Interim City Manager is
relieved of his duties as Interim City Manager, he will be returned to the position of
Assistant City Manager; and
WHEREAS, the Council believes, based upon the added responsibilities placed on
the Assistant City Manager, that the base salary of the Interim City Manager should be
established at the amount of $121,000, effective June 16, 2004, so that the annualized total
compensation paid to the Interim City Manager will be in the amount of$153,959.
WHEREAS, in addition, the Council believes that a City vehicle should be made
available to the Interim City Manager in view of the fact that his new position will require a
considerable amount of travel to attend meetings, conferences, and the like.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That Section 2-596 of the Code of the City of Fort Collins is hereby
amended to read as follows:

annum, payable in biweekly installments. Forty (40) percent of such sum
shall be charged to the city electric utility, twenty (20) percent to the city
water utility and forty(40)percent to the general governmental expense.
Section 2. That the effective date of the salary adjustment referred to in Section
1 above shall be June 16, 2004.
Section 3. That the City shall make a City automobile available to the Interim
City Manager for his use during the term of his service as Interim City Manager. While the
Interim City Manager has the use of the City automobile under this provision, the City shall
be responsible for paying of the liability, property damage, and comprehensive insurance for
the automobile, or for self-insuring for the same, and for the cost to purchase, operate,
maintain, and repair said automobile.
Section 4. That at such time as the Interim City Manager is relieved of his duties
as Interim City Manager, he will be returned to the position of Assistant City Manager.
