Items Relating to the Trailhead Annexation.
RECOMMENDATION
Staff recommends adoption of the Resolution and of the Ordinances on Second Reading.
EXECUTIVE SUMMARY
A. Resolution 2004-075 Amending the Mountain Vista Subarea Plan Map and the CitY's
Structure Plan Map.
B. Second Reading of Ordinance No. 092, 2004, Annexing Property Known as the Trailhead
Annexation to the City of Fort Collins, Colorado.
C. Second Reading of Ordinance No. 093,2004,Amending the Zoning Map of the City of Fort
Collins and Classifying for Zoning Purposes the Property Included in the Trailhead
Annexation to the City of Fort Collins, Colorado.
On June 1, 2004, Council adopted Ordinance No. 092, 2004, on First Reading by a vote of 6-0
(Councilmember Tharp was absent) annexing the Trailhead property. Also on June 1, 2004,
Council adopted Ordinance No. 093, 2004, on First Reading with the recommended zoning of the
Trailhead Annexation to the Low Density Mixed Use Neighborhood District (LMN ) by a vote of
5-1 (Councilmember Tharp was absent and Councilmember Hamrick opposed). As a result, an
amendment to the Mountain Vista Subarea Area Plan and the City of Fort Collins Structure Plan is
accompanying the annexation and zoning ordinances on Second Reading. The plan amendments
will re-designate the Trailhead property from E— Employment to Low Density Mixed Use
Neighborhood. This zone district is consistent with the zoning adopted by Council on First Reading.
During the hearing, Council requested additional information concerning the recent negotiations
with Anheuser-Busch and City staff. These negotiations mainly focus on the possible location of
a regional detention pond located north of the Trailhead property and the proposed changes to the
Mountain Vista Subarea Plan. The key points are included within the attached memorandum. One
Councilmember also requested that a representative from Anheuser-Busch attend the June 15,2004
Council hearing. Based on this direction, staff has extended an invitation to Anheuser-Busch.
This is a request to annex and zone approximately 91.25 acres of land located along the north side
of East Vine Drive, south of the Burlington Northern Railroad, west of the Waterglen Subdivision.
The project is located within the Mountain Vista Sub-Area Plan. The proposed zoning is LMN—

Low Density Mixed-Use Neighborhood. The anticipated land use would be single and multi-family
residential, consistent with the standards in the LMN zone district.
RECOMMENDATION
Staff recommends that the City Council adopt the resolution amending the Mountain Vista Subarea
Plan and the City of Fort Collins Structure Plan, and adopt the annexation and zoning ordinances
on Second Reading, annexing the Trailhead property and placing it in the LMN zone district.
RESOLUTION 2004-075
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE MOUNTAIN VISTA SUBAREA PLAN MAP AND
THE CITY'S STRUCTURE PLAN MAP
WHEREAS,the City has received a petition for the annexation to the City of certain property
known as the Trailhead Annexation, which property is located along the north side of East Vine
Drive, south of the Burlington Northern Railroad and west of the Waterglen Subdivision which
annexation contains approximately 91 acres of land; and
WHEREAS,the City has also received an application to zone the Trailhead Annexation into
the "LMN" -Low Density Mixed Use Neighborhood Zone District; and
WHEREAS, the Council finds that the proposed zoning complies with the "Principles and
Policies"of the City's Comprehensive Plan,as well as the key principles of the City's Structure Plan
and also complies with the provisions contained in the Mountain Vista Subarea Plan with the
exception that the proposed zoning does not comply with the City's Structure Plan Map and the
Mountain Vista Subarea Plan Map; and
WHEREAS, the Council has determined that the proposed zoning for the Trailhead
Annexation is in the best interests of the citizens of the City and comports with the City's
Comprehensive Plan and Mountain Vista Subarea Plan except for the maps described above; and
WHEREAS,the Council has further determined that the Mountain Vista Subarea Plan Map
and the City's Structure Plan Map should be amended as shown on Exhibits "A" and "B" attached
hereto.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council finds that the existing Mountain Vista Subarea Plan
Map is in need of the amendment requested by the applicant for the Trailhead Annexation and
Zoning.
Section 2. That the City Council finds that the existing the City's Structure Plan Map is
in need of the amendment requested by the applicant for the Trailhead Annexation and Zoning.
Section 3. That the City Council finds that the proposed amendments will promote the
public welfare and will be consistent with the vision,goals,principles and policies of City Plan and
the elements thereof, including the Mountain Vista Subarea Plan.
Section 4. That the Mountain Vista Subarea Plan Map is hereby amended so as to appear
as shown on Exhibit "A" attached hereto and incorporated herein by this reference.
Section 5. That the City Plan Structure Plan Map is hereby amended so as to appear as
shown on Exhibit "B" attached hereto and incorporated herein by this reference.

WHEREAS,Resolution 2004-051, finding substantial compliance and initiating annexation
proceedings, has heretofore been adopted by the Council of the City of Fort Collins; and

City to annex said area to the City.

CITY OF FORT COLLINS, COLORADO
WHEREAS, Division 1.3 of the Land Use Code of the City of Fort Collins establishes the
Zoning Map and Zone Districts of the City; and
WHEREAS, Division 2.9 of the Land Use Code of the City of Fort Collins establishes
procedures and criteria for reviewing the zoning of land; and
WHEREAS, in accordance with the foregoing,the Council has considered the zoning of the
property which is the subject of this ordinance, and has determined that the said property should be
zoned as hereafter provided.

The Trailhead Annexation, Zoning and Structure Plan Amendment was presented to the Planning
and Zoning Board on April 15,2004.The Planning and Zoning Board recommends adoption of the
Annexation Resolution and Ordinance on First Reading, with initial zoning to the E—Employment
zone district,and subsequent denial of the requested amendment to the City of Fort Collins Structure
Plan from the Employment Di oPailarYoadelst

hborhood District.
This is a request to annex and ne appd located along the north side
of East Vine Drive, south of thf the Waterglen Subdivision.
The project is located within the Mountain Vista Sub-Area Plan. The proposed zoning is LMN —
Low Density Mixed-Use Neighborhood. The Mountain Vista Sub-Area Plan and the City of Fort
Collins Structure Plan designate this property as E—Employment.An amendment to the Mountain
Vista Sub Area Plan and Structure Plan is accompanying the annexation and zoning request. The
requested plan amendment would designate this property as Low Density Mixed-Use Neighborhood.
The anticipated land use would be single and multi-family residential,consistent with the standards
in the LMN zone district.
1. The annexation of this area is consistent with the policies and agreements between Larimer
County and the City of Fort Collins as contained in the Intergovernmental Agreement for the
Fort Collins Urban Growth Area.

The property is located within the Fort Collins Growth Management Area (GMA).
According to policies and agreements between the City of Fort Collins and Larimer County,
contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area(last
amended November 2000), the City will pursue the annexation of land into the City of Fort
Collins when such lands are eligible for annexation according to Colorado Revised Statutes
(CRS).
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a voluntary
annexation to the City of Fort Collins.
This property is eligib for an ation c di to olorado Annexation Act, which
requires 1/6 contiguit the ex ing ci li its. The 'lhead Annexation complies with
this standard since the p h f -of its to oundary of approximately 9,084
feet is contiguous to the existing city limits. This meets the minimum 1,524 feet required
to achieve 1/6 contiguity. This contiguity occurs through a common boundary with the
property to the north, east, west and south of the parcel.
3. Requested Structure Plan:
The removal of the Employment designation from the Trailhead property would represent
a loss of 90 acres within t i y's v nt Em to ent desi ated land inventory. A recent
study completed for Co o 1 A n ent concluded that the current
supply of Employme - desi ted 1 quat owever, any future removal of
Employment lands wil in ate sh fall in th ity's inventory.
With the most recent proposal, the applicant and the City have re-entered into negotiations
for the property north and west of the Trailhead site for use as a regional detention pond.
This concept would relocate a portion of the water ponding on adjacent Anheuser-Busch
property (estimated to be approximately 90 acres) to this adjacent property. Preliminary
grading plans have been completed by the applicant which will determine the capacity of the
new detention pond.With the most recent design,it is estimated that approximately 30 acres
of the 90 acres of area encumbered by floodwater on the adjacent Anheuser-Busch property
would be removed fro 6*on�

Even with the 30 acres removed from the flooding area, there still remains a net loss of
Employment land of 60 acres with this proposal. Additional improvements could be made
on Anheuser-Busch property to further reduce the ponding area; however, without the
consent of Anheuser-Busch to proceed with such plans, staff can not evaluate what impact
this may have. Staff maintains the position that this loss is too great to justify the zoning of
the Trailhead property to LMN without additional Employment land dedicated elsewhere.
Storm drainage issues on the Anheuser-Busch property have been an obstacle in the adoption
of the staff initiated amendments to the Mountain Vista Subarea Plan.This purchase of the
property by the City for a regional detention pond could be the catalyst to re-enter into
negotiations with Anheuser-Busch and continue the Mountain Vista Subarea Plan

amendment.The amended plan relocates Employment uses off of the Trailhead property and
onto adjacent Anheuser-Busch property.The resulting designation on the Trailhead property
is LMN.
The negotiations have been completed for the 30 acres on the northwestern portion of the
Trailhead property. Stormwater would like to acquire the property, since it is a key piece in

The City of Fort Collins Comprehensive Plan, City Plan, may be amended pursuant to Appendix C
of City Plan. All City Plan amendments shall be considered by the City Council, after
recommendation by the Planning and Zoning Board and City staff. Such amendment shall
demonstrate compliance with the following criteria:

Some conditions have changed since adoption of the Plan.For instance,Vine Drive had once
been considered to be a viable "truck bypass" route; that is no longer considered a viable
option. Also, the Burlington Northern Railroad line is directly west of this site. It was
originally thought that the Employment uses could take advantage of this line by adding
spurs off the main line for railcar deliveries. However, since the adoption of the Mountain
Vista Plan,the Larimer and Weld Ditch has been relocated from its previous location,which

bisected the property, to the edge of the property adjacent to the railroad tracks. This new
location has effectively eliminated the possibility of tying into the existing to lines.
B. The proposed plan amendment will promote the public welfare and will be consistent
with the visiongoals, rind les and policies of City Plan and the elements thereof.
One of the key goals of the Mountain Vista Sub Area Plan amendment is to maintain a
balance of land available for Employment and residential uses in the northeast part of town
and community-wide. The City is currently in the process of looking at some possible
amendments to the Mo t is u aRly

FINDINGS OF FACT/CO LUSIOV
After reviewing the Trailhead Annexation and Zoning, File #43-02, staff makes the following
findings of fact and conclusions as explained above:
1. The annexation of this area is consistent with the policies and agreements between Latimer
County and the City of Fort Collins as contained in the Intergovernmental Agreement for the
Fort Collins Urban Growth Area.
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a voluntary
annexation to the City o n

SUBJECT: Trailhead Annexation and Zoning
On June 1, 2004, the Trailhead Annexation, Zoning and plan amendment was presented
on first reading to the City Council for consideration. At the hearing, Council adopted the
annexation and zoning ordinances, with initial zoning of the Trailhead Annexation to the
LMN—Low Density Mixed-Use Neighborhood zone district, and subsequent adoption of
the Mountain Vista Subarea and Structure Plan amendments. As a result of the
discussion, Council requested additional information relating to the communications staff
has had with Anheuser-Busch (A-B) relating to the Mountain Vista Plan Amendment and
the contract to purchase a portion of the tract of land immediately north and east of the
Trailhead site for a regional stormwater detention pond. The following is a summary of
discussion points with Anheuser-Busch as they relate to the Mountain Vista Subarea Plan
Amendment and regional storm drainage solutions.
Mountain Vista Subarea Plan Amendment
The Mountain Vista Subarea Plan was adopted in March 1999. A few new issues have
arisen since adoption of the Plan. In response, staff initiated a process to amend the
Mountain Vista Subarea Plan in August 2003. The proposed amendments do not
represent a significant change in the overall direction of the Plan; rather they reflect a
focused list of revisions responding to changing conditions. The key issues triggering this
process include a development proposal recommendation, responding to Anheuser-Busch
concerns of incompatible land uses adjacent to Brewery and re-assessment of the existing
East Vine Drive alignment.
The proposed Plan amendments include revising the land use designations and street
network, changing the regional multi-use trail alignment, and re-alignment of East Vine
Drive. City staff outlined a public process throughout the fall of 2003, including
meetings with Boards and Commissions, City Council, general public and property
owners within the Plan area. Representatives of Anheuser-Busch were present at several
meetings to discuss the proposed amendments to the Plan.
The discussions with A-B and staff focused on the proposed land uses and stormwater
improvements and not the proposed East Vine Drive re-alignment. Since the Mountain
Vista Subarea Plan was adopted, A-B expressed concerns about land use designations,
especially the proximity of residential to the Brewery location, community park location
and stormwater improvements.
The proposed Plan amendments dated October 1, 2003 show a relocation of employment
land use designation on A-B property as a result of the proposed Trailhead Annexation
and Zoning. In addition, the proposed Plan shifts residential and commercial further to
the west and off of A-B property. Staff believes these recommended changes would
address most of A-B concerns and result in a more successful Plan.
In October 2003, representatives of A-B determined that they were not prepared to
continue discussions on land use until stormwater improvement issues are resolved
separately. As a result, progress on moving forward with the proposed Plan amendments
has been on hold. Staff anticipates continuing land use discussions with A-B as soon as
the stormwater issues have been resolved,between now and the end of the year.
Regional Stormwater Master Plan —Discussions with Stakeholders
The recently adopted Stormwater Master Plan identifies the need to update the
stormwater master plan for the Mountain Vista area, a sub-basin of the Cooper Slough
drainage basin, including the Anheuser-Busch (A-B) brewery. Utilities staff is in the
process of updating that master plan with representatives of A-B and other stakeholders
in the basin.
The Master Agreement between the City and A-B spells out conditions under which the
brewery and the remaining lands owned by A-B can develop. The agreement grants A-B
the right to chose from two options for handling stormwater. Under the "Company
Option," all stormwater improvements would be paid for by A-B in exchange for not
paying City stormwater fees. Under the "City Option," all stormwater facilities would be
paid for by the City in exchange for A-B paying city stormwater fees. In July 1984, A-B
notified the City that it had initially elected to exercise the Company Option, but further
expressed a desire to reserve the right to agree with the City at some later date to a
combination of on-site and off-site detention facilities and improvements to address
stormwater issues on the AB property.
At the time of development of the brewery, A-B prepared a conceptual drainage plan for
all of the A-B lands. This plan is currently being updated to reflect new information from
better topographic mapping and the new rainfall standard adopted by the City.
Alternatives are now being identified to solve existing problems that are compatible with
the future development of the Mountain Vista area. Through out the development of the
master plan, input from basin stakeholders must take place. These stakeholders include
ditch companies, property owners such as A-B and the owners of the Trailhead
Development, other City departments, and Larimer County.
A pending option agreement to purchase a parcel of land from the developer of the
Trailhead Development has been negotiated. Because the property the Utility is
considering is a low area where existing ponding occurs, it is probable that a regional
stormwater facility will be located there. If the current study confirms this, the option
would be exercised in 2006. Completion of the stormwater study is expected in late 2004
or early 2005.
