RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: Funds are budgeted in the 1999 Wastewater Utility Budget for this expenditure. The purchase is not to exceed $190,000. EXECUTIVE SUMMARY: Over the past fourteen years the Water/Wastewater Utility has used the Insituform Sleeving Method (Cured-In-Place-Pipe CIPP)to reline and restore over 38,000 lineal feet of existing six, eight, ten, twelve, eighteen, twenty-one. and twenty-four inch sewer mains and service connections. The method has been successful because it does not require any excavation of the street, minimizing disruption to citizens,businesses and traffic. In addition,there is a cost savings of between 5 to 40 percent,compared to conventional excavation and replacement methods.depending on the size and location of the line. This year, funds were budgeted for the relining of approximately 4.200 lineal feet of sewer mains, at a cost not to exceed $190,000. Section 8-160 of the Code states that any exemption to the use of competitive bidding in excess of $100,000 must be approved by the City- Council. The contract with Insituform Technologies is requested because it is the only repair method presently tested and approved that does not require excavation,it is cost effective when compared to conventional excavation and replacement methods and Instiuform Technologies has been determined to be the sole responsible source for this repair method. The Utility continues to review qualifications of other vendors and will perform a test with Western Slope Utilities from Breckenridge. However, there is not time to complete the testing and still perform the amount of work that needs to be completed in 1999. Council approved purchases with Insituform in 1997, of over 4,500 feet of Cured-In-Place-Pipe at a cost 5197,250 and in 1998, of over 4,600 feet at a cost of$255,474. The Resolution will authorize the contract for Insituform Sleeving(CIPP)as an exemption to the use of competitive bid or proposal and will allow an extension of the contract for 1999 as provided in Section 8-160(d)(4). RESOLUTION 99-121 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE ACQUISITION OF SERVICES FROM INSITUFORM TECHNOLOGIES, INC., FOR THE REPAIR OF EXISTING SEWER MAINS WHEREAS,Insituform's sleeving method has been used previously by the City's Wastewater Utility Department as a viable method for sewer main rehabilitation; and WHEREAS,the Wastewater Utility has conducted research proving Insituform's method is more cost effective and less disruptive to citizens, businesses and traffic than the conventional method of excavation and replacement; and WHEREAS, previous attempts to bid and the City's requirements have resulted in one bid being received from Insituform Technologies, Inc. ("Insituform"), and although other firms have been identified that do this work and the City is continuing to evaluate such other vendors, those vendors are not as experienced as Insituform and do not have local representation. WHEREAS, funds have been budgeted and approved in the Wastewater Utility budget for 1999; and . WHEREAS, Section 8-160(d)(1)(a) of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and services writhout utilizing a competitive bidding process where the Purchasing Agent determines that only one responsible source exists;and WHEREAS, the Purchasing Agent has determined that only one responsible source exists, and has submitted the requisite justification to the City Manager for approval; and WHEREAS, the City Manager has reviewed and approved the justification for this acquisition; and WHEREAS, Section 8-160(d)(3)required approval of this purchasing method by the City Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition. NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the acquisition of services from Insituform Technologies, Inc., for the relining of certain existing sewer mains during 1999, at a cost not to exceed One Hundred Ninety Thousand Dollars ($190,000), is hereby approved: Passed and adopted at a regular meeting of the City Council held this 19th day of October, A.D. 1999.
