RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. I i I I I ' FINANCIAL IMPACT: The Ordinance authorizes the transfer of existing appropriations in the amount of$2,429,629 from various stormwater projects to other stormwater projects. I EXECUTIVE SUMMARY: In October, 1998, the Council authorized a city-wide approach to financing capital improvements of the Stormwater Utility. This approach allowed staff and the Water Board to proceed with implementing a 15-year plan to prioritize and construct needed improvements in the City storm drainage system. In March, 1999, the Council amended the Storm Drainage Design Criteria and Construction Standards by revising the Rainfall Intensity Duration Curve Graph. A key element of the revision was to give the Utilities General Manager the authority to enhance drainage basin master plans to provide for additional flood protection. In order to revise and update Storm Drainage Basin Master Plans in the various basins and to reprioritize various projects within the Storm Drainage Fund, a transfer of existing appropriations is needed. The purposes for which the original appropriations were needed no longer exist. Capital projects that are deemed a priority and have adequate appropriations are not affected. The following transfers are being recommended: DATE: April 20, 1999 2 ITEM NUMBER: 17 FROM: Foothills Basin Project $(1,932,933) Cooper Slough Basin Project $( 100,000) Stormwater Office Facility-Depot Project $( 396,696) TO: Basin Master Plans Project $ 410,000 Flood Mapping & Precipitation/ Stream Gaging Project $ 168,411 Storm Drainage Fund Minor Capital $ 851,216 Old Town Basin Project $ 1,000,000 The transfer of$410,000 to the Basin Master Plans Project will allow staff to proceed with revising and updating Basin Master Plans in all of the City's storm drainage basins. The transfer of$168,413 to the Flood Mapping & Precipitation/Stream Gaging Project will cover expenses related to the City's Flood Warning System that are not funded by FEMA. The transfer of$851,216 to Storm Drainage Fund Minor Capital includes $193,716 for staff support to master plan consultants, $299,000 for various minor capital projects, and $358,500 for storm drainage repay agreements related to new development. The transfer of$1,000,000 to the Old Town Basin Project will allow staff to proceed with construction of the Howes Outfall and Locust Outfall Projects. ORDINANCE NO. 5 3. 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF EXISTING APPROPRIATIONS IN THE STORM DRAINAGE FUND WHEREAS,on October 6, 1998,the Council approved Ordinance No. 168. 1998,adopting a city-wide approach to stormwater monthly capital fees; and WHEREAS, staff and the Water Board developed an approach whereby prioritization of storm drainage improvements and financing of these projects would be handled through a combination of debt financing and fees assessed against property owners and developers; and WHEREAS, the approach developed by staff and the Water Board provided for a 15 year construction schedule for completing remaining improvements in basins with adopted Master Plans; and WHEREAS, on March 16, 1999, the Council approved Ordinance No. 42. 1999, which amended the Storm Drainage Design Criteria and Construction Standards by revising the Rainfall Intensity Duration Curve Graph; and • WHEREAS, Ordinance No. 42, 1999, provided that the Utilities General Manager has the authority to enhance drainage basin master plans to provide for additional flood protection; and WHEREAS,in order to revise and update Storm Drainage Master Plans in the various basins and to reprioritize various projects within the Storm Drainage Fund, a transfer of existing appropriations is needed; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the funds were initially appropriated no longer exists; and WHEREAS, staff has advised the Council that the original purposes for which the funds described below were appropriated no longer exist. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following unexpended and unencumbered appropriated amounts are hereby authorized for transfer,and appropriated in the respective new accounts in the Storm Drainage Fund: FROM: Foothills Basin Project $(1,932,933) • Cooper Slough Basin Project $( 100,000) Stormwater Office Facility-Depot Project $( 396,696) TO: Basin Master Plans Project $ 410.000 Flood Mapping & Precipitation/ Stream Gaging Project $ 168.413 Storm Drainage Fund Minor Capital $ 851.216 Old Town Basin Project $ 1,000.000 Introduced, considered favorably on first reading, and ordered published this 20th day of April, A.D. 1999, and to be presented for final passage on the 4th day of May, A.D. 1999.
