RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY Council has asked for a review of the City's Stormwater Best Management Practices. City staff has requested assistance from Colorado State University. This Ordinance,adopted on First Reading on June 3, 2008 by a vote of 6-0 (Councilmember Troxell withdrew due to a conflict of interest), appropriates $303,012 from Stormwater reserves to fund the services to be provided by the Urban Water Center at Colorado State University. BACKGROUND City Council has asked for a review of the City's Stormwater Best Management Practices(BMPs). City staff has requested assistance from Colorado State University. The first phase includes: June 3, 2008 -2- Item No. 16 A-B • Review of current stormwater BMPs, and • Recommended changes in practice and design criteria, including appropriate Low Impact Development (LID)prac nsierkby Any proposed changes will be C puncil in a first quarter of 2009. The second and concurrent phase is: • Monitoring performance of certain existing stormwater water quality facilities; • Recommending performance and operational changes for existing facilities; • Monitoring results of performance modifications; and • Pilot testing of selected LID practices and BMP renovation demonstration projects. The total length of the agreement will be three years, with the results of the second phase used for continuous improvement to stormwater BMPs. This review of stormwater practices and the proposed agreement with Colorado State University also support the Utilities 21 st Century Initiative to implement sustainable utility practices. This study uniquely positions the University to perform the work requested by the City. In addition,the availability of graduate students,under the supervision of Dr.Larry Roesner,Director of the Urban Water Center,results in substantially lower cost to the City. Finally,the proposed agreement will strengthen the relationship between the City and the University, support the goals of the UniverCity Connections Program and connect the University to the City, Downtown, and the Poudre River. r nI A i .., ORDINANCE NO. 063, 2008 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE STORMWATER FUND FOR REVIEW OF STORMWATER BEST MANAGEMENT PRACTICES AND IMPLEMENTATION OF LOW IMPACT DEVELOPMENT DEMONSTRATION PROJECTS WHEREAS, the City Council has requested a review of current Stormwater Best Management Practices; and WHEREAS, such a review supports the Utilities 21st Century Initiative to implement sustainable utility practices; and WHEREAS, the Urban Water Center at Colorado State University ("CSU") is recognized nationally as a leader in stormwater best management practices and is engaged in a study of such practices commissioned by the Colorado Stormwater Council; and WHEREAS, by virtue of Colorado State University's ongoing work in the field of stormwater best management practices,the Urban Water Center is uniquely positioned to leverage the results of concurrent studies with a review of the City's stormwater practices; and WHEREAS,the Colorado Stormwater Council study allows for strong synergy in the review of the City's stormwater practices and would lower the City's cost of review due to the participation of graduate students; and WHEREAS,one of the purposes ofUniverCity Connections is to bring CSU,the City of Fort Collins, Downtown, and the Poudre River together in harmony with our natural environment and utilizing the services of CSU to review the City's stormwater practices would further this purpose; and WHEREAS,City staff has recommended,and by authorization of Resolution 2008-054,the Council has authorized an agreement between the City and CSU for the above described purposes; and WHEREAS, the funds needed to carry out the City's financial obligations under this agreement are available from the Stormwater Fund prior year reserves; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from Stormwater Fund Prior Year Reserves the sum of THREE HUNDRED THREE THOUSAND AND TWELVE DOLLARS ($303,012),to be used to fund the City's obligations under the above-referenced intergovernmental agreement with Colorado State University for the review of the City's stormwater best management practices and implementation of low impact development demonstration projects. Introduced,considered favorably on first reading,and ordered published this 3rd day of June, A.D. 2008, and to be presented for final passage on the 1st da uly, A.D. 2008.
