RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: The City will pay$2,736.17 per month($32,834 annually), less the reduction in property taxes for the leased property, as determined by the County Treasurer. Funds are available in the Library's 1999 operating budget to pay the rent and needed utilities. 0 EXECUTIVE SUMMARY: Adoption of this Ordinance authorizes the terms of the lease for 101 Remington Street and will permit the Larimer County Treasurer's office to remove the Leased Property from the tax rolls in accordance with Section 31-15-(801 and 802) C.R.S. This will result in lower lease costs for the City. In order to have this leased space become tax exempt, it is necessary to have the Council approve the terms of the lease by Ordinance. The Library needs to move its Technical Services (processing) function into a 3,794 square foot facility at 101 Remington Street, Suites F,M, 0 and Q. to meet the growing demands for space at the main library. The gross rental for this facility is $2,716.17 per month,including taxes. This amount will be reduced after approval of the Ordinance. The amount of tax abatement, (and the rent reduction amount) will be determined by the Latimer County Assessor's Office. The City's other responsibilities as Tenant will be for utilities, routine janitorial, maintenance, and personal property insurance. The term of this lease runs from Februaryl, 1999 until January 11,2004, with the option of a third year anniversary cost of living adjustment not to exceed 4% annually, and annual cost of living adjustments thereafter. ORDINANCE NO. 16, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE TERMS OF THE LEASE AGREEMENT FOR 101 REMINGTON STREET, SUITES F, M, 0 AND Q WHEREAS,the City is leasing 3,794 square feet of office and work space at 101 Remington Street, Fort Collins, Colorado (the "Property"), pursuant to a Lease Agreement dated January 8, 1999, for a term beginning February 1, 1999 between the City and the owner of the property, Jim Stouffer(the "Lease Agreement"); and WHEREAS,under the Lease Agreement,the gross annual rent paid by the City is $32,834 subject to a cost of living adjustment in the third year of up to 4%; and WHEREAS,the Lease extends through January 31,2004,contingent upon the City's annual appropriation of sufficient funds to meet the City's lease obligations; and WHEREAS, the City may extend the Lease Agreement for up to four additional one-year terms; and WHEREAS, sufficient funds have been budgeted and appropriated by the City to meet its obligations for the first year of the Lease Agreement; and • WHEREAS,in orderforthe Propertyto be exempt from taxation,Section 31-15-801,C.R.S., requires that the Lease Agreement and the terms thereof must be approved by ordinance by the City Council; and WHEREAS,the City Council wishes to approve the Lease Agreement by ordinance so that the Property may be removed from the tax rolls. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council hereby approves the terms and conditions of the Lease Agreement between the City and Jim Stouffer, dated January 8, 1999, for 101 Remington Street, Suites F, M, 0 and Q,a copy of which is on file in the office of the City Clerk and available for public inspection.
