Pavement Management Program Ballot Measure.
GENERAL DIRECTION SOUGHT AND SPECIFIC QUESTIONS TO BE ANSWERED
The Pavement Management program provides funding for the repair and renovation of the City's
street system. All 475+ miles of City streets are covered by the program including arterials,
collectors and residential streets. The program covers major maintenance and preventative
maintenance of streets including repairs, renovations and reconstruction when necessary.
Maintenance is also performed on curbs, gutters, bridges, sidewalks, parkways, shoulders and
medians.
The renewal of the Street Maintenance sales and use tax would provide approximately$5.5 million
per year for the program. Current funding sources are detailed in Attachment 1.
1. Shall staff continue to prepare materials for the Pavement Management Program to be
placed on the April 2005 ballot?
At the November 30, 2004 study session,City Council provided direction to staff regarding the
renewal of two Building Community Choices capital sales taxes, currently set to expire
December 31, 2005. Councilmembers present for the study session agreed that the Pavement
Management sales tax measure should be pursued for the April 2005 ballot. The Community
Enhancements package was deferred until the November 2005 election. In order to place the
measure on the April ballot, Council must adopt a resolution by February 1, 2005.
2. Does City Council have any questions or comments regarding the proposed Ballot
Language?
The proposed ballot language(Attachment 2)provides for renewal of the existing sales tax at the
current rate of 0.25%. The ballot language details how the proceeds of the tax can be used and
notes that revenues would not be limited by Article X, Section 20 of the Colorado Constitution
(TABOR).
3. What should be the term of the tax?
A date for the expiration of the tax must be added to the proposed ballot language. A term of
8, 10, 15,or 20 years are possible options for Council consideration. As a basic service funding
by this resource, staff recommends a long term for the tax. At the November 30 study session,
Council discussed the tax term. Councilmembers present were split on the number of years that

the renewal should run. Some were in favor of an 8-10 year term,while others favored a longer
term for the tax, such as 20 years. The term of the tax must be set when the ballot language
resolution is considered on February 1, 2005.

Pavement Management Program Capital Sales Tax
January 3, 2005
SHALL CITY OF FORT COLLINS TAXES BE INCREASED BY AN ESTIMATED
$ FOR THE FIRST FULL FISCAL YEAR(2006) AND BY SUCH AMOUNTS AS
MAY BE GENERATED ANNUALLY THEREAFTER BY EXTENDING THROUGH
DECEMBER 31,20_THE EXISTING SALES AND USE TAX FOR STREET MAINTENANCE
AND OVERLAY AT THE RATE OF 0.25%(25 CENTS ON A$100 PURCHASE),WHICH TAX
IS PRESENTLY SCHEDULED TO EXPIRE DECEMBER 31, 2005; PROVIDED THAT THE
REVENUES DERIVED FROM SUCH TAX EXTENSION SHALL BE USED TO PAY THE
COSTS OF PLANNING, DESIGN, RIGHT-OF-WAY ACQUISITION, INCIDENTAL
UPGRADES AND OTHER COSTS ASSOCIATED WITH:
• THE REPAIR AND RENOVATION OF CITY STREETS, INCLUDING BUT NOT
LIMITED TO CURBS, GUTTERS, BRIDGES, SIDEWALKS, PARKWAYS,
SHOULDERS AND MEDIANS;
AND FURTHER PROVIDED THAT THE FULL AMOUNT OF REVENUES DERIVED FROM
• THE TAX EXTENSION MAY BE RETAINED AND EXPENDED BY THE CITY
NOTWITHSTANDING ANY STATE REVENUE OR EXPENDITURE LIMITATION,
INCLUDING THE LIMITATION CONTAINED ARTICLE X, SECTION 20 OF THE
COLORADO CONSTITUTION?
