SUBJECT:
First Reading of Ordinance No.48, 1999,Authorizing the City to Grant a Non-Exclusive Easement
Across Meadow Springs Ranch to Williams Communications,Inc.for Installation and Maintenance
of Fiber Optic Cable.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The Wastewater Fund will receive payment in the amount of$2,254.
EXECUTIVE SUMMARY:
In 1980,the Cities Service Gas Company acquired a 50-foot wide easement across a portion of the
Meadow Springs Ranch near the Colorado/Wyoming border, for installation of a natural gas
pipeline. Williams Communications,Inc.has requested another easement within these boundaries,
but subj ect to the existing pipeline easement,for the installation and maintenance of fiber optic cable
to be used for telephone digital data transmission and internet services. The proposed easement is
10 feet wide and approximately 2,254 feet in length(.51 acres). Staffhas reviewed and recommends
approval of the requested easement.
ORDINANCE NO. 48, 1999
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE
EASEMENT ACROSS MEADOW SPRINGS RANCH
TO WILLIAMS COMMUNICATIONS, INC. FOR INSTALLATION
AND MAINTENANCE OF FIBER OPTIC CABLE
WHEREAS, the City of Fort Collins (the "City") is the owner of the property known as
Meadow Springs Ranch in Larimer County, Colorado ("the Ranch"); and
WTIEREAS,the Cities Service Gas Company has acquired a 50-foot wide easement across
the Ranch for installation of a natural gas pipeline recorded in Book 908 at Reception No. 182993,
in the Weld County Clerk and Recorder Office (the "Pipeline Easement"); and
WHEREAS, Williams Communications, Inc. has requested a 10-foot wide non-exclusive
easement(having an area of.51 acres)to be located within the boundaries of the Pipeline Easement,
and subject to the Pipeline Easement, for installation and maintenance of fiber optic cable, which
easement is described on Exhibit "A" attached hereto and incorporated herein by reference (the
"Fiber Optic Easement"); and
WHEREAS, the estimated value of the Fiber Optic Easement is $2,254; and
'WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or disposition of real property owned by the City will not materially
impair the viability of the City's utility system as a whole if the property is part of the system,that
it will be for the benefit of the City's citizens, and that the sale is in the best interests of the City of
Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above described sale and conveyance of the Fiber Optic Easement will
not materially impair the viability of the City's utility as a whole,will be for the benefit of the City's
citizens, and it is in the best interests of the City.
Section 2. That the Mayor is authorized to execute such documents of conveyance as are
necessary to convey the Fiber Optic Easement interest to Williams Communications, Inc.
Introduced, considered favorably on first reading, and ordered published this 16th day of
March, A.D. 1999, and to be presented for final passage on the 20th day of April, A.D. 1999.

Said right of way and easement herein and hereby granted being ten (10) feet in width throughout
extending on, over and across the below described land, the center line of such right of way and
easement being twenty (20)feet south and parallel to the center line described in Tract 1.
